HomeMy WebLinkAbout390 12-22-1970ORDINANCE NO. 390 AN ORDINANCE AMENDING SECTIONS 5 -103, 7 -201, 7 -202, 7 -300, 7 -302, 7 -303, 7 -304 AND SECTION 7 -1102 (2) OF THE CITY OF EULESS COMPREHENSIVE ZONING ORDINANCE NO. 347; ADDING NEW SECTIONS 5- 103 -R -3, 5- 103 -R -4 AND 5- 103 -R -5, 7 -307 THROUGH 7- 310 -R -3, 7- 311 -R -4 AND 7- 312- R- 5;PROVIDING FOR THE CREATION OF "R -311, LOW DENSITY MULTI- FAMILY DWELLING DISTRICT, PERMITTING SINGLE FAMILY, TWO FAMILY, TOWNHOUSE OR ROW HOUSE, OR MULTI - FAMILY DWELLINGS AT A DENSITY NOT TO EXCEED TWELVE UNITS PER ACRE; PROVIDING FOR THE CREATION OF "R -4 ", MEDIUM DENSITY MULTI - FAMILY DWELLING DISTRICT, PERMITTING SINGLE FAMILY, TWO FAMILY, TOWNHOUSE OR ROW HOUSE, OR MULTI - FAMILY DWELLINGS AT A DENSITY NOT TO EXCEED SIXTEEN UNITS PER ACRE; PROVIDING FOR THE CREATION OF ''R -5 '', HIGH DENSITY MULTI - FAMILY DWELLING DISTRICT, PERMITTING SINGLE FAMILY, TWO FAMILY TOWNHOUSE OR ROW HOUSE, OR MULTI - FAMILY DWELLINGS AT A DENSITY NOT TO EXCEED TWENTY -FOUR PER ACRE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless Planning and Zoning Commission and the Euless City Council, with a quorum of each body present and in attendance, held a public hearing on September 22, 1970, after advertising said public hearing in the official newspaper of said City, to consider suggested changes to City of Euless Comprehensive Zoning Ordinance No. 347 providing for varying density limitations in multi - family dwelling districts, and WHEREAS, at such public hearing interested citizens and parties desiring to be heard on proposed changes and revisions of the City of Euless Comprehensive Zoning Ordinance were afforded an opportunity to be heard, and WHEREAS, the Euless Planning and Zoning Commission and the Euless City Council, after due consideration and deliberation, determined that the Euless Comprehensive Zoning Ordinance should be amended to provide for multi- family zoning districts of varying and limited density of units per acre, and WHEREAS, at the conclusion of such public hearing, the Euless City Council directed the Euless City Attorney to present certain proposed and approved revisions to Euless Zoning Ordinance No. 347 in legal form, and WHEREAS, the Euless City Council has examined such proposed changes and revisions and is of the opinion that such revisions and changes contained in this Ordinance should be adopted, NOW, THEREFORE, BE IT ORDAINED BY THE EULESS CITY COUNCIL: ITEM VI Council Meeting December 22, 1970 SECTION I Section 5 -103 of the City of Euless Comprehensive Zoning Ordinance No. 347 is hereby deleted and the following sections adopted in lieu thereof: 115- 103 -R -3. Low Density Multi- Family Dwelling District. This zoning district is composed mainly of areas containing a mixture of single family, two family, townhouses, row houses and multi - family dwellings at a density not to exceed twelve (12) units per acre. The districts shown on the Zoning Map as R -3 are low density dwelling districts and are located in certain areas outside the center of the city near commercial and industrial centers where they serve as buffers between heavy traffic generators and single family.dwelling areas. The area regulations are designed to prevent overcrowding of land by providing minimum standards for building spacing, yards, off - street parking and building coverage. "5- 103 -R -4. Medium Density Multi- Family Dwelling District. This zoning district is composed mainly of areas containing a mixture of single family, two family, townhouses, row houses and multi - family dwellings at a density not to exceed sixteen (16) units per acre. The districts shown on the Zoning Map as R -4 are medium density dwelling districts and are located in certain areas near the center of the city and near commercial and industrial centers where they serve as buffers between heavy traffic generators and outlying areas. The area regulations are designed to prevent overcrowding of land by providing minimum standards for building spacing, yards, offstreet parking and building coverage. "5- 103 -R -5. High Density Multi- Family Dwelling District. This zoning district is composed mainly of areas containing a mixture of single family, two family, townhouses, row houses and multi - family dwellings at a density not to exceed twenty -four (24) units per acre. The districts shown on the Zoning Map as R -5 are high density dwelling districts and are located in certain areas near the center of the city and near commercial and industrial centers where they serve as buffers between heavy traffic generators and outlying areas. The area regulations are designed to prevent overcrowding of land by providing minimum standards for building spacing, yards, offstreet parking and building coverage." SECTION II Sections 7 -201, 7 -202 of the City