HomeMy WebLinkAbout370 03-24-1970ORDINANCE NO. 370 AN ORDINANCE REGULATING THE TRANSPORTATION, HANDLING AND STORAGE OF GASOLINE AND OTHER VOLATILES WITHIN THE CITY LIMITS OF EULESS, TEXAS; PROHIBITING THE TRANSPORTATION OF GASOLINE OR OTHER VOLATILES WITHIN THE CITY LIMITS OF EULESS IN TRUCKS HAVING A CAPACITY OF OVER 10,000 GALLONS; SPECIFYING THE EQUIPMENT TO BE USED BY TRUCKS HAUL- ING GASOLINE AND OTHER VOLATILES; ESTABLISHING SPECIFICATIONS FOR STORAGE TANKS AT SERVICE STATIONS TO BE UNDERGROUND AND MEETING CERTAIN SPECIFICATIONS; LIMITING SINGLE STORAGE TANKS AT SERVICE STATIONS TO 10,000 GALLONS AND TOTAL STORAGE CAPACITY OF ALL TANKS AT ONE LOCATION TO BE NOT GREATER THAN 20,000 GALLONS; CONTAINING MISCELLANEOUS PROVISIONS; FIXING PENALTY UP TO $200.00 PER DAY FOR VIOLATION OF THE ORDINANCE AND CONTAINING A SAVING CLAUSE. Section I. It shall be unlawful for any person, firm or corporation to transport, keep, store or handle gasoline or other volatiles in the City of Euless, except as specified in this code. Section II. Definitions: Aerosol, shall mean a material which is dispensed from its container as a mist, spray or foam by a propellent under pressure. Apartment House, shall mean a building, or that portion of a building containing more than two dwelling units. Approved, shall mean acceptance by the authority having juris- diction of design, equipment, installation or intended use as required by this code. Assembly Occupancy, shall mean the occupancy or use of a build- ing or structure, or any portion thereof, by a gathering of persons in groups of twenty -five (25) or more in one location. Atmospheric Tank, shall mean a storage tank which has been designed to operate at pressure from atmospheric through 0.5 Psig. Service Station, shall mean any location or building where gasoline or combustible liquids are stored or sold to the public. ITEM VI I Council Minutes March 24, 1970 Barrel, shall mean a volume of forty -two (42) U. S. gallons. Basement, shall mean a story of a building or structure having one half (2) or more below ground level and to which access for fire fighting purposes is unduly restricted. Boiling Point, shall mean the boiling point of a liquid at a pressure of 14.7 Psia (760 MM). Where an accurate boil- ing point is unavailable for the material in question, or for mixtures which do not have a constant boiling point, for purposes of this code the ten percent point of a distillation performed in accordance with the Standard Method of Test for Distillation of Petroleum Products, ASTM D -86 -62 may be used as the boiling point of the liquid. Boil Over, shall mean the expulsion of crude oil (or certain other liquid) from a burning tank. The light fractions of the crude oil burn off producing a heat wave in the residue, which on reaching a water strata may result in the expulsion of a portion of the contents of the tank in the form of froth. Bulk Plant, shall mean that portion of a property where flammable or combustible liquids are received by tank vessel, pipe lines, tank car, or tank vehicles, and are stored or blended in bulk for the purpose of distributing such liquids by tank vessel, pipe line, tank car, or container. Chemical Plant, shall mean a large integrated plant or that portion of such a plant other than a refinery or distillery where flammable or combustible liquids are produced by chemical reactions or used in chemical reaction. Closed Container, shall mean a container as herein defined, so sealed by means of a lid or other device that neither liquid nor vapor will escape from it at ordinary tempera- tures. Containers, shall mean any can, barrel or drum. Crude Petroleum, shall mean hydrocarbon mixtures that have a flash point below 1500 F. and which have not been processed in a refinery. Distillery, shall mean a plant, or that portion of a plant, where flammables or combustible liquids produced by fermentation are concentrated, and where the concentrated products may also be mixed, stored, or packaged. ITEM VII Council Minutes March 24, 1970 Flammable Aerosol, shall mean an aerosol which is required to be labeled "Flammable" under the U. S. Federal Hazardous Substances Labeling Act for the purpose of this code, such aerosols are considered Class lA liquids. Flash Point, shall mean the temperature of the liquid at which it gives off vapor sufficient to form an ignitible mixture with the air near the surface of the liquid or within the vessel used as determined by appropriate procedure and apparatus as specified below. The flash point of liquids having a viscosity less than 45 SUS at 1000 F. (37.80 C.) and a flash point below 175° F. (79.40 C.) shall be determined in accordance with the Standard Method of Test for Flash Point by the tagged closed tester. (ASTM D- 56 -69.) The flash point of liquids having a viscosity of 45 SUS or more at 100 F. (37.8 C.) or a flash point of 1750 F. (79.40 C.) or higher shall be determined in accordance with the standard Method of Test for Flash Point by the Pensky Morters closed tes_er, ASTM D- 93 -69. Liquid, shall mean, for the purpose of this code, any material which has a fluidity greater than that of 300 penetration asphalt when tested in accordance with ASTM Test for Penetration for Bituminous Materials D -5 -65. When not otherwise identified, the term liquid shall include both flammable and combustible liquids. Combustible Liquid, shall mean any liquid having a flash point at or above 140° F. (600 C.) and shall be known as Class III liquids. Flammable Liquids, shall mean any liquid having a flash point below 140° F. (600 C.) and having a vapor pressure not exceed- ing 40 pounds per square inch (absolute) at 1000 F. Flammable liquids shall be divided into two classes of liquids as follows: Class I liquids