THOMAS SURVEY, ABSTRACT NO. 1522 EAST OF TRIGG- EULESS ROAD ADJACENT TO STATE HIGHWAY 183 FROM "A" RESIDENTIAL TO "C" COMMERCIAL; SUBJECT TO CERTAIN CONDITIONS SUBSEQUENT INCLUDING A REVERTER; AMENDING THE ZONING MAP TO CONFORM; PROVIDING A PENALTY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: 1. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 33, be amended to read as follows: That the zoning classification of a 45.03 acre tract of land out of the John W. Thomas Survey, Abstract No. 1522, Tarrant County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING at a point in the east right -of -way line of Trigg - Euless Road, said Point of Beginning being North 00 degrees 07 minutes West a distance of 79.22 feet from the point of Intersection of the north line of State Highway 183 and the east right -of -way line of Trigg - Euless Road as established by a right -of -way deed recorded In Volume 3722, Page 556, Deed Records of Tarrant County, Texas; THENCE North 00 degrees 07 minutes West along the east right - of-way line of Trigg - Euless Road a distance of 919.41 feet to a point; THENCE South 89 degrees 36 minutes East a distance of 583.88 feet to a point; THENCE East a distance of 1,538.80 feet to a point; THENCE South 02 degrees 13 minutes West a distance of 133.70 feet to a point; THENCE South 04 degrees 07 minutes East a distance of 707.80 feet to a point; THENCE South 12 degrees 28 minutes East a distance of 77.59 feet to a point; THENCE West along a line 300.00 feet north of and parallel to the north right- of-way line of State Highway 183 a distance of 2,183.18 feet to the Point of Beginning and containing 45.03 acres of land, more or less; now zoned "A" Residential be changed to "C" Commerclal. T That the zoning change set forth in Paragraph 1 hereof shall be subject to the following conditions subsequent: A. A final site development plan shall be submitted to the City Council within , 8 months following final passage of the ordinance effecting the requested changes. B. Construction In substantial compliance with the final site development plan as approved shall be cc m nced within _2L months following final passage of the ordinance effecting the requested changes. C. Construction in substantial compliance with the final site development plan as approved shall have been substantially completed within JL months following final passage of the ordinance effecting the requested changes. 3. In the event of failure to comply with any one of such conditions subsequent, the zoning of the property In question shall automatically revert to its former use or zoning classification; provided, however, upon the filing of an application at least 30 days prior to the date In question and upon good cause shorn the City Council may, after considering the recommendation of the Planning and Zoning Commission. grant reasonable extensions of time for canpilanca with any one or all of said conditions subsequent. 4. Any person violating the provisions of this Ordinance, or the amend - ments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding $200.00, as provided by Ordinance 33 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING on the 23rd day of July 1968, at a regular -meeting of the City Council of the City of Euless, Texas; and given Second Reading, passed and approved on the 13th day of August, 1968, by a vote of 4 ayes and _„_ nays at a regular meeting of the City Council of the City of Euless, Texas.
