HomeMy WebLinkAbout445 04-24-1973ORDINANCE NO. 445 AN ORDINANCE EXEMPTING THREE THOUSAND DOLLARS ($3,000.00) OF THE ASSESSED VALUE OF RESIDENCE HOMESTEADS OF RESIDENTS OF THE CITY OF EULESS SIXTY -FIVE (65) YEARS OF AGE OR OLDER FROM ALL AD VALOREM TAXES LEVIED BY THE CITY OF EULESS, TEXAS; ESTABLISHING PROCEDURES FOR APPLICATION FOR SUCH EXEMPTION; AND PROVIDING A SEVERANCE CLAUSE WHEREAS, the citizens of the State of Texas, have, by appropriate election, amended Article VIII, Section 1 -b of the Constitution of the State of Texas so as to authorize cities within the State of Texas to exempt, by their own action, certain sums from the assessed value of residence homesteads of persons sixty -five (65) years of age or older from the pay- ment of ad valorem taxes, and WHEREAS, it is the desire of the Euless City Council to afford such residents of the City of Euless such an exemption in the amount of Three Thousand Dollars ($3,000.00). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: ARTICLE I From and after the effective date of this Ordinance and upon compliance with the requirements hereafter set forth, there shall be exempted the sum of Three Thousand Dollars ($3,000.00) of the assessed value of residence homesteads of residents of the City of Euless, Texas, who are sixty -five (65) years of age or older from all ad valorem taxes there- after levied by such City. ARTICLE II All residents of the City of Euless who, on January 1 of each tax year, shall be eligible for the exemption herein provided for shall make application therefor between January 1 and April 30 of each such tax year to the Tax Assessor - Collector of the City of Euless, Texas. Such application shall be supported by affidavit of the applicant and shall be in such form as the Tax Assessor - Collector of the City of Euless, Texas may prescribe. The initial application of any such applicant shall be accompanied by such proof of age as the Euless Tax Assessor - Collector may prescribe. The Tax Assessor - Collector may accept subsequent renewals thereof by affidavit only. ARTICLE III For the tax year 1973, the Euless Tax Assessor - Collector shall extend such exemption to the owners of all residence homesteads who shall have made satisfactory application for like exemption to such Tax Assessor - Collector with respect to taxes levied by the Hurst - Euless- Bedford Independent School District. ARTICLE IV The exemption herein created shall not apply to any ad valorem tax heretofore pledged for the payment of any debt of the City of Euless, Texas, if the cessation of such levy would impair the obligation of the contract by which such debt was created and the Tax Assessor - Collector of the City of Euless shall have the authority to continue any such levy and collect the tax against such homestead property at the same rate as the tax so pledged until any such debt be finally discharged. ARTICLE V Should any section, provision, word, phrase or clause of this Ordinance or the application thereof to any person or circumstance be held invalid, unconstitutional or ineffective, the remainder of the Ordinance in the application of such provisions to other persons or circumstances shall not be affected thereby. ARTICLE VI This Ordinance shall become effective and be in full force and effect from and after the date of its final passage. APPROVED AND ADOPTED on final reading on the 24th day of Apri 1 , 1973.