shall include those having flash points below 100° F. and may be subdivided as follows: Class IA shall include those having flash points below 730 F. and having a boiling point '-)elow 1000 F. Class 1B shall include those having flash points below 730 F. and having a boiling point at or above 1000 F. Class 1C shall include those having flash points at or above 730 F. and below 1000 -3- ITEM VII Council Minutes March 24, 1970 Class II liquids shall include those having flash points at or above 1000 F. and below 140o F. Unstable Liquid, shall mean a liquid which in the pure state or as commercially produced or transported will vigorously, polymerize, decompose, condense, or will become self - reactive under conditions of shock, pressure, or temperature. Low Pressure Tank, shall mean a storage tank which has been designed to operate at pressures above 0.5 Psig. but not more than 15 Psig. Portable Tank, shall mean a closed container having a liquid capacity over 60 U. S. gallons and not intended for fixed installation. Pressure Vessel, shall mean a storage tank or vessel which has been designed to operate at pressures above 15 Psig. Safety Can, shall mean an approved container, of not more than five gallons capacity, having a spring- closing lid and spout cover and so designed that it will safely relieve internal pressure when subjected to fire exposure. Vapor Pressure, shall mean the pressure, measured in pounds per square inch, exerted by a volatile liquid as determined by the "Standard Method of Test for Vapor Pressure of Petroleum Products (Reid Method)` (ASTM D- 323 -5$) Ventilation as specified in this code is for the prevention of fire and explosion. It is considered adequate if it is sufficient to prevent accumulation of significant quantities of vapor -air mixtures in concentration over one - fourth of the lower flammable limit. Section III. Service Stations All service stations erected or constructed in the City of Euless shall not have a storage capacity exceeding 20,000 gallons of which any one single storage tank shall not exceed 10,000 gallons. A. All storage tanks used for dispensing of gasoline shall be underground tanks. B. Underground tanks shall be installed on firm foundations and surrounded with at least six inches of noncorrosive, inert materials, such as clean sand or washed sand. Tanks shall have a minimum cover of one foot of earth with a reinforced concrete slab of not less than four inches thick and extending at least six inches beyond tank limits. Tanks installed underground and subject to traffic shall be protected against damage from vehicles by having at least three feet of compacted earth cover or eighteen Inches of well tamped earth, plus six inches of reinforced concrete or eight inches of asphalt concrete. Concrete or asphalt shall extend one foot horizontally beyond the outline of tank. C. Venting Underground Tanks. Vent pipe on underground storage tanks shall be located on the outside of the building and shall be not less than twelve feet above ground level. They shall be so located as to prevent vapor from entering building and shall be so graded that any liquid which collects in the vent lines will drain back into storage tanks. Vent pipes shall enter the top of storage tanks and be well protected from physical damage. Vent pipes shall be not less than 14 inches nominal inside diameter. Vent pipes shall be sized according to maximum flow of intake and liquid removed from tank per minute. Flow up to two hundred gallons per minute shall require I inch vent not to exceed two hundred feet. Flow of two hundred to five hundred gallons per minute shall require 1'—z inch vent not to exceed one hundred feet in length. Flow of seven hundred gallons per minute shall require a two inch vent not to exceed two hundred feet in length. Vents shall terminate in a double gooseneck spark protection, two foot minimum above roof. D. Tank Piping and Openings. Connections for all tanks shall be vapor and liquid tight. Fill and discharge lines shall enter tank from top. Filling and emptying connections which are made or broken shall be made outside of buildings not less than five feet away from any opening and location shall be free from any source of ignition. Such connection shall be closed and liquid tight when not in use. The connection shall be properly identified. ITEM VII Council Minutes March 24, 1970 -5- E. Tank Materials. All underground tanks installed in the City of Euless shall follow the specifications below, Tanks of 560 gallons or less shall be made of not less than 12 gauge galvanized steel or t/4 inch blac k.open hearth tank steel. Tanks with 560 to 6,000 gallons capacity shall be not less than 3/16 inch galvanized steel. Tanks of 6,000 to 10,000 gallons must be made of not less than 1/4 inch steel. Fiberglas underground storage tanks shall be allowed in the City of Euless only as they are approved by Underwriter's Laboratory. Each tank must have the Underwriter's Laboratory's seal of approval plainly visible on the exterior of the tank. Red thread glass -fiber reinforced epoxy piping systems may be installed with the fiberglas tanks only if it Is installed according to Product Bulletin #7681 of June 1, 1968, as approved by Underwriter's Laboratory. F. Service Station pumps and distribution. All pumps used in the City of Euless for drawing and dispensing of Class I, II or III liquids must be approved by Underwriter's Laboratory and bear their seal of approval plainly visible on each pump. The use of automatic or self- serving pumps or devices, by means of which the public may draw Class I, II and III liquids is deemed to be hazardous practice and in violation of the intent of this code. No coin operated pumps will be allowed in the City of