HomeMy WebLinkAbout206 12-13-1963ORDINANCE NO. 206 AN ORDINANCE PROVIDING CERTAIN MINIMUM STANDARDS FOR AND REGULATING THE INSTALLATION OF ELECTRICAL WIRING AND APPARATUS IN THE CITY OF EULESS; PROVIDING CERTAIN DEFINITIONS, ADOPTING CERTAIN ELECTRICAL CODES; CREATING THE OFFICE OF ELECTRICAL INSPECTOR AND DEFIN- ING THE DUTIES OF SUCH OFFICE; REQUIRING CITY INSPECTION OF ALL ELECTRICAL INSTALLATIONS, CONSTRUCTION AND REPAIR; REQUIRING ELECTRICAL LICENSES AND JOB PERMITS AND PRO - VIDING FEES FOR THE ISSUANCE THEREOF; PROVIDING A CUMULATIVE CLAUSE AND A SEVERANCE CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. WHEREAS, the City of Euless has experienced and is experiencing a rapid increase in residential, commercial and industrial building and construction; and WHEREAS, such rapid increase in the volume of building and construction has emphasized a need for the revision of the Electrical Code; and WHEREAS, the Euless City Council deems it essential, to protect the lives, safety and property of its citizens, to enact a comprehensive electrical ordinances, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. Ta. This Ordinance is and shall be deemed an exercise of the administrative and police powers of the City of Euless, enacted to protect public safety, comfort, welfare and property, and all the provisions hereof shall be construed for the accomplishment of that purpose. II . 6 _4 R 4 1. The term "electrical wiring" herein used is intended to mean the installa- tion of electrical wires, fixtures, appliances, apparatus or the addition to any wires, fixtures, apparatus or appliances used or to be used on or in any building or in any premises for the purpose of transmitting electrical current for electric light, heat, power, house annuciator systems, electric bells, telephones, signal systems, private telephones or telegraph, radios, lighting fixtures, or for any purpose, of any kind, nature or description. 2. "Electrical Contractor" shall mean any person, firm, partnership, or corporation engaged in the business of installing or repairing, or con- tracting to install of repair any electrical wiring. conduits, fixtures, devices, equipment or other electrical materials for conducting, using or consuming electrical energy. 3. "Master Electrician" shall mean any person holding a current Master Electrician's License. 4. "Journeyman Electrician" shall mean and include any person doing the work of installing, repairing or maintaining any electrical wiring, conduits, fixtures, or devices, or any other electrical materials or appliances for conductilg, using or consuming electrical energy and who may engage in such work only under the supervision of, or in the direct employ of a Master Electrician, or Electrical Contractor. S. "Apprentice Electrician" shall mean any person helping a Journeyman or Master Electrician. M. The City of Euless hereby adopts the National Electrical Code as now existing or as hereinafter mended, as the standard for electrical wiring require- ments for the city of Euless. "Aster installations shall comply with specifications of utility company furnishing power. The utility company furnishing power shall have the right to designate service entrance location. IV. 1. There is hereby created the office of Electrical Inspector of the City of Euless, Texas. It shall be the responsibility and duty of the Electrical Inspector of the City of Euless to carry out the terns, provisions and requirements of this Ordinance and to that end he shall be responsible to the City NUnager. 2. There shall be designated from time to time as the need may arise such Assistant Electrical Inspectors as may be deemed necessary by the administrative authority of the City of Euless. 3. The Electrical Inspectors are herein given authority to refuse to issue a permit on an addition to old work where the old work is in an unsafe con- dition until such is changed to come up to a satisfactory condition. All -2 Light, heat and power companies, shall be notified not to make service connections until they receive clearance of written permission from the Electrical Inspection Department. 4. It shall be the duty of the Electrical Inspector to inspect all public and isolated light plants (excepting property of companies and corporations operating under a regular franchise) now or hereafter in operation, at least once in each year, or more often if application is made by=-the owners thereof. They shall see that any dangerous or defective machinery, wires or apparatus are removed immediately at the expense of owner or agent of said property. S. It shall be the duty of the Electrical Inspector to cause all dead wires, unused poles or electric apparatus on the outside of buildings or in streets or alleys to be removed at the expense of the owners by giving the said owners written notice. This does not apply to apparatus owned and operated by the Utility Company. 