AN ORDINANCE AMENDING SECTION 3 -23 OF ARTICLE
2 OF CHAPTER 3 OF THE CODE OF ORDINANCES,
CITY OF EULESS, TEXAS, AND CHANGING THE FEES
CHARGED FOR THE TAKING UP, IMPOUNDING, AND
KEEPING OF ANIMALS BY THE CITY OF EULESS.
WHEREAS, Section 3 -23 of Article 2 of Chapter 3 of the Code_
of Ordinances, City of Euless, Texas, now provides specific fees
chargeable for the taking up, impounding and keeping of stray
animals by the Animal Warden of the City of Euless, and
WHEREAS, such schedule was adopted more than 17 years ago
and is now wholly inconsistent with the actual expenses incurred
by the city with respect to taking up, impounding and keeping of
stray animals, and
WHEREAS it is the desire of the City Council to provide for
an increase in such fees more in keeping with the actual costs
incurred by the City in connection with same and to provide a
method whereby such fees may be periodically increased to pro-
vide for increases in costs incurred by the City without requir-
ing the enactment of subsequent legislation by the City Council
of the City of Euless, and
WHEREAS it is the desire of the City Council to designate
the City Manager of the City of Euless as the person and officer
of the City charged with the responsibility of periodic evalua-
tion and change in such fees;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS, THAT SECTION 3 -23 OF ARTICLE 2 OF CHAP-
TER 3 OF THE CODE OF ORDINANCES, CITY OF EULESS, BE AND THE SAME
IS HEREWITH AND HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS:
Sec. 2 -23 Fees - Schedule
For each animal taken and impounded there shall be paid to
the City Treasurer by the owner thereof or his agent, a charge
for the taking up and impounding of same and there shall be
additionally paid a further charge per day for each day except
the first day that such animal shall remain in the custody of
the Animal Warden. Such fees and /or charges are charged for
the purpose of covering the costs of taking up, impounding,
feeding, and caring for such animals. When such animals are
sold in accordance with the provisions of this Article, a fur-
ther charge shall be levied and paid by the party purchasing
same. An additional charge shall be levied and paid by any
such person so purchasing such an animal when such animal is a
male capable of breeding, such as boars, stud horses, jacks
or bulls, found at large and impounded. Likewise there shall
be levied and paid an additional charge by any owner or his
agent for the impounding, taking up, feeding and care of any
such animal capable of breeding such as hereinbefore described.
The fees and /or charges herein provided for shall be established
and from time to time amended by the City Manager of the City
of Euless, Texas. Such fees and /or charges and /or any changes
thereto established by the City Manager of the City of Euless,
Texas, shall be effective from and after the date a schedule
of such fees so established or changed are promulgated by the
City Manager. The term promulgation as herein used shall mean
the furnishing of written schedule of such fees, as established
or amended, to the Animal Warden of the City of Euless, and the
posting of same in a conspicuous place at the animal shelter of
the City of Euless or another public facility of the municipal-
ity of the City of Euless.
APPROVED AND ADOPTED ON FIRST AND FINAL READING on the 25th
day of November, 1975, at a regular meeting of the City Council
of the City of Euless, Texas.
