AN ORDINANCE AMENDING A PORTION OF THE TRAFFIC
CODE OF THE CITY OF EULESS, TEXAS, BY AMENDING
ORDINANCE 116, ARTICLE III, SECTION 21, REGU-
LATING SPEEDING ON PUBLIC ROADWAYS WITHIN SAID
CITY; PROVIDING A PENALTY; REPEALING ORDINANCE
INCONSISTENT HEREWITH; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance 116, Article III, Section 21,
of the Ordinances of the City of Euless, as well as Sections 169(b)
and 170(b) of Article 6701d, Revised Civil Statutes, the Citv of Euless
has authority to establish both minimum speed limits and prima facie
maximum reasonable and prudent speed limits within its corporate bounda-
ries for vehicles on streets and highways; and,
WHEREAS, upon the basis of engineering and traffic investigations
taking into consideration the width and condition of the pavement, the
usual traffic, as well as other circumstances on public streets and high-
ways, the City Council has determined that certain speeds at certain
locations are reasonable and prudent prima facie maximum speeds;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1.
That Ordinance 116, Article III, Section 21, of the Ordinances
of the City of Euless, Texas, be and the same is hereby amended as
follows:
Subsection A General Speed Limits
(1) No person shall drive as defined by state law a
motor vehicle, a motorcycle, bicycle, motor driven cycle, motor -
assisted cycle, or any other vehicle of any kind upon a public
street, alley, highway, or parkway within the corporate limits
of the City of Euless at a speed greater than is reasonable and
prudent under the circumstances then existing. Except where a
special hazard exists that requires lower speeds for compliance
with paragraph (2) of this subsection, the limits specified in
this Subsection A or Subsection B herein and established as
authorized by law shall be the lawful speed limit, but any speed
in excess of the limits so specified and established as authorized
by law shall be prima facie evidence that the speed is not reason-
able or prudent and that it is unlawful;
Thirty (30) miles per hour in any urban district.
"Urban District" means the territory contiguous
to and including any highway or street which is
built up with structures devoted to business,
industry or dwelling houses, situated at intervals
of less than one hundred (100) feet for a distance
of one - quarter (1/4) of a mile or more on either
side.
(2) No person shall drive a vehicle upon a public street
or a public alley within the corporate limits of the City of Euless
at a speed greater than is reasonable and prudent under the conditions
and having regard to the actual and potential hazards then existing.
In every event speed shall be so controlled as may be necessary to
avoid colliding with any person, vehicle or other conveyance on or
entering the highway in compliance with legal requirements and the
duty of all persons to use due care.
Subsection B Speed Limits on Certain Streets
Upon the basis of an engineering and traffic investigation
heretofore made as authorized by the provisions of Section 169, V.G.S.,
6701d, Uniform Act Regulating Traffic on Highways, the following prima
facie speed limits hereafter indicated for vehicles are hereby determined
and declared to be reasonable and safe; and such speed limits are hereby
fixed at the rate of speed indicated for vehicles traveling upon the
named streets, or parts thereof, the same being portions of the public
street system of the city, said speed limit to be in force and effect
unless otherwise provided. The streets hereby regulated, and the
maximum prima facie speed limits thereof, are as follows:

SECTION 2.
That any person who violates any of the provisions of
this ordinance shall be guilty of a misdemeanor and, upon
conviction thereof, shall be fined not less than One Dollar
($1.00) nor more than Two Hundred Dollars ($200.00).
SECTION 3.
That this ordinance shall repeal every prior ordinance
and provision of the Ordinances of the City of Euless, as amended,
in conflict herewith, but only in so far as the portion of such
prior ordinance or provision shall be in conflict, and as to all
other ordinances and provisions of the Code not in conflict here-
with, this ordinance shall be and is hereby made cumulative.
SECTION 4.
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted .
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 5.
The fact that the enactment of an amendment to the Traffic

Code of the City of Euless is necessary to preserve and continue
the public business, health, safety and general welfare of the
citizens of the City of Euless, creates an emergency in the im-
mediate passage of same, and requires that this Ordinance shall
take effect immediately from and after its passage, and it is
accordingly so ordained.
SECTION 6.
This Ordinance shall be in full force and effect from
and after its passage and publication as provided by the Euless
City Charter and the laws of the State of Texas.
