AN ORDINANCE AMENDING EULESS ZONING
ORDINANCE NO. 347 CHANGING OFF - STREET
PARKING SPACE REQUIREMENTS FOR MOTELS
AND HOTELS, ADJUSTING SIDE YARD
REQUIREMENTS IN "R -1" SINGLE FAMILY
DWELLING DISTRICTS, AMENDING THE USES
PERMITTED IN "C -1" NEIGHBORHOOD BUSI-
NESS DISTRICTS, AND CHANGING THE
SETBACK REQUIREMENTS AND USES
PERMITTED IN "C -2" COMMUNITY BUSINESS
DISTRICTS; AUTHORIZING PUBLICATION OF
THE DESCRIPTIVE CAPTION AND PENALTY
CLAUSE; PROVIDING A SAVINGS CLAUSE
AND AN EFFECTIVE DATE.
WHEREAS, the City of Euless Planning and Zoning
Commission and the Euless City Council, with a quorum of each
body present and in attendance, held public hearings after
due notice to consider suggested changes to the City of Euless
Comprehensive Zoning Ordinance No. 347, providing for changes
therein as to parking space requirements for off - street park-
ing for motels and hotels, as to changes in side yard
requirements in "R -1" Single Family Dwelling Districts, for
changes in the uses permitted in "C -1" Neighborhood Business
Districts, for changes in the setback requirements and uses
permitted for "C -2" Community Business Districts, and
WHEREAS, at such public hearings interested citizens
and parties desiring to be heard on such proposed changes and
revisions of the City of Euless Comprehensive Zoning Ordinance
were afforded an opportunity to be heard, and
WHEREAS, the Euless Planning and Zoning Commission and
the Euless City Council, after due consideration and delibera-
tion, have each determined that the Euless Comprehensive
Zoning Ordinance should be amended to provide for the changes
set forth in this Ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EULESS, TEXAS, AS FOLLOWS:
ARTICLE I
That portion of Section 8 -400 entitled "Residential
Uses" of the "City of Euless Comprehensive Zoning Ordinance
No. 347" is herewith amended to hereafter read as follows:

ARTICLE II
Paragraph (3) entitled "Side Yards" of Section 7 -102
of the "City of Euless Comprehensive Zoning Ordinance No. 347"
is herewith amended to hereafter read as follows:
(3) Side Yards There shall be two (2) side yards for
each structure in the "R -1" Dwelling District, one
(1) on each side of such structure. One (1) such
side yard shall not be less than five feet (5')
measured from the side property line to the side
of the structure and no covered porch, covered
terrace, or attached accessory building shall
project into any required side yard space. The
other such side yard shall not be less than twelve
feet (12' ) measured from the side property line to
the side of the structure and no covered porch,
covered terrace, or attached accessory building
shall project into any required side yard space.
All required side yards shall be open and unob-
structed except for fences and for ordinary
projections of sills, belt course and cornices;
but in no case shall any such projection exceed
twenty -four inches (24 ") .
ARTICLE III
Paragraph (1) of Section 7 -401 entitled "Uses
Permitted" in "C -1" Neighborhood Business Districts is herewith
amended to hereafter read as follows:
(1) Any uses permitted in the foregoing "R" Dwelling
Districts, except that no residential dwellings
or living quarters shall be constructed or allowed
in any "C -1" Neighborhood Business District.

ARTICLE IV
Paragraph (1) of Section 7 -501 entitled "Uses
Permitted" in "C -2" Community Business Districts is herewith
amended to hereafter read as follows:
(1) Any uses permitted in the foregoing "R" Dwelling
Districts or the foregoing "C -1" Neighborhood
Business Districts, except that no residential
dwellings or living quarters shall be constructed
or allowed in any "C -2" Community Business District.
ARTICLE V
Paragraph (1) of Section 7 -502 entitled "Area Require-
ments" of the "City of Euless Comprehensive Zoning Ordinance
No. 347" is herewith amended to hereafter read as follows:
(1) There shall be a front yard for every structure
erected or structurally altered in the "C -2"
Community Business District of not less than
twenty feet (20') in depth from the front property
line to the face of the building. No covered
porch, covered terrace or attached accessory
building shall project into any front yard space.
ARTICLE VI
Section 7 -1002 entitled "Specific Use Schedule" of the
"City of Euless Comprehensive Zoning Ordinance No. 347" is
herewith amended by the addition of Paragraph (57) which shall
read as follows:
(57) Residential dwellings or C -1, C -2
living quarters
ARTICLE VII
Any person or corporation who shall violate any of the
provisions of this Ordinance or fail to comply therewith or
with any of the requirements thereof, or who shall build or
alter any building or use in violation of any detailed state-
ment or plan submitted and approved hereunder shall be guilty
of a misdemeanor and shall be liable to a fine of not more than
Two Hundred Dollars ($200.00) and each day such violation shall
be permitted to exist shall constitute a separate offense. The
owner or owners of any building or premises, or part thereof,
where anything in violation of this Ordinance shall be placed
or shall exist, and any architect, builder, contractor, agent,
person or corporation employed in connection therewith and who

may have assisted in the commission of any such violation
shall be guilty of a separate offense and upon conviction
shall be fined as herein provided. The City of Euless, like-
wise, shall have the power to enforce the provisions of this
Ordinance through civil court action as provided by State law.
ARTICLE VIII
If any section, paragraph, subdivision, clause, phrase
or provision of this Ordinance shall be adjudged invalid or
held unconstitutional, the same shall not affect the validity
of this Ordinance as a whole or any part of provisions thereof
other t1lan the part so decided to be invalid or unconstitutional.
ARTICLE IX
This Ordinance shall become effective and be in full
force and effect from and after the date of its final passage.
PRESENTED AND APPROVED ON FIRST READING at a regular
meeting of the Euless City Council on September 1 1 , 1973.
GIVEN SECOND AND FINAL READING at a regular meeting of
the Euless City Council on September 25, 1973.