6. The City Electrical Inspector may be called upon as many times as re- quired to inspect new buildings in course of construction in order not to delay construction, and must inspect such work within 48 hours from the time such request is received, Sunday and holidays excepted. 7. The Electrical Inspector shall have the authority to demand building con- tractors to open such work that in any manner conceals electrical wiring that has been closed without his knowledge or permission, and in no case shall inspectors issue clearance until he is satisfied that the work is in accordance with the provisions of this Ordinance. Inspectors shall have the right to refuse to issue a clearance on any wiring that is concealed in such manner that they cannot fully satisfy themselves that it has been done in accordance with this ordinance. S. The Electrical Inspector shall have the right at all times to make a thorough re- inspection of the installation in or on buildings and /or premises of all electric wiring, electric devices and electric materials now installed or that may hereafter be installed, within the City of Euless, Texas. when the installation of any such wiring, devices or materials is found to be in a dangerous or unsafe condition, the person, firm or corporation owning, using or operating the same shall be notified in writing, and shall make the necessary repairs or changes required to place such wiring, devices and materials in a safe condition and have such work completed within fifteen (15) days from date of said notice or other reasonable period specified by the Electrical Inspector in said notice. -3- 9. The Electrical Inspector is hereby empowered to disconnect or order the public utility company serving electric energy to sever the electrical service to such wiring, device and/or material found to be defectively Installed until the installation of such wiring device and material has been made safe as directed by the Electrical Inspector. Any person, firm or corporation ordered to discontinue any electrical service shall do so within twenty -four (24) hours and shall not reconnect or allow it to be reconnected until notified to do so by the City Electrical Inspector. No person or persons shall hinder or prevent the City Electrical Inspector or his deputies from making any electrical inspection. 10. When service Is discoinnea cted to any building used for commercial or mercantile purposes, theaters, gasoline stations and garages in the corporate limits of the City of Euless, Texas, approval must be obtained from the City Electrical Inspector before reconnecting to the electrical energy. Provided, however, where service Is terminated for non - payment of bill. it shall not be necessary to obtain City approval for reconnecting. 11. The City Electrical Inspector shad have the power to enter any building. structure, alley, lot, manhole or subway during reasonable hours and while in the actual performance of his regular duties he shall have power to arrest, or cause the arrest of any person or persons violating any of the provisions of this Ordinance. V. 1. Electrical Contractors, as that team Is defined In paragraph II hereofs shall be required to have an Electrical C ntractoe s license Issued by the City of Euless. An applicant for an Electrical Contractor's license must hold a Master Electrician's lieeenere as that term Is herein defined. The fee for an Electrical Contractoe a license shall be $100.00 for a period of one year with an annual license renewal fee of $25.00. No person, firm or corpora- tion shall engage In the City of Euless in the business of installing. altering or repairing any electrical wiringj device or equipment, or the installation, alteration or repair or replacement of starterrs, matm, generators, signs or stationary electrical apparatus or appliances n r shall any petrson, firm or corporation In any manner undertake to execute such work without an Electrical Contractor's licensee Issued by the City of Euless, Twos. Z. Electrical Contractors, as that term is herein defined, shall be required to maintain a surety band in such amount as may be from time to time re- quired by the Euless City Council. 