P. HALFORD SURVEY, ABSTRACT 711, FROM "A" RESIDENTIAL TO "A -3" MULTI- FAMILY RESIDENCE, AND THE REMAINDER OF THE TRACT FROM "A" RESIDENTIAL TO "C" COMMERCIAL; SUBJECT TO CERTAIN CONDITIONS SUBSEQUENT INCLUDING A REVERTER; AMENDING THE ZONING MAP TO CONFORM; PROVIDING A PENALTY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: That the zoning classification of a 26.103 acre tract out of the J. P. Halford Survey, Abstract No. 711, Tarrant County, Texas, herein described, be changed as follows: The East 200 feet, from "A" Residential to "A -3" Multi- Family Residence, and The remainder of the tract, from "A" Residential to "C" Commercial; Said tract being described by metes and bounds, as follows: BEGINNING at a point In the East R.O.W. line of F.M. Road No. 157, said point being to the North line of a tract deeded to Paul Revere Company as recorded in Volume 3157, Page 193, Deed Records, Tarrant County, Texas; THENCE North 0 degrees 53 minutes West along said East R.O.W. line of F.M. 157, a distance of 556.0 feet to a steel rod for corner; THENCE East 490.0 feet to a steel rod for corner; THENCE North 0 degrees 52 minutes West with fence line 776.8 feet to a steel rod in the South R.O.W. line of Harwood Road; THENCE North 88 degrees 12 minutes East along said South R.O.W. line of Harwood Road with fence line 648.1 feet to a steel rod for corner; THENCE South 1 degree 09 minutes East with fence line, 877.7 feet to a steel rod; THENCE South 1 degree 23 minutes East 439.0 feet to a point; THENCE North 89 degrees 48 minutes West, 1148.0 feet to the place of beginning, and containing 26.103 acres of land, more or less. 2. That the zoning change set forth in Paragraph 1 hereof shall be subject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within 18 months following final passage of the ordinance effecting the requested changes. B. Construction in substantial compliance with the final site development plan as approved shall be commenced within 24 months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within 36 . months following final passage of the ordinance effecting the requested changes. 3. In the event of failure to comply with any one of such conditions subsequent, the zoning of the property in question shall automatically revert to its former use or zoning classification; provided, however, upon the filing of an application at least 30 days prior to the date in question, and upon good cause shown, the City Council may, after consider- ing the recommendation of the Planning and Zoning Commission, grant reasonable extensions of time for compliance with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as provided by Ordinance 33 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. S. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING on the 9th day of April, 1968, at a regular meeting of the City Council of the City of Euless, Texas; and given Second Reading, passed and approved on the 23rd day of April, 1968, by a vote of _3_ ayes and 0 nays at a regular meeting of the City Council of the City of Euless, Texas.
