HomeMy WebLinkAbout323 02-27-1968ORDINANCE NO. 323,E AN ORDINANCE AMENDING ORDINANCE NO. 33 IDENTIFIED AS THE TEMPORARY COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS, PROVIDING FOR CHANGE OF DESIGNATION IN CERTAIN AREA AND AMENDING ZONING MAP TO CONFORM WITH SUCH AMENDMENT; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: THAT the zoning classification of the following described property now zoned "A" Residential be changed to "C" Commercial. Being a tract of land out of the T. W. Cash Survey, Abstract #280, situated In the City of Euless, Tarrant County, Texas and described by metes and bounds as follows: COMMENCING at a point In the South line of Huffman Drive, said point being 25.0 feet South and 629.7 feet West from the Northeast corner of said Cash Survey; THENCE South 0 degrees 36 minutes East 400.0 feet to the point of beginning of the tract herein described; THENCE South 0 degrees 36 minutes East 864.0 feet to an iron pin for corner; THENCE 'test 650.5 feet to a point for corner; THENCE North 10 degrees 44 minutes west 883.27 feet to a point for corner; THENCE East 811.3 feet to the place of beginning and containing 14.497 acres of land, more or less. 2. That the zoning change set forth in Paragraph I hereof shall be subject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance e7fecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed wi t`r i n 36 months following final 17assage of the ordinance effecting the requested changes. 3. In the event of failure to comply with any one of such conditions subsequent, the zoning of the property in question shall automatically re- vert to is former use or zoning classification; provided, however, upon ti]e f ling of c;n a,­)! ication at 'east ?0 dciys ; rior to ti-le date in question and upon gooc' cause shown the City Council may, after considering the recominendat i on of 'Ciie T "anni ng and Zon rig Commission, grant reasonable extensions of t'rie for compliance with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amendments to the Et.;iess City Charter of 196, hereby Wade, shati be ueemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as provided by Ord'Mance 33 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. Conditions Subsequent will expire, as follows: A. February 27, 1973 B. August 27, 1973 C.