of Euless Zoning Ordinance No. 347 are hereby amended to provide as follows: 7 -200 "R -2" TWO- FAMILY DWELLING DISTRICT The following regulations shall apply in all "R -2" Dwelling Districts; 7 -201 Uses Permitted (1) Any use permitted in an "R -1" Dwelling District (2) Single family attached dwellings where each dwelling is separated by a minimum four inch (4 ") masonry wall. (3) Two - family dwellings (4) Accessory buildings (5) Home occupations (See Section 7 -1300 (21)) (6) A one - family garage apartment is permitted when located not less than eighty (80) feet from the front line, nor less then five (5) feet from either side line; provided, however, that all accessory buildings including the one - family garage apartment shall not occupy in excess of fifty (50) percent of the minimum required rear yard in the case of a one -story building or forty (40) percent in the case of a two -story building. A one - family garage apartment shall not be permitted in conjunction with another dwelling on the same lot designed for more than two families. 7 -202 Area Requirements (1) Front Yard There shall be a front yard for every structure in the "R -2" Dwelling District having a depth of not less than twenty -five (25) feet from the property line to the face of the building. No covered porch, covered terrace, or at- tached accessory building shall project into any required front yard space. (2) Rear Yard There shall be a rear yard for every structure in the "R -2" Dwelling District which shall have a depth of not less than twenty -five (25) feet measured from the back of the structure to the rear property line; provided, however, that where such rear yard abuts an alley, the required rear yard may be measured from the center line of such alley. (3) Side Yards for Duplexes There shall be two (2) side yards for each duplex in the "R -2" Dwelling District, one on each side of such'structure. No side yard shall be less than five (5) feet. No covered porch, covered terrace or attached accessory building shall project into required side yard, except for ordinary projections of sills, belt courses, cornices, etc.; but in no case shall any such projection exceed twenty -four (24) inches. (4) Side Yards for Single Family Attached Units There shall be one side yard for each dwelling unit in the "R -2" District having a depth of not less than ten (10) feet from the property line to the wall of the building. (5) Lot Area for Duplexes The minimum area of any lot used for duplexes in the "R -2" Dwelling District shall be 7,500 square feet. (6) Lot Area For Single Family Attached Dwelling Units The minimum area of any lot used in the "R -2" Dwelling District for Single Family attached dwelling units shall be 3,750 square feet. (7) Lot Width for Duplexes The minimum lot width shall be sixty - five 65 feet at the required building line. (8) Lot Width for Single Family Attached Dwelling Units The minimum lot width shall be thirty -two (32) feet at the required building line. (9) Lot Coverage The combined area of the main building and acces- sory buildings shall not cover more than fifty (50) percent of the total area of any lot in the "R -2" Dwelling District. (10) Floor Area for Duplexes Every two - family dwelling thereafter erected, constructed or altered in "R -2" Dwelling District shall have a floor area, excluding basements, open and screened porches, and garages, of not less than 850 square feet for each family. (11) Floor Area for Single Family Attached Dwellings Every single - family attached dwelling unit erected, constructed, or altered in "R -2" Dwelling District shall have a floor area, excluding basements, open or screened porches and garages, of not less than 1100 square feet for each family. (12) Construction Requirements All dwellings and detached garages hereafter erected in the "R -2" Dwelling District shall be eighty (80) percent masonry veneer on exterior walls exclusive of windows and doors. 7 -203 Height Limit No building in the "R -2" Dwelling District shall exceed the height of thirty -five (35) feet or two and one -half (21-2 ) stories, however, one - family dwellings may be increased in height not more than ten (10) feet when two side yards of not less than fifteen (15) feet each are provided. 7 -204 Off- Street Parking There shall be provided in connection with every use permitted in the "R -2" Dwelling District, off - street parking space in accordance with the provisions of SECTION 8. 