3. No person shall act as a 'aster Electrician or a journeyman Electrician without an appropriate current electrician's license Issued by the City of Euless. -4- All Applicants for a Master Electrician's license and journeyman Electrician's license shall be required to pass an examination given by the City. Tests will be conducted periodically by the City as the same may be necessary. Applications must be filed with the City Secretary a minimum of ten (10) days prior to the date of the test. An examination fee of $10.00 shall be required for a Master Electrician test. An examination fee of $5.00 shall be required for a journeyman Electrician test. A Master Electrician's license shall cost $S.00 annually and a Journeyman Electrician's license shall cost $2.00 annually. 4. Any person, firm or corporation failing to renew the electrical license held within thirty (30) days after the expiration of same shall be required to make a new application therefor, pay the usual fee for an initial application and pass an examination as required by this Ordinance. S. No person shall help or assist a Master Electrician or a journeyman Electrician without an Apprentice Electrician's license issued by the City of Euless. An Apprentice Electrician's license shall be issued upon request of a licensed Electrical Contractor for an anAual fee of $1.00. An Apprentice Electrician shall not be employed or work on any electrical job without supervision by a Master Electrician or a journeyman Electrician as that term is herein provided. 6. This licenses issued hereunder shall be in the name of the person, firm or corporation as certified by the City Electrical Inspector. 7. It shall be unlawful for any person holding any electrical license.issued hereunder to transfer or allow the use of same directly, or indirectly, by any other person, firm or corporation, for the purpose of obtaining a permit to do electrical work in the City of Euless. 3. No minor, nor any person or persons not of lawful age will be issued a Master Electrician's license. 9. Any person, firm or corporation desiring to secure an Electrical Contractor's license under the terms and provisions of this Ordinance, shall file with the City Secretary an application in waiting and shall deliver the said application to the Chief Electrical Inspector for further handling in accord- ance with the terms and provisions of this Ordinances. -5- 10. It shall be the .duty of the Chief Electrical inspector to make such investigation as he may deem necessary as to all applicants, as to their qualification, fitness, reputation, character and financial ability, and if after such investigation the Chief Electrical Inspector is satisfied with the qualification and fitness of the applicant, he shall notify said applicant la writing of such decision and advise the applicant that if he desires an examination a date, time and place will be set for same. The Chief Electrical inspector shall notify any applicant that takes such examination of his grade within five (5) days after such examination is field. A general average of 75 will be the minimurn passing grade. 11. In the event an applicant fails a city electrical test and feels that he I as been treated unfairly, he may appeal from the decision of the City Electrical Inspector to the City Manager who may order and supervise a second examination. 12. Upon approval of an examination, the Chief Electrical inspector shall certify such approval to the Inspection Department who shall, upon payment of the fee as required by this Ordinance, issue to the applicant a certificate of qualification and license. VI. 1. No wiring device or equipment for the transmission, distribution or utilization of electrical energy for light, power and/or heat shall be installed within or on any building or structure, nor shall any alteratio , or addition be made to any such existing wiring device or equipment without first obtaining a permit therefor from the Inspection Department as stated in the following paragraphs. 2. No permit will be required for the replacement of lamps or the connection of portable devices to suitable receptacles which have been permanently installed. 3. No permit will be required for the installation of wiring and equipment for the operation of transmission of intelligence where such wiring, devices and equipment operate at a voltage not exceeding 25 volts between conductors. 4. Applications for electrical permits shalt describe the work to be done and shall be made in writing to the Electrical Inspector by the person, firm or corporation installing the work and the permit, when issued, shall be to such applicant. ..5.. S. The Electrical Inspector may require that an applicant for a permit furnish complete plans and specifications for the Installation showing sizes of conductors and such other details as may be necessary to determine whether the installation as described will be in conformity with the requirements of this Ordinance. 