AN ORDINANCE SETTING FORTH THE COMPROMISE AND
SETTLEMENT AGREEMENT IN CAUSE NO, 37492 -C STYLED
W. FLOYD DEACON, ET AL VS. CITY OF EULESS, IN THE
48TH DISTRICT COURT OF TARRANT COUNTY, TEXAS; DE-
TERMINING THAT CERTAIN TERRITORY IS AN INTEGRAL PART
OF AND WITHIN THE CORPORATE LIMITS OF THE CITY OF
EULESS, TEXAS; ESTABLISHING VALUATION OF CERTAIN
TRACTS FOR TAX ROLL PURPOSES; PROVIDING AN EFFECTIVE
DATE,
WHEREAS, W. Floyd Deacon, Priest Baze and C. O. Crumbley as
Plaintiffs, filed suit against the City of Euless as Defendant in Cause No.
37492 -C in the 48th District Court of Tarrant County, Texas, attacking the
validity of certain annexations to the City of Euless, such annexations and
the territory encompassed thereby being more fully described in City of
Euless Annexation Ordinances 189, 190 and 192, and
WHEREAS, the said W. Floyd Deacon, Priest Baze and C. O.
Crumbley as Plaintiffs in Cause No. 37492 -C have agreed with the City of
Euless, Texas, Defendant therein, that the territory encompassed within
and described by Ordinances 189, 190 and 192 was, is and should be a
legal and integral part of the City of Euless, Texas, and
WHEREAS, the litigation involved in such Cause No. 37492 -C has
been protracted and expensive to both the Plaintiffs and to the Defendant
and has caused a financial drain on the resources of all parties thereto, and
WHEREAS, the Plaintiffs and the Defendant have reached an agree-
ment to compromise and settle all matters in dispute and to dismiss Cause
No. 37492 -C with prejudice to the refiling of same, and
_ WHEREAS, the Plaintiffs and the Defendant, City of Euless, have
all investigated the proposed settlement agreement and have determined
that such settlement is to the advantage of the Plaintiffs and to the City
of Euless and its inhabitants, which includes the Plaintiffs,
NOW, THEREFORE, BE IT ORDAINED BY THE EULESS CITY COUNCIL:
I.
The Euless City Council finds and hereby determines that the tracts
of land described by tax tract designation and with the owner thereof being

designated according to the 1965 City of Euless Tax Assessment Roll, shall
have a tax valuation for the tax years of 1964, 1965, 1966 and 1967 as set
forth in Exhibit "A" attached hereto and incorporated herein by reference.
ii.
The Euless City Council has agreed wit'11 Plaintiffs in Cause No.
37492-C that as a consideration for the dismissal of such law suit with
prejudice and the compromise and settlement of all causes of action raised
thcroin, the tracts of land hereinabove described shall be deemed for v'lx
purposes to have the assessed value as set forth herein in Exhibit "A" until
the occurrance of one of the events described in Paragraph III of this
Ordinance.
III.
The various tracts of land described and set forth in Exhibit "A" of
this Ordinance shall be assessed by the City of Euless at the value established
in Exhibit "A" hereof until the occurrance of any one of the following events:
(a) Until any such tract described in Exhibit "A" of this Ordinance
shall be subdivided into two or more tracts or a part thereof shall have been
sold by the owner listed in this Ordinance, or
(b) Until such time as the tract has been sold by the owner designated
in Exhibit "A" of this Ordinance, or
(c) Until water and sewer mains are installed, layed and operational
within five hundred feet of the nearest boundary line of any such tract set
forth in Exhibit "A" of this Ordinance, provided that such installation of
water arid s ewer mains shall occur after January 1, 1967, or
(d) Until zoning is requested by the owner of such tract as designated
in Exhibit "A" of this Ordinance or platted or replatted for any reason, or
(e) Until December 31, 1973, at which time and date this Ordinance
shall no longer be effective and on and after such date the Euless Tax
Assessor - Collector and the City of Euless shall place an assessed value
on the land described in the attached Exhibit "A" in accordance with the
use then being made by the owner thereof.
IV.
The City of Euless agrees that taxes heretofore paid to the City of
Euless by the property owners set forth in Exhibit "A" of this Ordinance during

