AN ORDINANCE AMENDING ORDINANCE No. 347, SAME
BEING THE ZONING CODE OF THE CITY OF EULESS,
TEXAS, TO REVISE AND RESTATE THE SPECIFIC USE
SCHEDULE FOR SPECIFIC USE PERMITS; AMENDING
CATEGORY OF USES PERMITTED IN CERTAIN ZONING
CLASSIFICATIONS; PROVIDING A SEVERABILITY
CLAUSE; AN EFFECTIVE DATE; AND A PENALTY
FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
I.
Sub - section 1002, entitled Specific Use Schedule, of Euless Ordinance
No. 347, same being the Zoning Code of the City of Euless, Texas,
is herewith amended to be and shall hereafter read as follows:

II.
Sub- section 7 -401, entitled Uses Permitted, with respect to "C -1"
NEIGHBORHOOD BUSINESS DISTRICT, of Ordinance No. 347, same being
the Zoning Code of the City of Euless, Texas, is herewith amended
by the addition of the following new sub - paragraph (12) which shall
hereafter read as follows:
(12) Library, Art Gallery or Museum, Public
III.
Sub - section 7 -301 of Ordinance No. 347, same being the Zoning Code
of the City of Euless, Texas, entitled Uses Permitted, with respect
to "R -3" MULTIPLE- FAMILY LOW DENSITY DWELLING DISTRICT: limit of
(12) units per acre, is herewith amended by the amendment of the
existing sub - paragraph (9) which shall hereafter read as follows:
(9) Kindergartens, day nurserys, private schools
teaching similar subjects as are taught in
elementary schools, provided the buiding, or
buildings, are set back from all required yard -
lines two (2) feet for every foot of building
height and provided all off - street parking
facilities consistent with requirements of
the use are provided on the site, and further
provided that such kindergartens, day nurserys,
or private schools are not located within a
residential dwelling on the site also used for
habitation as within an apartment unit. In the in-
stance of private schools and kindergartens,
a minimum building area of thirty (30) square
feet per student and a minimum site area of
two hundred (200) square foot per student
shall be provided.

IV.
Sub - section 7 -501 of Ordinance No. 347, same being the Zoning
Code of the City of Euless, Texas, entitled Uses Permitted,
with respect to "C -2" COM24UNITY BUSINESS DISTRICT, is herewith
amended by the deletion of the existing sub - paragraph (2) apper-
taining to auto sales agency and repair work and the substitution
therefore, of a new sub - paragraph (2) which shall hereafter read
as follows:

Sub - section 7 -501 of Ordinance No. 347, same being the Zoning
Code of the City of Euless, Texas, entitled Uses Permitted, with
respect to "C -2" COMMUNITY BUSINESS DISTRICT is herewith amended
by the addition of the following new sub - paragraphs (28), (29),
(30), (31), and (32) which new sub - paragraphs shall hereafter read
as follows:
(28) School, Business
(29) School, Commercial, Trade
(30) Mortuary, Animal Clinic, or Hospital (no out-
side runs)
(31) Animal Pound, Public (no outside runs)
(32) Garden Shop and Plant Sales
VI.
Sub - section 7 -701 of Ordinance No. 347, same being the Zoning Code
of the City of Euless, Texas, entitled Uses Permitted, with re-
spect to "I -1" - LIGHT, INDUSTRIAL DISTRICT, is herewith amended
by the addition of the following new sub - paragraph (21) which
shall hereafter read as follows:
(21) Animal Clinic, Animal Hospital or Animal
Kennel (outside runs)
VII.
Severability. That it is hereby declared to be the intention of
the City Council that the sections, paragraphs, sentences, clauses
and phrases of this ordinance are severable, and if any, phrase,
clause, sentence, paragraph or section of this ordinance shall
be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconsitutionality shall
not affect any of the remaining phrases, clauses, sentences,

paragraphs and sections -of this ordinance, since the same would
have been enacted by the City Council without the incorporation
in this ordinance of any such unconstitutional phrase, clause,
sentence, paragraph or section.
VII.
Penalty for Violation. Any person, firm or corporation violating
any of the terms and provisions of this Ordinance shall be deemed
guilty of a misdemeanor and, upon conviction thereof, shall be
fined in an amount not to exceed $200.00. Each such violation shall
be deemed a separate offense and shall be punishable as such hereun-
der.
VIII.
Effective Date. This Ordinance shall be in full force and effect
from and after its passage and publication as provided by the Euless
City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of
the Euless City Council on the 14th day of February, 1978; by
a vote of 5 ayes, 0 nays and 0 abstentions; GIVEN SECOND READING,
PASSED AND APPROVED at a regular meeting of the Euless City Council
on the 28th day of February, 1978, by a vote of 5 ayes, 0 nays
and 0 abstentions.
