HOST SURVEY, ABSTRACT 657 AND H. MCCOY SURVEY, ABSTRACT 1073, FROM "A" RESI- DENTIAL TO "A -3" MULTI - FAMILY; SUBJECT TO CERTAIN CONDITIONS SUBSEQUENT INCLUDING A REVERTER; AMENDING THE ZONING MAP TO CONFORM; PROVIDING A PENALTY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: That the zoning classification of the following described property now zoned "A" Residential be changed to "A-3" Multi- Family Dwelling. FIELD NOTES of a tract of land out of the H. Hust Survey Abstract 657 and the H. McCoy Survey Abstract 1073, Euless, Tarrant County, Texas, and being described by metes and bounds as follows: COMMENCING at the Northeast corner of the H. McCoy Survey, Abstract 1073; THENCE N 890 25' 15" W, along the north line of said McCoy Survey, also being the north line of a 31 acre school tract, 2202.41 feet; THENCE South 49.88 feet to the place of beginning; THENCE S 160 13' 36" W a distance of 748.10 feet to a point; THENCE West a distance of 465.70 feet to a point; THENCE N 00 22' 20" W a distance of 725.15 feet to a point; said point being in the south right -of-way line of Pipe Line Road; THENCE S 890 24' E,0" E along the south right - of-way of Pipe Line Road a distance of 676.35 feet to a point; said point being the place of beginning, and containing 9.0 acres of land more or less. 2. That the zoning change set forth in Paragraph 1 hereof shall be subject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. Construction In substantial compliance with the final site development plan as approved shall have been substantially completed within _IL months following final passage of the ordinance effecting the requested changes. 3. In the event of failure to comply with any one of such conditions subsequent, the zoning of the property in question shall automatically revert to Its former use or zoning classification; provided, however, upon the filing of an application at least 30 days prior to the date in question, and upon good cause shown, the City Council may, after considering the recommendation of the Planning and Zoning Commission, grant reasonable extensions of time for compliance with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amend- ments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as provided by Ordinance 33 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GiVEN FIRST READING on the twenty -sixth day of March, 1968, at a regular meeting of the City Council of the City of Euless, Texas; and given Second Reading, passed and approved on the ninth day of April, 1968, by a vote of 4 ayes and 0 nays at a regular meeting of the City Council of the City of Euless, Texas.