the years 1964, 1965, 1966 and 1967 in excess of the annual assessed value
established and set forth in Exhibit "A" of this Ordinance are deemed to be
excess payments and the tax payers actually having made such payment shall
be entitled to a refund of those taxes paid on any given tax year in excess of
the assessed value set forth in Exhibit "A" of this Ordinance, provided that
such tax payer, before receiving such refund, shall present a paid tax receipt
to the City Secretary of the City of Euless for each tax year for which refund
is claimed on or before August 1, 1968. After such date of August 1, 1968, the
City shall be under no obligation to refund any taxes paid by the tax payers
set forth in Exhibit "A" of this Ordinance. The City of Euless further agrees
to waive penalties and interest for non - payment of taxes heretofore levied
and assessed against those properties described in the attached Exhibit "A" .
V.
The City of Euless tax rolls shall be, and are hereby amended to
reflect the assessed valuations set forth opposite the various tax tracts in
Exhibit "A" of this Ordinance.
VI.
The territory encompassed by and within Euless Annexation Ordinances
189, 190 and 192 and being more fully described in the attached Exhibit "B" has
been found and determined by the Euless City Council to be a legal and integral
part of the City of Euless, Texas, having been considered and treated as a part
of the City of Euless, Texas, since June 25, 1963. That Exhibit "B" attached
hereto is incorporated by reference into this Ordinance and made a part hereof.
VII.
The assessment valuation of all other territory encompassed in Euless
Annexation Ordinances 189, 190 and 192, not expressly referred to in the
attached Exhibit "A" shall not be affected by the terms of this Ordinance and
the valuation of the other such territory encompassed in Euless Annexation
Ordinances 189, 190 and 192, and any territory described and listed in the
attached Exhibit "A" where the use and character thereof has been or shall
be changed by the occurrance of any of the events listed in Paragraph III of
this Ordinance shall be made by the Euless Tax Assessor - Collector and ad-
justed from time to time in accordance with the use then being made by the
owner thereof. From and after the adoption of this Ordinance, the City of
Euless shall have the right to reassess any land subdivided into two or more
tracts or a part thereof sold by any owner listed in the attached Exhibit "A"
during 1964, 1965, 1966 or 1967.
VIII.
This Ordinance shall be in full force and effect upon its final adoption
by the Euless City Council and the dismissal of Cause No. 37492 -C styled
W. Floyd Deacon, et al vs. City of Euless in the 48th District Court of
Tarrant County, Texas.
PRESENTED and given First Reading on the 13th day of February ,
1968, at a Regular Meeting of the City Council of the City of Euless, Texas,
and given Second Reading, passed and approved on the J4th day of January ,
1969, by a vote of 4 ayes and ___Q _nays at a Regular Meeting of the City
Council of the City of Euless, Texas.

Beginning at the intersection of the centerline of County Road
No. 3036 and the East line of County Road No. 3129, said point being
in the North line of Euless Ordinance No. 57;
Thence Easterly, with the said centerline of County Road
No. 3036 approximately 13,300 feet; Southerly approximately 900 feet
and Easterly approximately 1,900 feet to the East line of Tarrant
County, Texas;
Thence Southerly, with the East line of Tarrant County approximately
5,200 feet to the North line of State Highway No. 183 as it existed
prior to the construction of the tunnel under the North -South Runway
of Carter Field;
Thence Westerly, with the North line of said State Highway No. 183
prior to the construction of the said tunnel, parallel to the South
'line of the J. W. Thomas Survey and the A. Barnard Survey a distance
of approximately 9,600 feet to a point in the East line of
County Road No. 3011, a point in the area annexed to the City of Euless
through the provisions of Euless Ordinance No. 49;
Thence, with the following courses and distances and with
the boundary line as described in said Ordinance No. 49, Northerly
approximately 2,000 feet; Easterly 2,053 feet; Northerly 475 feet;
Easterly 316.7 feet; Northerly 2,869.4 feet; Westerly approximately
801 feet; Northerly 1,411.1 feet; and Westerly 1,569.4 feet to the
Northwest corner of said area annexed by Ordinance No. 49, a point
in the Easterly line of the area annexed to the City of Euless as
described in Ordnance No. 48;
Thence Northerly, approximately 600 feet to the Northeast corner
of the area described by said Ordinance No. 48;
Thence, continuing with the boundary line as described in said
Ordinance No. 48, Westerly approximately 2,689 feet; Southerly
1,569 feet; Easterly approximately 2,665 feet and Southerly approxi-
mately 400 feet;

intersection of the Colleyville City Limit and the Bedford City Limit

County Road No. 3081, said line being the City Limit boundary of

the South line of County Road No. 3036, a point in the said Colleyville
