AN ORDINANCE AMENDING ORDINANCE NO. 147
ENTITLED SUBDIVSION RULES AND REGULATIONS
BY SPECIFIC AMENDMENT TO ARTICLE III (B) AND
ARTICLE III (D) 2 (e); PROVIDING FOR PUBLICATION
AND FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
1.
That Article III (B) stall be amended to read as follows:
"2. 3UM Sewers:
(a) Preliminary plans and layouts prepared by and bearing the
seal and signature of a rooster" pr>"atessional ononser in the State of
Teams for any drainage structures and Improvements shall be submitted by
the subdivider or developer to the City Planning Commission for study by
the City IIn:jineeer along with the submission of the preliminary plat of the
subdivision. These plans shall show drainage areas contributing to all
facilities and design criteria and calculations for all facilities showing
pireliminary sizing.
(b) Where, in the opinion of the City Enoneeer, strum sewers
are required to adequately accommodate drainage runoff, the subdivider or
developer shall be required to install, at his own expense, all such storm-
sew-or lines and drainage structures which require the equivalent of a 48"
diameter pipe or smaller. Such construction shall be performed in a3ocordance
with the Clay of Euless Standards and Specifications governing same. The
developer shall_ assume all costs including all engineering costs covering
design, layouts, and construction supervision.
(c) Where, in the opinion of the City Enginoer, storm sewers
or drainage facilities are required which are in excess of a 43" diameter pipe,
or its equivalents, the subdivider or developer shall deposit with the City an
amount of money sufficient, in the estimation of the City Engineer, to furnish
and insfsll a 48" diameter pipe, together with all excavation, backfill,
Incidentals and appurtenances which would normally be expected in such a
facility. The City shall them design and contract to construct the facility
of the design and size required. The City shall assume the balance of the
cost above that deposited by the Developer. Participation by the City in such
drainage improvements shall be contingent upon the avilability of funds and
the decision of the City Council to allocate such funds for such purpose."

That Article III D 2(e) shall be amended to read as follows:
"(er) Complete construction plans, bearing a seal and certification
by a registered professional engineer in the State of Texas that such plans
comply with City of Euless Ordinances 121 and 147 and current amendments,
shall be submitted for all street and drainages improvements, alleys and
sidewalks If any, and any other improvements to be performed. These plans
shall be submitted on standard 24" x 36" sheets."

The fact that the health, safety and welfare of the City of Euless
is endangered by the condition that exists in regard to regulations of
subdivisions and that the present regulations applicable thereto in said City
are wholly inadequate for the protection of the public and the preso nation of
the public health, safety and general welfare, makes it imperative that

4.
This Ordinance shall becomes of ative from and after its publication
as required by the Euless City ordinance and the law of the Stater of Texas.
PASSED AND APPROVED by the City Council of the City of Euless,
Texas. on this nth day of Apr i 1 , 1966.
