HomeMy WebLinkAbout333 04-23-1968ORDINANCE NO. 353 AN ORDINANCE AMENDING ORDI WA'NCE NO. 33 IDENTIFIED AS THE TEMPORARY COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF EULESS, TEXA, PROVIDING FOR CHANGE OF BLOCK 1, OAK FOREST ADDITION, FROM "A" SINGLE FAMILY RESIDENCE TO "A -3" MULTI- FAMILY RESIDENCE, 0.5 ACRES OF BLOCK 2 (SOUTHEAST CORNER) FROM "A" SINGLE FAMILY RESIDENCE TO "C" COMMERCIAL AND THE REMAINDER OF BLOCK 2 AND ALL OF BLOCK 3 FROM "A"' SINGLE FAMILY RESIDENCE TO "'9 " LOCAL BUSINESS; SUBJECT TO CERTAIN CONDITIONS SUBSEPUENT INCLUDING A REVERTER; AMENDING THE ZOM1NG MAP TO CONFORM; PROVIDING A PENALTY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: 1. IT IS HERESY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: That the zoning classification of Block 1, Oak Forest Addition, now zoned "A" Single Farm l y Residence be changed to "A -3"' Multi - Family Res i - dence . And, that the zoning classification of 0.5 acres of Block 2 (South- east corner), Oak Forest Addition, now zoned "A" Single Family Residence be changed to "C" Commercial. And, that the zoning classification of the remainder of Block 2 and all of Block 3, Oak Forest Addition, now zoned "A" Single Family Residence be changed to "B" Local Business. 2. That the zoning change set forth in Paragraph 1 hereof shall be ubject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within _„,,_months following final passage of the ordinance effecting the requested charges. B. Construction in substantial compiiance with the final site development plan as approved shall be commenced within . 44 months following final passage of the ordinance effecting the requested changes. C. Construction In substantial compliance with the final site development plan as approved shall have been substantially completed within ff P months following final passage of the ordinance a ect ng the requested changes. 3. In the event of failure to amply with any one of such conditions subsequent, the zoning of the property In question shall automaticaliy revert to its former use or zoning classification; provided, however, upon the filing of an application at least 30 days prior to the date in question and upon good cause shown the City Council may, after considering the recomR+endation of the Planning and Zoning Camisslon, grant reasonable extensions of time for co"llonce with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as provided by Ordinance 33 and subsequent smiendments of the Euless City Charter and the Statutes of the State of Texas. 5• This ordinance shall be In full force and effect from and after Its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING on the _ 9th day of April , 1968, at a _ regular meeting of the City Council of the City of Euless, Taxes; and given Second Reading, passed and approved on the „ 23rd day of April , 1968, by a vote of 4 ayes and 0 nays at a regular meeting of the City Council of the City of Euless, Texas. APPROVED: Mayor ATTEST: City Secretary A ED TO FORM: C /ty At MEMO On October 13, 1970, the Euless City Council approved an eighteen (18) month extension of time for development of the 0.5 acres out of Block 2, Oak Forest Addition, which is zoned COMMERCIAL (Southeast corner of Block 2). The ex- tension of time is applied to conditions subsequent incorporated in Ordinance No. 333, and the extension was granted from October 6, 1970, as recommended by the Planning and Zoning Commission. This extension applies only to the 0.5 acres; the remainder of the property reverts to its original zoning classification, which is Single Family. This extension applies only to that portion of the property rezoned by this ordinance for APARTMENTS AND NEIGHBORHOOD BUSINESS. MEMO December 15, 1971 On December 14, 1971, the Euless City Council approved a one year extension of time applied to conditions subsequent incorporated in Ord. 333, from December 15, 1971, as recommended by the Planning and Zoning Commission.