6. The issuance of a permit shall not be taken as permission to violate any of the requirements of this Ordinance. 7. The fees to be charged for inspection of any electrical work in the City of Euless, Texas, shall be paid at the office of the City Secretary before work is commenced a. id -shall be as follows: (a) For electric motors up to and Including 3/4 H . P . , $0.75 (b) For electric motors from 3/4 H. P, to and including 5 H. P. , S 1.50 each; for electric motors from 5 H. P. up to and including 15 H. P. , $3.00 each; for electric motors to exceed 15 H.P. , $4.00 each. (c) For electric generators, including sv4tchboards and wwItors not in excess of 10 K. W . , $10.00 each. (d) For electric signs, $0.50 per circuit for the first four circuits; $0.25 per circuit for all electric sign circuits thereafter; for connections of electric signs, $1.04, for neon strip and outline lighting, $1.00 for the first circuit and $0.50 for each additional circuit. (e) For motion picture projection machines, $2.00 each; for rectifiers, 41.50 each; for motion picture sound apparatus, including the complete circuit, pick -up devices, sound panel and speakers, $S. 00 each, for spot light when permanently installed, $1.00 each. (f) For transformer type welders or plug receptacles for welders, $1.50 for each outlet. (q) For inspection of repair work where no additional outlets are added, $1.00 each. (h) For changing, extending or relocating the service equipment when not in excess of 30 amps, $A.00; more than 30 amps but not in excess Of 60 amps, $1.50; for more than 60 amps, but not in excess of 140 amps, $2.00, for more than 100 amps, $3.00. (i) A free of $2.00 shall be charged for the inspection of electrical apparatus where no fee is herein otherwise provided. A fee of $1.50 shall be charged for re- inspection of wiring having twice been rejected by the Electrical Inspector as not meeting regulation requirements. (�) An inve stigatioa fee of $2.00 shall be urged if the office of the Electrical Inspector is not notified within 72 hours (j unda3y& and legal holidays excepted) after a specific job is started. (k) A separate job permit shall be required for each separate storage space in store buildings: a separate job permit shrill be required for each separate electrical service in apartment buildings and other multiple dwelling buildings. -7- W Commercial heating and air conditioning fees as follows: Air conditioning, a minimum of $2.00 up to 5 tons plus an additional $0.39 per tan thereafter. Heating, a minimum of $2.00 up to i5, 000 B. T. U. plus $0.50 for each additieusal 25, 040 B.T.U. thereafter. S. Residential inspection fees: $ 50. - $ 4,999. $ 9.00 $ 10.00 $ 13.00 $ 2.00 $ 2.00 5,000 . • 9,000. 8.00 10.00 12.00 2.00 2.00 10,000. 14,999. 8.00 10.00 12.00 3.00 2.00 15,000. " Up 10.00 12.00 14.00 2.00 2.00 9. There shall be charged a reinspection fee of $1.00 where it is necessary for the Electrical tnapector to reinspect any phase of an electrical lob. vn . 1. Wiring installed in the City of Euless, Texas, is to be no less grade than non - metalic sheathed cable. Aluminum wiring may be used as designated in the National Electrical Code, provided that aluminum wire smaUear then 6 -AWG shall not be used. Wiring of hasardous locations shall comply with Article 500 of the ?National Electrical Code. 3. All throo (3) phase power wiring shall be installed in metal conduit. All electric motors rsust be grounded. 3. Service entrance panels may be installed in any accessible place in dwellings excluding baths and heater closets. All service entrance risers must be conduit. Meter bass and riser must be secured on service mask, not less than 3" ridged pipe must be used. 4. All dwellings of 1050 sq. ft. to 1999 sq. ft. must have not less than 100 amps service entrance conductors. All dwellings of 2000 sq. ft. or more must have not lose than 150 amps service entrance conductors. S. Dish washers, washing machines and disposals must each be on a single circuit of no less tha;a Rao. 12 -2 with ground. Clothes dryers must be on a separate circuit of no less than No. 10 -3 with ground. Wlurre electric ovens and ranges are separate and distinct appliances they shall be on separate circuits of not less than No. 10 -3 with ground provided such wire is capable of carrying connected lead. Where electric ranges and ovens are a single unit, no less than No. 6 -2 8 -1 conductors shall be used, provided conductors must be sized to carry connected load. ..g.. 6. All electric homes must have a computed load and entrance cable size turned in with application for electrical Permit. Installation shall be 1255 of calculated load. All calculations shall be