AN ORDINANCE GRANTING TO GENERAL
TELEPHONE COMPANY OF THE SOUTHWEST
THE RIGHT TO OPERATE WITHIN THE
CORPORATE LIMITS OF THE CITY OF
EULESS, TEXAS, IN THAT AREA OF
EULESS LOCATED WITHIN THE BOUNDARY
LIMITS OF THE DALLAS -FORT WORTH
REGIONAL AIRPORT; APPROVING THE
PROPOSED SCHEDULE OF RATES SUBMITTED
TO EULESS BY GENERAL TELEPHONE COMPANY
OF THE SOUTHWEST; RESERVING TO THE
CITY OF EULESS THE RIGHT AND POWER TO
REGULATE THE STANDARD AND QUALITY OF
TELEPHONE SERVICE FURNISHED BY GENERAL
TELEPHONE COMPANY OF THE SOUTHWEST
WITHIN THE DESIGNATED AREAS OF OPERATION;
PROVIDING THAT SUCH RIGHT TO OPERATE
WITHIN THE DESIGNATED AREAS SHALL EXTEND
FOR A PERIOD OF ONE YEAR FROM THE EFFEC-
TIVE DATE OF THIS ORDINANCE.
WHEREAS, General Telephone Company of the Southwest has
requested the right and authority from the City of Euless to
furnish airport telephone service within the boundaries of the
Dallas -Fort Worth Regional Airport lying within the corporate
limits of the City of Euless, and
WHEREAS, General Telephone Company of the Southwest has
submitted a proposed schedule of rates for approval by Euless
being the same rate schedule heretofore accepted and approved
by the Dallas -Fort Worth Regional Airport Authority, and
WHEREAS, the City of Euless recognizes that a common
schedule of rates must be effective within the corporate limits
of all cities in which the Dallas -Fort Worth Regional Airport
is located;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EULESS, TEXAS:
Section 1: That the General Telephone Company of the
Southwest is hereby authorized to place into effect on its
September 25, , 1973 , billing date rates within the Dallas -Fort
Worth Airport for Second Tier Dallas Metro Service and Optional
Dallas -Fort Worth Metro Service in addition to the attached
schedule of rates.
Section 2: That nothing in this Ordinance contained shall
be construed as in any manner, now or hereafter, limiting or
modifying the right and power of the City Council under the law
to regulate the rates charged by the General Telephone Company
of the Southwest for its service within the City of Euless,
Texas.
Section 3: The right and authority to operate within the
boundaries of the Dallas -Fort Worth Regional Airport lying within
the corporate limits of the City of Euless, Texas, granted
hereunder shall extend for a period of one year from the effec-
tive date of this Ordinance.
Section 4: The City of Euless, Texas, reserves its right
and power to periodically examine the standard of service offered
by the General Telephone Company of the Southwest within its
corporate limits.
Section 5: At such time as the General Telephone Company
of the Southwest has installed, constructed and operates its
equipment, personal property and assets within the corporate
limits of the City of Euless, Texas, a franchise agreement
and contract by and between the General Telephone Company of
the Southwest and the City of Euless, Texas, shall be negotiated.
The customary franchise charge levied on other utilities by the
City of Euless, Texas, shall be incorporated in and made a part
of such franchise agreement.
Section 6: This Ordinance shall be in full force and
effect from and after the date of its final passage.
PRESENTED AND APPROVED ON FIRST READING at a regular meeting
of the Euless City Council on September 11, 1973, and GIVEN
SECOND AND FINAL READING at a regular meeting of the Euless
City Council on September 25, , 1973.
