BONDS, SERIES 1964, AND $100,000 "CITY OF
EULESS, TEXAS, PARK BONDS, SERIES 1964",
ALL DATED SEPTEMBER 1, 1964

ON THIS, the 22nd day of September, 1964, the City
:Council of the City of Euless, Texas, convened in regular session
at the regular meeting place thereof in the City Hall, there being
present and in attendance the following members, to -wit:

BILLY OWENS
FRANK E. DOUGLASS
BOBBY R. FULLER COUNCILMEN
DON R. WARREN
BILL L. BYERS
and
MRS. VADA FERRIS CITY SECRETARY
also being present, and with the following absent: none
consti%,uting a quorum, at which time the following among other
business was transacted, to -wit:
Mayor Fuller introduced a proposed ordinance. The
ordinance was read in full.
Councilman Byers made a motion that the
Charter provision requiring ordinances to be read at two regular
Council meetings be suspended. The motion was seconded by Council -
man Owens and carried by the following vote:
AYES: Councilmen Owens, Douglass, -
Fuller, Warren and Byers.
NAYS: None.
Councilman Byers made a motion that the ordi-
nance be passed finally as an emergency measure. The motion was
seconded by Councilman Owens and carried by the follow -
ing vote:
AYES: Councilmen Owens, Douglass,
Fuller, Warren and Byers.
NAYS: None.
The Mayor announced that the ordinance had been finally
passed.
The ORDINANCE is as follows:
AN ORDINAINTCE by the City Council of the City of
Euless, Texas, authorizing the issuance of $900,000
"CITY OF EULESS, TEXAS, GENERAL OBLIGATION BONDS,
SERIES 196+ ", dated September 1, 1964, for the pur-
pose of making permanent public improvements, to-wit:
$430,000 for constructing street improvements in and
for said City, and drainage incidental thereto;
$250,000 for constructing and equipping a community
center building in and for said City and the acquisi-
tion of a site therefor; $130,000 for constructing
and equipping a police station and courts building
in and for said City and the acquisition of a site
therefor; and $90,000 for constructing and equip,''.,,g
a fire station building in and for said City and the
acquisition of a site therefor; and authorizing the
issuance of $100,000 "CITY OF EULESS, TEXAS PARK
BONDS, SERIES 196+11, dated September 1, 1964, for the
purpose of making permanent public improvements, to
wit: purchasing and /or improving lands for public
parks in and for said City; prescribing the form of
the bonds and the form of the interest coupons; levy-
ing a continuing direct annual ad valorem tax on all
taxable property within the limits of said City to
pay the interest on said bonds and to create a sinking
fund for the redemption thereof and providing for the
assessment and collection of such taxes; enacting
provisions incident and relating to the purpose and
subject of this ordinance; and declaring an emergency.
WHEREAS, pursuant to a resolution and order duly adopted
and passed by the City Council of the City of Euless on the 23rd
day of June, 1964, an election was held on the 11th day of July,
1964, and resulted favorably to the issuance of general obligation
bonds of said City to mature over a period of years not to exceed
fog,ty years from their date, and to bear interest at not to exceed
5% per annum, as follows:

and equipping a community center building
in and for said City and the acquisition
of a site therefor;

general obligation bonds for permanent
public improvements, to -wit: constructing
and equipping a police station and courts
building in and for said City and the
acquisition of a site therefor; and
$ 90,000
general obligation bonds for permanent
public improvements, to -wit: constructing
and equipping a fire station building in
and for said City and the acquisition of
a site therefor;
AND WHEREAS, the City Council has heretofore canvassed
the returns of said election and by resolution passed and adopted
on the 11th day of July, 1964, the City Council found that said
election had been conducted in the manner prescribed by law and
was in all respects legally held after due and proper notice as--
required by law; that due returns of said election had been made
by the proper officers; that said election resulted favorably to
the issuance of said bonds; that a majority of the resident qual-
ified electors, who owned taxable property in said City and had
duly rendered the same for taxation, voting at said election voted
in favor of the issuance of said bonds; and that the City Council
was in all things authorized to issue said bonds and to do any and
all things necessary and /or convenient in connection therewith; and
WHEREAS, it is now determined by the City Council that
In its judgment it is desirable to issue at this time only such
of the total voted authorizations of bonds as are hereinafter pro-
vided to be issued and as shown by the tabulation below, it being
undo- :stood that the City Council reserves the right and authority
to issue the remaining amount of bonds authorized in one or more
series at a future date or dates when, in the judgment of the City
Council, such amounts are needed for their authorized purposes.
AND WHEREAS, this City Council deems it advisable and
to the best interest of the City that the bonds of the authoriza-
tions hereinabove described, except the park bonds which are herein
authorized as a separate issue, shall be issued in a single combined
series; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS:
PERTAINING TO THE GENERAL OBLIGATION BONDS
SECTION 1: That the bonds of said City, to be known as
"CITY OF EULESS, TEXAS, GENERAL OBLIGATION BONDS, SERIES 196411, be
and the same are hereby ordered to be issued in the principal sum
of NINE HUNDRED THOUSAND DOLLARS ($900,000) for the purpose of
making the following permanent public improvements, to -wit:
*430,000 for constructing street improvements in and for said City,
and drainage incidental thereto; $250,000 for constructing and
equipp :.ng a community center building in and for said City and the
acquisition of a site therefor; $130,000 for constructing and equip-
ping a police station and courts building in and for said City and