7 -205 Signs Permitted signs in the "R -2" Dwelling District shall be in accordance with the regulations in SECTION 9. SECTION III Sections 7 -300, 7 -302, 7 -303 and 7 -304 of the City of Euless Zoning Ordinance No. 347 are hereby amended as follows, and Sections 7-307, 7 -308, 7 -309, 7 -310, 7 -311 and 7 -312 are hereby added as follows: 7 -300 "R -3" MULTIPLE - FAMILY LOW DENSITY DWELLING DISTRICT: LIMIT OF TWELVE 12 UNITS PER ACRE The following regulations shall apply in all "R -3" Multiple - Family Dwelling Districts: 7 -301 Uses Permitted (1) Any use permitted in any of the foregoing districts. (2) Multiple - family dwellings. (3) Apartment houses. (4) Children's day nurseries when housed wholly in a private residence, the principal use of which is the operator's private dwelling. (5) Boarding or lodging housds. (6) Hospitals, doctor's and dentist's offices and clinics (except tubercular and veterinary hospitals and clinics for the treatment of alcoholic, neurotic, insane, feeble- minded or narcotics - addicted patients). (7) Hotels in which business may be conducted for the sole convenience of the occupants of the building; provided, however, that there shall be no entrance to any such place of business except from the inside of the building. (8) Private clubs, fraternities, sororities, group student houses, lodges; except, however, any of such uses of whose chief activities are customarily carried on as a business. (9) Kindergartens, day nurseries, private schools teaching similar subjects as are taught in elementary schools, provided the building, or buildings, are set back from all required yard lines two (2) feet for every foot of building height and provided all off - street parking facilities consistent with requirements of the use are provided on the site. In the instance of private schools and kindergartens, a minimum building area of thirty (30) square feet per student and a minimum site area of two hundred (200) square feet per student shall be provided. 7 -302 Area Requirements (1) Front Yard There shall be a front yard for every structure in the "R -3" Dwelling District having a depth of not less than twenty -five (25) feet from the property line to the face of the building. No covered porch, covered terrace, or attached accessory building shall project into any required front yard space. (2) Rear Yard There shall be a rear yard for every structure in the "R -3" Dwelling District which shall have a depth of not less than twenty -five (25) feet measured from the back of the structure to the rear property line; provided, however, that where such rear yard abuts an alley the required rear yard may be measured from the center line of such alley. (3) Interior Requirements (A) Thirty (30 ) foot minimum between windows or doors in both walls. (B) Fifteen (15) foot minimum between windows and blank wall. (C) Ten (10) foot minimum between blank walls. (4) Exterior Area Requirements (A ) All buildings shall have a twenty -five (25) foot setback from property line. (B) Covered parking shall be allowed to one (1) foot of lot line provided it is not along a public street. (C) Roof, balcony and porch overhangs to be four (4) foot maximum into front, side and rear yards. (D) Fireplace masses and window boxes to be allowed to penetrate front, side and rear yards three (3) feet. (E) No stairways or columns to be outside building line. (F) No required parking shall be allowed in front of building line of front yards, but will be allowed in side and rear yards. (5) Minimum Land Area Per Apartment Unit (A) Efficiency units shall have 1600 square feet of land area per unit and shall be limited to thirty (30) percent efficiency units per acre. (B) One- bedroom units shall have 1800 square feet of land area per unit and shall be limited to fifty (50) percent one - bedroom units per acre. (C) Two- bedroom units shall have 2000 square feet of land area per unit. (D) Three - bedroom units shall have 2200 square feet of land area per unit. (E) Over three - bedroom units shall have additional 1,000 square feet of land area per additional bedroom. (6) Lot Area The minimum area of any lot used for dwelling unit construction shall be 7,500 square feet. (7) Lot Width The minimum lot width of any lot used for dwelling unit construction shall be 65 feet. (8) Floor Area (A ) Efficiency units - four hundred (400) square feet per unit. (B) One- bedroom units - five hundred and sixty (560) square feet per unit. (C) Two - bedroom units - seven hundred and fifty (750) square feet per unit. (D) Three - bedroom units - nine hundred and eighty (980) square feet per unit. 7 -303 Height Limit Height of building's usable space shall be thirty -five (35) feet, with no limit of roof height. 7 -304 Off- Street Parking There shall be two (2) parking spaces for each dwelling unit in the "R -3" Dwelling District. 7-305 L=s gn_s Permitted signs in the "R -3" Dwelling District shall be in accordance with the regulations in SECTION 9. 7 -306 Screening Protective screening in the "R -3" Multiple - Family Dwelling District shall be provided in accordance with SECTION 10. 7 -307 Land Coverage Maximum land coverage of forty (40) percent shall include all build- ings except covered parking. 