AN ORDINANCE AUTHORIZING THE MAKING OF
A CONTRACT BETWEEN THE CITY OF EULESS,
TEXAS; PRESCRIBING THE FORM OF SAID
CONTRACT; ORDAINING OTHER PROVISIONS
RELATING TO THE SUBJECT; AND DECLARING
AN EMERGENCY.

WHEREAS, it is desirable and necessary for the City of
Euless, Texas, to enter into a contract with Trinity River
Authority of Texas for the purpose of providing sewage disposal
services to said City; and

Section 1. This City shall enter into a contract with
Trinity River Authority of Texas in substantially the form
attached hereto and matte a part hereof for all purposes.
Section 2. That the said contract shall be signed on
behalf of this City by its Mayor and attested by the City
Secretary.
Section 3. This ordinance is hereby declared to be an
er.cr" .ncy recasure and is passed as such for the immediate

W I T N E S S E T H:
WHEREAS, the City is in need of services for the trans-
porL-ation, treatment and disposal_ of sanitary sewage, industrial
waste and other wastes; and
WHET:'�AS, Authority can provide such services;

agr`c�:cnts herein contained, Authority agrees to provide and tha
City agrees to pay for transportation, treatment and disposal of

"Enginocri.n, I:eport" means a report of Forrest and
Cotton, Inc., Consulti_n; Engineers, entitled "West Side Exte:rlz�,ion
Project ( Euless)" to Trinity River Authority Central System
dated December, 1970.
" Garbage" means solid wastes from the preparation,
cooking arlcl dispons:i_ng of focd, and from handling, sto;_agc and
sale of produce.
"Grease" means fats, waxes, free fatty acids, calc:i-,m
and magnesium soaps, mineral oils, and other non -fatty materials,
"Industrial. Waste" means the liquid wastes from-
industrial processes, as distinct from Sanitary Se,:,age.
"Infiltration" means the water which leaks into a
sewer through defective joints, breaks in pipes, or porol:s walls.
11p11" means the logarithm of the reciprocal of t e
weight. of hydrogen ions in grams per liter of solution.
"Points of Entry" means the point or points of entry
designated in the Engineering Report.

Section 2, Cons truC.tion_Of- Fac.J li_ties,by Authority.
(a) Authority will design, construct, own, maintain and operate
sewage collection facilities (hereinafter called 'project ") to be
designed, constructed and located in accordance with the Engineer-
ing Report as such Engineering Repot may be changed, amended or
supplcrented by mutual consent of the staffs of the parties to this
contract at any time prior to the award of construction contracts
by Authority and subject to any change orders which may be issued
by Authority's consulting -engincers after award of construction
contracts for the Project.
(b) Authority shall give the City not less than thirty
(30) days written notice of the date on which the City will be
authorized to release Sewage into the Project.
Section. 3. Financing Authority will pay for cost
Of co-.-s .-ruction of the Project, and will issue its revenue
bolds (:ercin called "Bonds"), ") , in one or more series or issues,
in an araount sufficient to finance a7.1. or a part of the cost of

In considers Lion o:i the payments to be made by the City ur;(Icr 1-h is
Contract) the City is entitled to discharge into tic. Project during
any Fiscal Year of Authority while this Contract is effective a total
quantity of 6,398,450,000 gallons of Sewage, at the Points of Entry.
The maxi-,-.um rate at which Se\ae.ge is discharged by ti-le, City at the
Points of Entry shall. not exceed the maximum rates as provided in
the Engineei:i_ng Report.
(b) It shall be the sole responsibility of the City,
including any liability incurred in connection therewith, to
convey such Sewage to the Points of Entry.
(c) Authority will construct a metering station and
install appropriate metering equipment at points designated in the
Engineering Report for the purpose of metering sewage discharged
into the Project by the City. Authority shall have complete
control of the operation and maintenance of such metering stations
and equipr:]ent. The City shall have access to such metering equip.-
ment at all reasonable times for inspection and examin --tion, but the
-reading, calibration, and adjustment thereof shall_ be done only by
er_,oyees or agents of Authority in the presence of a representative
o t--le 'Ci_ty if requested by the City. All readings of rnetcrs will

(e) if, for any reason, ally meters are out of
service or out of repair, or if, upon any test, the percentage
of inaccuracy of any meter is found to.be in excess of five (5 %)

(f) Tile City may, at its option and its mwrn expense,
install and operate a check meter to check each meter installed
by Authority, but the measurelncnt for the purpose of this
agreement shall be solely by Authority's meters, excenL in L:.e

con�rary. All such check mCLers shall be of standard ma':ce and
s::«ll be subject at all reasonable times to inspection and

of providing such additional points of discharge shall be paid by
City; Authority's engineers shall approve the location and con-
struction of any such additional points of discharge; City shall pay
to Authority all costs of operation and maintenance of such additional
points of discharge, as determined by Authority; and, provided that
the total discharge of Sewage into the Project from the Points of
Entry and any such additional points of discharge does not exceed the
gallonage allowed to be discharged under this Contract or the max-
imum rate of discharge as provided in the Engineering Report.

(g) City agrees that any costs incurred by Authority in
relocating or rebuilding any part of the facilities to be constructed
hereunder and under contracts of even date with the Cities of Arlington
and Grand Prairie due, directly or indirectly, to the Trinity River
becoming navigable or preparations or construction to that end, will
be borne by City in the proporition that City's capacity in said
facilities bears to the total capacity of said facilities. City
agrees that uponnotification in writing by Authority that any such
amount is due it will promptly ray such amount to Authority from
funds 'Lawfully available for the purpose.