made according rding to the National Mactrical Cade specifications. i. All temporary pules must be at least 103 ft, high and have two circuit breakers in approved rain shield type box. No fins will be allowed. Switch box and sockets must be grounded and pole properly braced. Utility company may refuse to hook up any pole found in an unsafe con- dition. S. On all commercial Installations the Electrical CcsAtractaar ,shall furnish the City of Euless Inspeection-Departmeent a calculated load and riser d1aagra: prior to requesting electrical permit. All commercial Installa- tions shall be 12S% of calculated load. ✓9. On all rewiring of old installations the mdring rgay be done according to Ci•.apte3r 9, Table 4--A, National Code on rewiring. A.i►I used electrical wiring must be layed in conduit. All electrical wiring la; d or Installed through masonery shall be installed in conduit. 12. No fuse or circuit breaker or current limiting device shall be replaced with ea fusee, circuit breaker or current limiting device of greater current limiting capacity than that specified in the National Electrical Code. 13. All electrical service must be mounded with not leans than No. 8 wire. The service must be gtoanded to cold water liner. If water lure is not available, grounding shall comply with National Electrical Coder spe>cctfica- Uons. 14. For residential wiring not more than eight (8) hoot openings :shall be Installed on one 15 amp circuit. Two appliance circuits must be Installed in all new work. 'There shall be at least one base receptacle but not more than four on a circuit of No. 12 wire. The appliance circuit load shell not exceed a 13501 watt load. A grounded appliance plug will be used on all appliance circuits. 15. All ungrounded wires of branch circuit must be protected by fuses or circuit breakers. The neutral conductors must be Identifieed and properly connected to all branch circuits and connected to the screw shell of all sockets and nosed not be fused. 16. Fain entrance switches at circuit breakers in escceass of 4003 amps must be mounted on plyboards, approved for the purposes and locatian. ..9,. 17. Service entrance switches* suit breakers, or fuse cabinets Installed on the outside of buildings or structures must be City approved weather- proof design. 18. No open splices will be allowed in any electrical wiring. All preen field must terminate in a boast. 19. This Ordinance shall apply to electrical work done upon any structure in the City of Euless, Texas. 20. Only authorised personnel of power company shall be permitted to make electrical service connections to power company lanes. In emergency situations where representative of power company cannot be contacted# Electrical Contractors licensed by the City of Euless may be permitted to make ccrunections. In such event, Contractor must notify power company and City Siectrical Inspector within twenty -four (24) hours. 21. Electrical job permits are not transferrable, _ Electrical Contractor holding permit on Job must request fined insp"n by City. No Electrical Contractor will be issued a pesrmIt on any building where another contractor holds a permit for same building. No contractor can continue to complete another con- tractor's urwk unless the original contractor cancels his permit, or City Council finds Electrical Contrmetiorr at fault in failing to complete his work. Wil .�� t{ Should any section,, article, provision or peat of this Ordinance be declared to be unconstitutional and void by a coact of competent jurisdictiont such decidions shall in no way affect the validity of any of the remaining parts of Oda Ordinance unless the part held unconstitutional at void is Inseparable from and indispensable to the operation of the remaining parts. The City Council herby declares that It would have paasssed those parts which may be unconstitutional at the time of the passage of this Ordinance, IX. A Any person, firm or motion violating any of the rimvisions of this Ordirams shall be deemed guilty of a misdemea a r and the person, Wm or Moon, or an employee, an agent, manager, or officer thereof shall be fined in any amount not less than $2 S. 00 nor more than $200.00 for each offence, and every violation of each and every day's failure or refusal to comply with the said provisions will constitute a separate offence, and in case of vAllful or continued violations by any person, firm or motion as aforesaid, or their ag"ts, employees, servants or vfficaars, the City shall have power to revoke and repeal any License under which said person, firm or motion may be acting, and revoke all posits, privileges and hawhisec granted to said person, firm or corporation aforesaid.
