AN ORDINANCE PROHIBITING LOITERING IN OR
ABOUT ANY PUBLIC OR PRIVATE BUILDING OR
REST ROOM IN THE CITY OF BULESS; DEFINITION
OF TERMS; REQUIRING ANY PERSON OR PERSONS
TO MOVE UPON THE EXPRESS ORDER OF THE OMR
OR PERSON IN CHARGE OF ANY PUBLIC OR PRIVATE
BUILDING OR REST ROOM; PROVIDING THAT THE
ACTS PROHIBITED AND PUNISHMENT THEREFOR
SHALL BE IN ADDITION TO AND SUPPLEMENT
ARTICLES 607, ET SEQ, REVISED CIVIL STATUTES
OF THE STATE OF TEXAS ENTITIED "VAGRANCY";
PROVIDING A PENALTY, A SEVERABILITY CLAUSE,
DECLARING AN EMERGENCY AND PROVIDING FOR
AN EFFECTIVE DATE.
ME IT ORDALNED SY THE CITY C(UNCIL OF THE CITY OF EULESS, TEXAS:
I.
(a) "Public Building" or "Private Building" shall include any
basement, building entrance, exit or doorway, lobby, hallway, stairway,
elevator, or sitting room or other place used in common by the public,
tenants, occupants or guests in any building, public or private, in the
City of Euless.
(b) "Rest Roan" shall include any public or private rest room
located in a public building, in a motel, hotel or other private building.
II.
It shall be unlawful for any person to loiter, sit, stand or remain
in any public room or rest room in a private building or public building in
the City of Euless and such person shall immediately leave, quit or remove
himself from such public room or rest room upon the express order of the
owner or person in charge of such public room or rest room.
III.
It shall be unlawful for any person to use any public room for
business or social purposes in any hotel, private office building or public
building in the City of Euless in violation of the express order of the owner,
lessee, managing agent or person in charge of the building in which such
public room may be situated.
I V.
This Ordinance shall supplement Article 607, Revised Civil Statutes
of the State of Texas entitled "Vagrancy" and the offenses prohibited herein
and the penalty provided therefor shall be in addition to the offenses and
penalties prescribed by such statute.
V.
Any person, corporation, association, partnership or le ml entity
violating any of the provisions of this Ordinance shall be deemed guilty
of a misdemeanor, and upon conviction shall be fined in a sum not to exceed
Two Hundred ($200.00) Dollars.
VI .
Should any section, article, provision or part of this Ordinance
be declared to be unconstitutional and void by a court of competent juris-
diction, such decisions shall in no way affect the validity of any of the
remaining parts of this Ordinance unless the part held unconstitutional or
void is inseparable from and indispensable to the operation of the remaining
parts. The City Council hereby declares that it would have passed those
parts of this Ordinance which are valid and would have omitted any parts
which may be unconstitutional or void, if it had known such parts were uncon-
stitutional or void at the time of the passage of this Ordinance.
VII.
The fact that the present regulation with reference to loitering in or
about any public or private building or rest room in the City of Euless are
deemed inadequate creates an urgency and'an emergency for the immediate
preservation of the public peace, health, comfort, safety and general welfare,
and requires that this Ordinance shall take effect immediately from and after
its passage and publication, and it is accordingly so ordained.
PRESENTED AND GIVEN FIRST READING ON the 14th day of September ,
1965, at a regular meeting of the City Council of the City of Euless,
Texas; and given SECOND READING, passed and approved on the 28th day of
September , 1965 by a vote of 3 ayes and 0 nays at a regular
meeting of the City Council of the City of Euless, Texas.
