AN ORDINANCE AMENDING ORDINANCE NO. 258
PRESCRIBING RATES TO BE CHARGED FOR SERVICES
FURNISHED BY THE CITY'S WATERWORKS AND
SANITARY SEWER SYSTEM; ESTABLISHING RULES
AND REGULATIONS FOR THE OPERATION OF SAID
WATERWORKS AND SANITARY SEWER SYSTEM; PROVIDING
A SAVING CLAUSE AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS:
SECTION 1: Section 1 of Euless City Ordinance No. 258 shall
be, and is amended, as follows:
"SECTION 1: That a schedule of monthly rates and
charges for water and sewer services furnished by the City's Water-
works and Sanitary Sewer System shall be, and such is hereby adopted
and established, as follows:

SEWER SERVICE - COMMERCIAL AND INDUSTRIAL

The COMMERCIAL AND INDUSTRIAL rate is intended to apply to only those
establishments which will contribute domestic sewage only.
The City reserves the right to prescribe the conditions under which
services will be rendered to commercial and industrial customers of
a type producing abnormal sewage such as might require screening or
pretreatment."
SECTION 2: Paragraph 2 of Section 2, Ordinance No. 258, is
amended as follows: ''Each month's charges shall be due and payable
on or before the 10th day after the date of bill; and in the event
such charges are not paid within twenty days from the date of bill,
a penalty shall be added in the amount of ten per cent of the amount
past due.''
SECTION 3: Should any section, provision, word, phrase or
clause of this Ordinance or the application thereof to any person,
or circumstances be held invalid, unconstitutional or ineffective,
the remainder of the Ordinance and the application of such provi-
sions to other persons or circumstances shall not be effected thereby.
This Ordinance shall be effective from and after its passage
and adoption as required by Statute and Euless City Charter.
That the fact that it is to the best interests of the City to
provide rates and charges for services rendered by its waterworks
and sanitary sewer system, so that same may be in force and effect
immediately for the preservation of the public peace, health and
safety, constitutes and creates an emergency and an urgent public
necessity, requiring that any rule providing for ordinances to be
read and voted upon at more than one meeting of the City Council be
suspended, and requiring that this ordinance be passed and take
effect as an emergency measure, and such rules and provisions are
accordingly suspended, and this ordinance is passed as an emergency
measure, and shall take and have effect and be in full force from
and after its passage.
PASSED AND APPROVED by the City Council of the City of Euless,
Texas, on the 23rd day of June , 1970.
