AN ORDINANCE PROHIBITING THE OPERATOR OF A MOTOR
VEHICLE FROM DISREGARDING THE INSTRUCTIONS OF A
POLICE OFFICER; P.10IIBITING THE OPERATOR OF A MOTOR
VEHICLE FROM FLEEING FROM OR RACING A POLICE OFFICER
TO AVOID THE RECEIPT OF A TRAFFIC CITATION OR TO AVOID
ARREST; PROVIDING THAT THIS ORDINANCE BE PUBLISHED IN
THE OFFICIAL CITY NEWSPAPER OF THE CITY OF EULESS AS
REQUIRED BY THE EULESS CITY CHARTER; PROVIDING A PENALTY
AND A SAVINGS CLAUSE AND DECLARING AN EMERGENCY.
WHEREAS, the Euless City Council has determined that there have
occurred recent instances where the operator of a motor vehicle has dis-
regarded the instructions of City of Euless police officers, and
WHEREAS, the Euless City Council has found that on various
occasions operators of motor vehicles have fled from Euless police officers
to avoid receipt of a traffic citation and to avoid arrest, and
WHEREAS, these occurrances have endangered the "Lives of the
citizens of Euless and their property and have endangered the lives of
Euless police officers attempting to perform their duty;
i'OW, THEREFORE, BE IT ORDAINED BY THE EULESS CITY COUNCIL:
That no person operating a motor vehicle on the streets, alleys,
public ways, thoroughfares, private roads open to the public, park drives
or other places where vehicles travel, within the City shall flee from or
seek to evade a police officer after having received an indication either
by the blinking of red lights, the whistling of a siren or the motioning by
the officer to the motorist to halt or to move to the side of the street or
disobeying any other plain and unmist,kable indication that the officer
Is attempting to stop the motorist, or for the purpose of preventing the
receipt by the motorist of a traffic citation or ticket, or in an attempt
to evade arrest.
That any person found guilty of violating this Ordinance shall be
fined a sum not less than one hundred dollars ($100.00) and not to exceed
two hundred dollars ($200.00).
This Ordinance shall be published at least two times In the
official newspaper of the City of Euless, in accordance with the provisions
of the Euless City Charter.
IV.
Should any section, provision, word, phrase, or clause of this
Ordinance or the application thereof to any person, or circumstances be
held Invalid, unconstitutional or ineffective, the remainder of the
Ordinance and the application of such provisions to other persons or
circumstances shall not be affected thereby.
V.
Since the City of Euless has no Ordinance prohibiting the operator
of a motor vehicle from disregarding the instructions of a police officer
and from fleeing from or racing a police officer to avoid the receipt of a
traffic citation or to avoid arrest, there has been created and exists an
urgency and an emergency for the immediate preservation of the public peace,
health and safety, requiring that this Ordinance shall become effective
immediately from and after its passage and publication and it is accordingly
so ordained.

EULESS, TEXAS, on this the 23rd day of January , 1968.
