AN ORDINANCE AUTHORIZING THE ESTABLISHMENT
OF ADDITIONAL MUNICIPAL COURTS FOR THE CITY
OF EULESS AND THE APPOINTMENT OF ADDITIONAL
JUDGES FOR THE STAFFING OF SAME; PROVIDING
A SAVINGS CLAUSE, ESTABLISHING AN EFFECTIVE
DATE AND DECLARING AN EMERGENCY.
WHEREAS, because of increases in the population of the City
of Euless, increasing traffic flow through, into and from such City,
and an increase in the number of offenses over which the Municipal
Court of the City of Euless has jurisdiction, an appreciable
increase has occurred in the number of cases filed in the Euless
Municipal Court, and
WHEREAS, such increase in the number of cases has resulted
correspondingly in a congestion of the docket of such Court, and
WHEREAS, there appears to be a trend which evidences con-
tinuing increases in the future which will even further congest the
docket of such Court, and
WHEREAS, it is the desire of the Euless City Council to
provide effective measure to assure the right of all citizens
appearing before such Court to a fair and expeditious hearing, and
WHEREAS, the Council has determined that the need now
exists and will continue in the future for an increase in the num-
ber of courts and judicial personnel necessary to their proper
conduct so as to alleviate docket congestion and assure to each
citizen the unalienable right of a fair and expeditious determina-
tion of any criminal charge pending against him:
NOW, THEREFORE, BE IT ORDAINED BY THE EULESS CITY COUNCIL:
I
The Euless City Council shall have the right and authority
from time to time, by appropriate resolution, to establish addi-
tional Municipal Courts which courts, when so established, shall
be courts of full stature and equal dignity with the present and
existing Euless Municipal Court.
II
That the Euless City Council shall, by appropriate resolu-
tion, have the authority from time to time to also name additional
judges and /or associate judges to preside over and perform the
judicial functions attendant each of the Municipal Courts of the
City of Euless.
III
That each of such Municipal Judges and /or Associate Judges
shall serve at the pleasure of the Euless City Council and may be
removed, without cause shown, at any time and from time to time at
the pleasure of the Euless City Council. That such Municipal
Judges and any Associate Municipal Judges shall be appointed with-
out term to serve as herein provided at the pleasure of the Euless
City Council.
IV
That the Judges and Associate Judges of the Euless Munici-
pal Courts shall be compensated in an amount and manner as same
may from time to time be prescribed by the Euless City- Council.
V
That each of such Municipal Judges and Associate Judges
shall have full authority and concurrent jurisdiction to preside
in the court or courts primarily assigned one to the other and at
any time and from time to time in the absence of the other. Each
of such Judges and /or Associate.Judges shall be of equal stature
and dignity with concurrent jurisdiction one with the other, each
with full right, power and authority to perform each and every
judicial function authorized by the Charter and Ordinances of said
City, the statutes, Constitution and laws of the State of Texas.
VI
Should any section, article, provision or part of this
Ordinance be declared to be unconstitutional or void by a court of
competent jurisdiction, such decisions shall in no way affect the
validity of any of the remaining parts of this Ordinance unless
the part held unconstitutional or void is inseparable from and
indispensdble to the operation of the remaining parts. The City
Council hereby declares that it would not have passed those parts
which may be unconstitutional at the time of the passage of this
Ordinance.
VII
This Ordinance shall become effective and be in full force
and effect from and after the day of its adoption and publication as
by law provided.

VIII
The fact that the enactment of this Ordinance is necessary
to preserve the public business, peace, health, safety and general
welfare, creates an urgency and an emergency in the immediate
preservation of same.
APPROVED AND ADOPTED on first and final reading on the
20th day of July , 1974, at a specially called
meeting of the City Council of the City of Euless, Texas.
