AN ORDINANCE AMENDING ORDINANCE NO. 500, SAME
BEING THE CITY OF EULESS ANIMAL AND RABIES
CONTROL ORDINANCE, WHICH AMENDMENT REVISES
SECTION 3 -5 THEREOF, MAKING IT AN OFFENSE TO
OWN, HARBOR, KEEP OR MAINTAIN ANY ANIMAL THAT
BITES, SCRATCHES OR ATTACKS ANY PERSON;
PROVIDING A SEVERABILITY CLAUSE; A PENALTY FOR
VIOLATION THEREOF; DECLARING AN EMERGENCY AND
PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS:
I.
Section 3 -5 of Article I of the City of Euless Animal and Rabies
Control Ordinance is herewith and hereby amended in its entirety to
hereafter read and be as follows:
SECTION 3 -5 - ANIMALS - BITING, SCRATCHING OR ATTACKING ANY
PERSON
It shall be unlawful for any person to own,
harbor, maintain or keep any animal that bites,
scratches or attacks any person unprovoked,
provided the person bitten was not trespassing
upon the property of the person owning, harbor-
ing, maintaining or keeping such animal.
II.
Severabiljt_y. The provisions of this Ordinance shall be, and
they are, declared to be severable, and should any portion thereof
be declared to be invalid for any reason by a Court of competent
jurisdiction, such Bolding shall not affect the remaining portions
hereof.
III.
Perialty 1 -or Violation. Any person, firm or corporation violating
any of the terms and provisions of this Ordinance shall be deemed
guilty of a misdemeanor and upon conviction thereof shall be fined
in an amount not to exceed $200.00. Lach such violation shall be
deemed a separate offense and shall be punishable as sucli hereunder.
IV.
Declaring an Emergency. The fact that the enactment of a
revision of the City of Euless Animal and Rabies Control Ordinance
is necessary to preserve and continue the public business, health,
safety and general welfare of the citizens of the City of Euless,
creates an urgency and an emergency in the immediate preservation
of the same, and requires that this Ordinance shall take effect
immediately from and after its passage, and it is accordingly so
ordained.

Effective Date. This Ordinance shall be in full force and effect
from and after its passage and publication as provided by the Euless
City Charter and the laws of the State of Texas.
PASSED and APPROVED by the City Council of the City of Euless,
Texas, on first and final reading this the 14th day of December
1976.
