HomeMy WebLinkAbout300 04-11-1967ORDINANCE NO. 300 AN ORDINANCE REGULATING EMERGENCY AMBULANCE SERVICE WITHIN THE CORPORATE LIMITS OF EULESS; REQUIRING EMERGENCY AMBULANCE SERVICE OPERATORS TO OBTAIM A CITY PERMIT; ESTABLISHING REQUIREMENTS FOR EMERGENCY AMBULANCE S'-:RV I C E WITHIN THE CITY LIMITS OF EULESS; REGULATING AMBULANCE SERVICE CHARGES; PROVIDING FOR THE FAY.14ENT OF CHARGES FOR EMERGENCY AMBULANCE SERVICE; PROVIDING FOR A PENALTY, A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. The following terms, where used in this Ordinance, shall have the meaning and effect hereinafter set forth. Definitions: 1. Emergencv_Ambulance Service - That emergency transporta- tion service furnished to citizens of and other persons within the corporate limits of Euless where there has been a death, personal injury or other emergency requiring the removal of injured persons to a hospital or medical facility for treatment. 2. Emergency Ambulance - A motor vehicle, air plane or helicopter useu primariiy for emergency ambulance transportation in, about or outside the corporate limits of Euless. 3. Funeral Home or Undertaker - or corporation duly licensed embalming service and prepare for interment. 11. Any person, firm, partnership by the State of Texas to perform the bodies of deceased persons No person, firm, partnership or corporation shall engage in the business of operating an emergency ambulance service for hire within the corporate limits of the City of Euless, Texas, without an emergency ambulance service permit from the City of Fuless, Texas. All emergency ambulance service permits issued by the City of Euless shall expire on May 1st of each year and those emergency ambulance service operators intending to continue their service shall each year file a written application for such permit containing the information and in the form prescribed in paragraph III hereof. III. All applicants for an emergency ambulance service permit must furnish the City Secretary the following: 1. A written application stating the location of the applicant's principal place of business and the pioce where its emergency vehicles are normally kept and maintained. 2. Applicant mast furnish satisfactory evidence of personal injury and property damage liability coverage in an amount not less than $254000.00 for personal injury and $10,000.00 for property damage. 3. The written application for an emergency ambulance service permit must contain a statement of applicant's normal rates or charges. 4. A written statement by applicant that the applicant's ambulance drivers shall at all times have a current commercial Texas driving license. 5. That applicant agrees to maintain emergency ambulance vehicles and equipment in operating condition with such minimum safety standards and requirements as may be from time to time required by the Chief of Police of the City of Euless. IV. Regulations governing payment of charges for ambulance services: 1. Any emergency ambulance service operator picking up a dead body from the streets or elsewhere in the City of Euless, hav- ing answered an emergency call, may take and keep such body at its usual place of business until some relative authorized to make funeral arrangements authorizes such emergency ambulance service operator to proceed with the preparing of the body for interment. 2. In the event relatives or friends having authority to make arrangements for the funeral shall desire that some other ende -taker or funeral home take charge of the body, it shall be the duty of the operator having such body in his possession to turn over the same to the funeral home or undertaker selected by friends or relatives having necessary authority upon pay- ment of the customary ambulance fee of not more than $25.00 plus the sum of $5.00 additional if oxygen has been used in the ambulance in providing emergency care and treatment for the deceased. 3. Any person, including the parent or guardian of a minor, know - ingly using the services of an emergency ambulance operator holding a permit to do business within the City of Euless shall be liable to such emergency ambulance opo -,ntor for the amount of charges not to exceed the amount currently charged by such emergency ambulance operator and as set forth in his applica- tion to do business within the City of Euiess. Such charge shall not exceed $25.00 plus the additional sum of $5.00 if oxygen has been used in the ambulance in providing services for the injured or ill person, provided that such $25.00 limit shall not apply to amount of service charges for contract transportation outsi6e Euless. 4. This section shall likewise apply in each case where any person though disabled by injury or illness requires such emergency ambulance service and such emergency ambulance service is called upon for ambulance service by the dispatcher of the Police Department, or by the Director of Public Health of the City to transport any such injured or ill person to a hospital or clinic or his place of aboc'e. 5. In addition to other remedies, the emergency ambulance service operator rendering such service shall have a right to enforce this ordinance by civil action in collecting for rendered services. V. If any section, subsection, sentence, word or phrase of this ordinance shall be declared to be invalid, it shall not affect the validity of the remainder of said ordinance. VI. Any person calling for emergency ambulance service and refusing to pay for such service after use thereof, shall be guilty of a misdeameanor and upon conviction thereof in the corporation court shall be subject to a fine not to exceed Two Hundred Dollars ($200.00). VII. This ordinance shall take effect and be in full force and effect from and af4cr the date of its passage and publication as required by law. r.
