AN ORDINANCE AMENDING ORDINANCE NO.252
PROVIDING FOR THE REGULATION OF SIGNS
AND BILLBOARDS ERECTED, CONSTRUCTED AND
MAINTAINED IN THE CITY LIMITS OF EULESS,
TARRANT COUNTY, TEXAS; DEFINING CERTAIN
TERMS; PROVIDING FOR PERMITS AND FEES;
ESTABLISHING BUILDING AND SIZE REQUIREMENTS
AND LIMITATIONS; PROVIDING FOR ALTERATION
AND REPLACEMENT OF SIGNS AND BILLBOARDS;
PROVIDING FOR APPEAL TO THE BOARD OF
ADJUSTMENT; PROVIDING A SEVERENCE CLAUSE,
A PENALTY CLAUSE AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
ARTICLE I
Subsection (c) of Article IV of Ordinance Number 252 of
the City of Euless, Texas is herewith amended to hereafter read as
follows:
(c) No license for any sign other than a flat sign,
projecting sign, temporary sign,pole sign or
roof sign advertising or identifying the business
venture or services performed at the site where
such business venture exists or where such services
are performed shall be granted within a distance of
three thousand feet (3000') either side of the
right of way, as same now or hereafter shall be
established, of the below listed streets or roadways
as same now exist or hereafter shall be extended
within the City Limits of the City of Euless:

STATE HIGHWAY 360
MINTERS - CHAPEL ROAD
ARTICLE II
PENALTY
Any person, firm or corporation, found guilty of violating
any portion of this ordinance shall be deemed guilty of a misdemeanor
and shall be fined not less than $25.00 nor more than $200.00 for
each offense, and every violation of each and every day's failure
or refusal to comply with the said provisions will constitute a
separate offence, and in case of willful or continued violations
by any person, firm or corporation the City shall have power to
revocke and repeal any license under which said person, firm or
corporation may be acting, and revoke all permits, privileges and
franchises granted to said person, firm or corporation aforesaid.
ARTICLE III
SEVERANCE CLAUSE
Should any section, article, provision or part of this
Ordinance be declared to be unconstitutional and void by a court
of competent jurisdiction, such decisions shall in no way effect the
validity of any of the remaining parts of this Ordinance unless the
part held unconstitutional or void is inseparable from and indispensable
to the operation of the remaining parts. The City Council hereby
declares that it would have passed those parts which may be un-
constitutional at the time of the passage of this Ordinance.
ARTICLE IV
The fact that the health, safety and welfare of the City of
Euless is endangered by the condition that exists in regard to the
regulations of billboards and that the present regulations applicable
thereto in said City are wholly inadequate for the protection of the
public and the preservation of the public health, safety and general
welfare, makes it imperative that this Ordinance be passed as an
emergency measure; this Ordinance shall be in full force and effect
immediately upon passage and publication.
PASSED and APPROVED by the City Council of the City of Euless,
Texas, on this 14th day of August , 1973.
