HomeMy WebLinkAbout287 08-09-1966ORDINANCE NO. 287 AN ORDINANCE AMENDING ORDINANCE NO. 33 IDENTIFIED AS THE TEMPORARY COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS, PROVIDING FOR CHANGE OF DESIGNATION IN CERTAIN AREA AND AMENDING ZONING MAP TO CONFORM WITH SUCH AMENDMENT: AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: THAT the zoning classification of the following described property, now zoned "A" Residential be changed to "C" Commercial. FIELD NOTES of a 3.544 acre tract of land out of the Terrell Jasper Survey, Abst. 861, Euless, Tarrant County, Texas and being described by metes and bounds as follows: BEGINNING at a point 1n the South R.O.W. line of County Road # 3020, (Huffman Drive) 25 feet South and 278 feet East of the Northwest corner of the Terrell Jasper Survey, said point being the Northwest corner of a 2 acre tract as conveyed to Ruben Jernigan as recorded in Volume 1396, page 401, Deed Records of Tarrant County, Texas; THENCE South 1 deg.01 min. East along the West line of said Jernigan tract 425.0 feet to a point; THENCE South 89 deg.46 min. East 211.0 feet to the Southeast corner of said Jernigan tract; THENCE South 1 deg.01 min. East 196.8 feet to a point; THENCE North 88 deg.23 min. West 389.7 feet to a point; THENCE North 0 deg-59 min. West 620.3 feet to a point in the South line of proposed State Spur Highway #350; THENCE Easterly along said proposed South R.O.W. line North 83 deg.52 min. East 55.95 feet and North 88 deg.19 min. East 122.68 feet to the place of beginning and containing 3.544 acres of land, more or less. THAT the zoning classification of the following described property, now zoned "A" Residential be changed to "A -2" Duplex. FIELD NOTES of a 2.595 acre tract of land out of the Terrell Jasper Survey, Abst. 861, Euless, Tarrant County, Texas and being described by metes and bounds as follows: BEGINNING at a point in the South R.O.W. line of County Road #3020, (Huffman Drive) 25 feet South and 278 feet East of the Northwest corner of the Terrell Jasper Survey; THENCE South 1 deg.01 min. East 425.0 feet, South 89 deg. 46 min. East, 211.0 feet and South 1 deg.01 min. East 196.8 feet to the BEGINNING POINT OF THE TRACT HERE- IN DESCRIBED; THENCE South I deg.01 min. East 290.0 feet to a point; THENCE South 88 deg.23 min. West 389.9 feet to a point; THENCE North 0 deg.59 min. West 290.0 feet to a point; THENCE North 88 deg.23 min. East 38917 feet to the place of beginning and containing 2.595 acres of land, more or less. 2. That the zoning change set forth in Paragraph 1, for changing the zoning classification from "A" Residential to "C" Commercial, shall be subject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within 48 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 54 months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within 00 months following final passage of the ordinance effecting the requested changes. 3. In the event of failure to comply with any one of such conditions subsequent, the zoning of the property in question shall automatically revert to its former use or zoning classification; provided, however, upon the filing of an application at least 30 days prior to the date in question and upon good cause shown the City Council, may, after considering the recommendation of the Planning and Zoning Commission, grant reasonable extensions of time for compliance with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as pro- vided by Ordinance 33 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING ON the 26th day of July , 1966, at a regular meeting of the City Council of the City of Euless, Texas, and given Second Reading, passed and approved on the 9th day of August , 1966, by a vote of 4 ayes and 0 nays at a regular meeting of the City Council of the City of Euless, Texas.
