HomeMy WebLinkAbout527 11-08-1977ORDINANCE NO. 527 AN ORDINANCE AMENDING ORDINANCE NO. 43 AND SECTION 7-3 OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, BY ADDING THERETO A TIME AND LIMITATION UPON THE PLACEMENT AND REMOVAL OF GARBAGE CONTAINERS; PROVIDING A SEVERABILITY CLAUSE; AN EFFECTIVE DATE AND A PENALTY FOR VIOLATION THEREOF, WHEREAS, it has come to the attention of the Euless City Council that certain citizenry are allowing garbage containers with refuse therein to remain outside their residence following collection, and WHEREAS, such containers left unattended for such periods of time are far more susceptible to their contents being spilled and scattered by animals and inclement elements, and WHEREAS, when such containers are spilled and their contents scattered within the community there exists not only an unsightly but hazardous condition to the health, safety and welfare of the citizens of the community, and WHEREAS, the Euless City Council in response to citizens' complaints is of the belief that limiting the period of time prior to and following collection wherein garbage receptacles may be left outside appropriately constructed enclosures does contribute to such unsightly litter and health hazard. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS: Section 7 -3 of Chapter 7 of the Code of Ordinances of the City of Euless (same being also known as Ordinance Number 43) is herewith amended to hereafter read as follows: Sec. 7 -3 Same - Time of Placement and Retrieval, Condition, Cleanliness. It shall be unlawful to place garbage containers outside of a suitable enclosure where same can be scattered by animals or the elements of weather, except between the hours of 8:00 p.m, of the day prior to scheduled collection and 8:00 p.m, of the day of scheduled collection. By the term "suitable enclosure" as used herein is meant a fully enclosed area such as within a residence, enclosed garage or outbuilding, or a fully contained area wherein access by stray animals to the contents of garbage containers is pre- vented and wherein the contents of garbage containers are pro- tected from the elements of weather so as to avoid the loss, spillage and scattering of such contents upon the streets, alleys and premises of the city and its inhabitants. Severability. The provisions of this Ordinance shall be, and they are, declared to be severable, and should any portion thereof be declared to be invalid for any reason by a Court of competent jurisdiction, such holding shall not effect the remaining portions hereof. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined an amount not to exceed $200.00. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. IV. Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. -2- PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 25th day of October , 1977; GIVEN SECOND READING, PASSED AND APPROVED at a regular meeting of the Euless City Council on the 8th day of November 1977.