7 -308 Access and Egress to Units Access and egress to each individual unit shall be according to the building code. 7 -309 Single Family Attached Dwellings (1) Lot Area The minimum lot area per dwelling structure shall be 2200 square feet. (2) Lot Width The minimum lot width between center to center four inch (4" fire walls shall be 22 feet. (3) Lot Depth The minimum lot depth shall be 100 feet. (4) Front Yards The minimum depth of front yards on public streets shall be 25 feet. The minimum depth of the front yard on interior private drives shall be 20 feet. (5) Rear Yards (A) The minimum depth of interior rear yards shall be 20 feet. (B) The minimum depth of the exterior rear yards shall be 25 feet from the property line and public roads. (6) Side Yards (A) On lots having single family attached dwelling units, no side yard is required except that no contiguous attached structure shall exceed one hundred and eighty (180) feet in length, and the minimum separation between structures shall be twenty (20) feet. (B) Side yards next to property line or public streets shall be twenty -five (25) feet. (7) Parking There shall be two (2) parking spaces per dwelling unit in Single Family Attached Dwellings; these parking spaces may be on the lot proper or on common or community property located in the immediate vicinity of the lot or lots to be served. However, no parking shall be allowed in the required front yard. Parking spaces shall meet the requirements of SECTION 8. 7 -310 Construction Requirements For All Multiple - Family Zoning Districts (1) All buildings hereafter erected in the Multiple - Family Dwelling Districts shall be eighty (80) percent masonry veneer on exterior walls exclusive of windows and doors. (2) In all Multiple - Family Dwelling Districts, all buildings must be located within one hundred (100) feet of a fire easement. 7 -311 "R -4" MULTIPLE- FAMILY MEDIUM DENSITY DWELLING DISTRICT: LIMIT OF SIXTEEN (16) UNITS PER ACRE All requirements for "R -4" Multiple - Family Dwelling Districts are the same as "R -3" Multiple - Family Dwelling District with exception of density requirements per acre. 7 -312 "R -5" MULTIPLE - FAMILY HIGH DENSITY DWELLING DISTRICT: LIMIT OF TWENTY -FOUR 24 UNITS PER ACRE All requirements for "R -5" Multiple - Family Dwelling Districts are the same as "R -3" Multiple - Family Dwelling District with exception of density requirements per acre and the following: (1) Parking There shall be one (1) parking space for each 500 feet of floor area, with a minimum of 12 spaces per unit and a maximum of 22 spaces per unit. SECTION IV All other sections in the 7 -200 and 7 -300 series shall remain unchanged. SECTION V Section 7- 1102(2) of the City of Euless Zoning Ordinance No. 347 is amended by the deletion of the words "on sites of five (5) acres or more" and shall read as follows: "The City Council of the City of Euless, after by the City Planning and Zoning Commission and hearing and proper notices to all parties affe, the creation of a Planned Development District various types of developments and combinations as enumerated in preceding paragraph." SECTION VI recommendation after public :ted, may authorize to accommodate of developments All land presently zoned Multi - Family Dwelling District R -3 on the City of Euless Comprehensive Zoning Map on the effective date of this Ordinance shall be rezoned 7 -312 R -5, High Density Multi- Family Dwelling District. SECTION VII If any section, paragraph, subdivision, clause, phrase or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part of provisions thereof other than the part so decided to be invalid or unconstitutional. SECTION VIII Any person or corporation who shall violate any of the provisions of this Ordinance or fail to comply therewith or with any of the requirements thereof, or who shall build or alter any building or use in violation of any detailed statement or plan submitted and approved hereunder shall be guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00) and each day such violation shall be permitted to exist shall constitute a separate offense. The owner or owners of any building or premises, or part thereof, where anything in violation of this Ordinance shall be placed or shall exist, and any architect, builder, contractor, agent, person or corporation employed in connection therewith and who may have assisted in the commission of any such violation shall be guilty of a separate offense and upon conviction shall be fined as herein provided. The City of Euless, likewise, shall have the power to enforce the provisions of this Ordinance through civil court action as provided by State law. SECTION IX This Ordinance shall become effective and be in full force and effect from and after the date of its final passage.