AND WHEREAS, this City Council deems it advisable and
to the best interest of the City that the bonds of the authoriza-
tions hereinabove described, except the park bonds which are herein
authorized as a separate issue, shall be issued in a single combined
series; therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS:
PERTAINING TO THE GENERAL OBLIGATION BONDS
SECTION 1: That the bonds of said City, to be known as
"CITY OF EULESS, TEXAS, GENERAL OBLIGATION BONDS, SERIES 196411, be
and the same are hereby ordered to be issued in the principal sum
of NINE HUNDRED THOUSAND DOLLARS ($900,000) for the purpose of
making the following permanent public improvements, to -wit:
*430,000 for constructing street improvements in and for said City,
and drainage incidental thereto; $250,000 for constructing and
equipp :.ng a community center building in and for said City and the
acquisition of a site therefor; $130,000 for constructing and equip-
ping a police station and courts building in and for said City and

stitution and laws of the State of Texas and pursuant to the
Charter of said City..
SECTION 2: That said bonds shall be numbered consecu-
tively from One 1 through One Hundred Eight (180); shall be in
denomination of Five Thousand Dollars ($5,000 each; aggregating
t:ze sum of NINE HUNDRED THOUSAND DOLLARS ($900,000); shall be dated
September 1, 1964, and shall become due and payable serially on
September 1 in each of the years in accordance with the following

1984, or on any interest payment date thereafter, at the price of

PROVIDED, FURTIiER, that at least thirty (30) days prior to any

SERIES 1964
The CITY OF EULESS, a municipal corporation of the
State of Texas, acknowledges itself indebted to and, FOR VALUE
RECEIVED, hereby promises to pay to bearer, the sum of
FIVE THOUSAND DOLLARS
($5,000), in lawful money of the United States of America, on the
FIRST DAY OF SEPTEMBER, 19 , with interest thereon from the
date hereof to maturity at the rate of PER CENTUM
(_ o) per annum, payable on March 1, 1965 and semi-annually
thereafter on September 1 and March 1, in each year, and interest
falling due on or prior to maturity hereof is payable only upon
presentation and surrender of the interest coupons hereto attached
as trey severally become due.
BOTH PRINCIPAL and interest of this bond are hereby made
payable at the First National Bank, Fort Worth, Texas
without exchange or collection charges to the owner or holder, and
for the prompt payment of this bond and the interest thereon at
maturity, the full faith, credit and resources of the City of
Euless, Texas, are hereby irrevocably pledged.
THIS BOND is one of a series of One Hundred Eighty (180)
serial bonds, numbered consecutively from One (1) through One Hun-
dred Eighty (180), in denomination of Five Thousand Dollars
(S5,000� each, aggregating NINE HUNDRED THOUSAND DOLLARS ($900,000),
issued for the purpose of making the following permanent public
improvements, to -wit: $430,000 for constructing street improve-
ments in and for said City, and drainage incidental thereto;
$250,000 for constructing and equipping a community center building
in and for said City and the acquisition of a site therefor;
$130,000 for constructing and equipping a police station and courts
building in and for said City and the acquisition of a site there-
for; and 590,000 for constructing and equipping a fire station
buildinS in and for said City and the acquisition of a site there -
for, under authority of the Constitution and laws of the State of
Texas, and pursuant to the Charter of said City of Euless and an
ordinance duly adopted by the City Council of the City of Euless,
Texas, and duly recorded in the Minutes of said City Council.
AS SPECIFIED in the ordinance hereinabove mentioned,
the City of Euless, Texas, reserves the right to redeem bonds num-
bered 87 through 180, of this series, in whole or in part, but in
inverse numerical order if less than all, on September 1, 1984, or
on any interest payment date thereafter, at the price of par and
accrued interest to the date fixed for redemption; PROVIDED, HOW -
EVER, that at least thirty (30) days prior to any interest payment
date upon which any of said bonds are to be redeemed, a notice of
redemption, signed by the City Secretary (specifying the serial
numbers and amount of bonds to be redeemed) shall have been filed
with
and should any bond or bonds not be presented for redemption pur-
suant to such notice, the same shall cease to bear interest from
and after the date so fixed for redemption.
IT IS ITSREBY CERTIFIED, RECITED AND REPRESENTED that the
issuance of this bond and the series of which it is a part is duly
autizo-rized by law and by a vote of the resident qualified electors
of t- e City of Euless, Texas, who owned taxable property therein
and who had duly rendered the same for taxation, voting at an elec-
tion held for that purpose within said City on the 11th day of
July, 196+; that all acts, conditions and things required to be
done precedent to and in the issuance of this series of bonds and
of this bond have been properly done and performed and have hap-
pened in regular and due time, form and manner as required by law;
that sufficient and proper provision for the levy and collection
of taxes has been made which, when collected, shall be appropri-
ated exclusively to the payment of this bond and the series of
Z�rhich it is a part, and to the payment of the interest coupons
thereto annexed, as-the same shall become due,.and that the total
indabtedness of the City of Euless, Texas, including the entire
series of bonds of which this is one, does not exceed any Consti-
tutional or statutory limitation.
IN TESTIMONY 1FHEREOF, the City Council of the City of
Euless, Texas, has caused the seal of said City to be impressed
or a facsimile thereof to be printed hereon, and this bond and its
appurtenant coupons to be executed with the imprinted facsimile
signatures of the :Mayor and City Secretary of said City, in accord-
ance with the provisions of the "Texas Uniform Facsimile Signature
of Public Officials Act" enacted by the 57th Legislature of Texas
at its regular Session in 1961; the date of this bond, in conform-

