AN ORDINANCE PROHIBITING THE WATERING OF LAWNS, SHRUBS,
PLANTS AND OTHER FOLIAGE AND GREENERY, AND PROHIBITING
THE WASHING OF CARS, TRUCKS AND OTHER VEHICLES iN THE
CITY OF EULESS, TEXAS, EXCEPT DURING CERTAIN HOURS ON
CERTAIN DAYS AS SET OUT IN THIS ORDINANCE, PROVIDING
A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR EACH VIOLATION
OF THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE;
ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; DECLARING
AN EMERGENCY AND IMMEDIATE EFFECT OF THIS ORDINANCE.
WHEREAS, severe drouth and unusually high temperatures have created
unusual demand for and unprecedented, inordinate usage of water by residents
of the City of Euless, Texas, thereby diminishing the reserve of water
necessary for adequate fire protection and sanitary use; and
WHEREAS, such shortage of water Is acute and requires immediate action
on the part of the City of Euless and its citizens to prevent further
diminution and depletion of water resources available to said City and its
citizens, and in order to maintain sufficient water pressure for fire
protection and sanitary use;
NOW, THEREFORE, BE IT ORDAIN €D BY THE CiTY COUNCIL OF THE CITY OF
EULESS, TEXAS:

The watering of lawns, shrubs, plants, and other foliage and greenery
and the washing of cars, trucks and other vehicles is hereby prohibited
within the corporate limits of the City of Euless, Texas, except during the
following days and hours:
(a) No person shat) use water for outside purposes or for
watering lawns, shrubs, plants and other foliage and
greenery and the washing of cars, trucks, and other
vehicles between the hours of 5 :00 P. M. In the evening
and 12 :00 midnight.
(b) Persons having even numbered house numbers may use water
for outside purposes such as the watering of lawns, shrubs,
plants and other foliage and greenery and the washing of
cars, trucks and other vehicles on even numbered days of the
month between the hours of 12 :00 midnight and 5 :00 P. M.
(c) Persons having odd numbered house numbers may use water for
outside purposes such as the watering of lawns, shrubs, plants
and other foliage and greenery and the washing of cars, trucks
and other vehicles on odd numbered days of the month between
the hours of 12 :00 midnight and 5 :00 P. M.
(d) The prohibition contained herein against the washing of cars,
trucks, and other vehicles shall not be applicable to car
washes, garages, or service stations.

The prohibitions contained herein shall apply to all water users of
the City of Euless water whether located within or without the corporate
limits of Euless. Violators shall be subject to revwAtion of water use
privileges.

In the event the prohibitions contained herein do not relieve existing
deficient water pressure or deficient water reserves, the Mayor is hereby
authorized and empowered without further Council action to declare by
proclamation a total and complete prohibition of all outside water usage for
such period deemed necessary to restore water pressure and/or water reserves.

Any person, firm or corporation using water for outside purposes except
as herein specially permitted and authorized, and otherwise violating the
provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in an amount of not less than Twenty-Five
Dollars ($25.00) and not more than Two Hundred Dollars ($200.00) for each
offense. Each occurrence shall constitute a separate and distinct offense
and shall be punishable as such.

The severe shortage of water existing In the City of Euless, Texas, and
the threat such shortage creates for the health, welfare and safety of the
citizens of the City of Euless and their property, creates an emergency and
an imperative public necessity that this Ordinance be effective from and after
Its reading and posting and publication on the Bulletin Board of the City of
Euless, Texas, City Hall.

Should any section, article or provision or part of this Ordinance
be declared to be unconstitutional and void by a court of competent
jurisdiction, such decision she]) in no way effect the validity of any
of the remaining parts of this Ordinance. The City Council hereby declares
at the time of the passage of this Ordinance that it would have passed those
remaining parts which may be constitutional separately and apart from those
which may be unconstitutional.
PRESENTED AND PASSED at a Special Meeting of the City Council of the
City of Euless. Texas, by a vote of ayes and O nays on this