Euless. G. Plumbing. Each service station having a work bay or wash bay must have a 4' x 6' double compartment sand trap between the sewer connection and the drainage from these bays. Each service station shall have two restrooms - one for each sex available to the public. H, Attendance or Supervision of Dispensing. Each service station open to the public shall have an attendant or supervisor on duty whenever the station is open for business. Attendant In charge shall allow no one except himself, or people employed by him, to dispense Class I, II and III liquids. I. Fire Control. Each service station shall be provided with at least one fire extinguisher having a minimum classification of 6B, C located so that an extinguisher will be within seventy -five feet of each pump, dispenser, underground fill pipe opening, and lubrication or service room. All Spilled liquids, trash, weeds or other unnecessary combustible materials shall be kept cleaned up at all times. -6- ITEM VII Council Minutes March 24, 1970 Section V. Transport Vehicles Tank trucks used for the distribution of Class I liquids to service stations shall not exceed 10,000 gallons. Every cargo tank having a total capacity of more than 3,000 gallons shall be divided into compartments, no one of which shall exceed 2,500 gallon capacity. A design tolerance of ten per cent shall be allowed in each compartment. Every cargo tank over ninety inches in length, except those used for asphalt service, shall be provided with baffles not to exceed sixty inches linear distance; between baffles or bulkheads. The cross section area of each baffle shall be not less than eighty per cent of the cross section area of the tank and the baffle shall be constructed out of material equal to the material of the bulkheads. Each cargo tank must be tested for leaks, and if leakage develops, tank must be taken out of service until repaired. A. Outlet Valves and Faucet Connections. Outlet shall be substantially made and attached to tank. Draw -off valves and faucets shall have discharge ends threaded, or they shall be so designed to permit tight connections to hose for fill pipe. Every cargo vehicle used for the transportation of any flammable liquid, regardless of the quantity being tansported, or whether loaded or empty, shall be conspicuously and legibly marked on each side and the rear thereof, In letters at least three inches high on a background of sharply contrasting colors the word "Flammable" or the name of the liquid being transported as long as the name is identified with the word "Flammable'. Tank vehicles shall not be operated unless they are in proper repair, devoid of accumulation of grease, oil or other flammables, and free of leaks. Dome covers shall be closed and latched while the vehicle is in transit. The operator of any tank vehicle shall not remain in the vehicle, but shall not leave the vehicle while it is being filled or discharged. Any article not covered in this section pertaining to tank vehicles shall be governed by NPFA No. 385 -1966 edition. Section VI. Storage and Warehousing In rooms or areas accessible to the public, storage shall be limited to quantities needed for display and normal merchandising purposes but shall not exceed two gallons per square foot of gross floor area. That floor area counted shall be the actual area being used for storage of flammable liquid. Containers in display shall not be stacked more than three feet or two containers high. ITEM VII Council Minutes March 24, 1970 Indoor container storage shall comply with the following chart: A. When two or more classes of materials are stored in a single pile, the maximum gallons permitted in that pile shall be the smallest of the allowable storage area of the two. B. Aisles shall be provided so that no container is more than twelve feet from an aisle. Main aisles shall be at least eigh't feet wide and side aisles four feet wide. C. Each Pile of containers must have a separation of not less than four feet. D. A sprinkler system or other approved fire equipment must be Installed in warehouse. No pile shall be closer than three feet to the nearest beam, cord, girder or other obstruction, and shall be three feet below sprinkler deflectors or discharge orifices of water spray or other overhead fire protec- tion systems. The storage area shall be graded in a manner to divert possible spills away from building or other exposures or shall be surrounded by a curb at least six inches in height. When curbs are used, provisions shall be made for draining of accumulations of ground or rain water or spills of flammable or combustible liquids. Drains shall terminate at a safe location and shall be accessible to operations under fire. No flammables shall be stored closer than ten feet to a building located on the same property and under the same ownership. Storage area shall be protected against tampering or trespassing prod shall be kept free of weeds and other debris. Fire protection shall be provided at suitable locations. Section VII. Any person, firm or corporation who violates any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof in the Corporation Court of the City of Euless, shall be fined in any sum not less than Twenty -five Dollars ($25.00) and not more than two hundred dollars ($200.00); each day shall constitute a separate offense. Section VIII. If any portion of this ordinance or any section or subdivision thereof be declared unconstitutional or in violation of the general laws of this State, such declaration shall not affect the remainder of this ordinance but same shall remain in full force and effect. Section IX. All ordinances and parts of ordinances inconsistent or in conflict herewith are hereby repealed. ITEM VII Council Minutes March 24, 1970 Section X.