IT IS HEREBY CERTIFIED, RECITED AND REPRESENTED that
the issuance of this bond and the series of which it is a part is

electors of the City of Euless, Texas, who owned taxable property
therein: and who had duly rendered the same for - taxation, voting at
an election held for that purpose within said City on the llth day
of July, 1964; that all acts, conditions and things required to be

SECTION 10: That both principal and interest of said

holder, at the First National Bank, Fort Worth, Texas
upon presentation and surrender of bonds or proper coupons.
SECTION 11: That the seal of said City may be impressed
on each of said bonds or, in the alternative, a facsimile of such
seal may be printed on the said bonds. The bonds and interest
coupons appurtenant thereto may be executed by the imprinted fae-
simile signatures of the Mayor and City Secretary of the City, and
execution in such manner shall have the same effect as if such
bonds and coupons had been signed by the Mayor'and City Secretary
in person by their manual signatures. Inasmuch as such bonds are
rQquirUd to be roglstarcd by the Comptroller of PublIQ Accounts
for the State of Texas, only his signature (or that of a deputy
desic.ated in writing to act for the Comptroller) shall be required
to be manually subscribed to such bonds in connection with his
registration certificate to appear thereon, as hereinafter pro-
vided; all in accordance with the provisions of the "Texas Uniform
Facsimile Signature of Public Officials Act ", enacted by the 57th
Legislature of Texas at its Regular Session in 1961.

SECTION 13: That special funds to be designated
'C L GENERAL 03LIGA^1ION BOND FUND, SERIES 1964" and "SPECIAL

oi all. taxes collected for or on account of each series of bonds
s..all be c:cedited to said respective funds for the purpose of pay-

taxing authority of the City for such purpose is adequate to permit
a legally sufficient tax in consideration of all other outstanding
obligations.
SECTION 14: That the sale of the bonds herein author-
ized to Eppler, Guerin & Turner, Underwood, Neuhaus & Company, First of Texas
Corporation, Dallas Union Securities Company, William N. Edwards & Company
at she price of par and accrued interest to date of delivery, plus
a pre ui.u.;z of None is hereby confirmed. Delivery of the
bonus shall be made to said purchasers as soon as may be after the
adoption of this ordinance, upon payment therefor in accordance
with the terms of sale.
SECTION 15: The purchasers' obligation to accept
delivery of tlae bonds herein authorized is subject to their being
.L- _ishcd a final opinion of Messrs. Dumas, Huguenin and Boothman,
nttcrn::ys, Dallas, Texas, approving such bonds .as to their validity,
said opinion to be dated and delivered as of the date of delivery
and pa5n.ent for such bonds. Printing of a true and correct copy
of said onirion on the reverse side of each of such bonds with
appropriate certificate pertaining thereto executed by facsimile
si&:,ature of the City Secretary is hereby approved and authorized.
SECTION 16: That the Mayor of said City shall be and
he is hereby authorized to take and have charge of all necessary
orders and records pending investigation by the Attorney General
of the State of Texas, and shall take and have charge and control
of the bonds herein authorized pending their approval. by the
Attorney General and their registration by the Comptroller of Pub-
lic Accounts.
SECTION 17: The public importance of this measure, and
the fact that it is to the best interest of the City and its
.....habitants to provide funds for the construction of the public
iprove:erts contemplated, at the earliest possible date, for the
immediate preservation of the public peace, health and safety
constitute and create an emergency and an urgent public necessity
recuirinc, :.hat this ordinance be passed and take effect as an
enargency measure and this ordinance is accordingly passed as an
enc:. .,oency 'imeasure and shall take effect and be in force immediately
from and after its passage.
