HomeMy WebLinkAbout546 06-13-1978ORDINANCE 546 AN ORDINANCE AMENDING SUB - SECTION 7 -1300 EN- TITLED "DEFINITIONS AND EXPLANATIONS APPLI- CABLE TO USE REGULATIONS', CERTAIN SUB- SECTIONS OF SECTION 9 ENTITLED "SIGN STANDARDS ", AND SUB - SECTION (66) OF SECTION 11 ENTITLED "GEN- ERAL DEFINITIONS" OF ORDINANCE NUMBER 347, SAME BEING THE ZONING CODE OF THE CITY OF EULESS, TEXAS, BY REVISING AND AMENDING THE "SCHEDULE OF SIGN STANDARDS" AND CERTAIN DEFINITIONS APPLICABLE THERETO AND TO PROVIDE A CESSATION OF PERMITS FOR CERTAIN SIGNS; PROVIDING A SEVER- ABILITY CLAUSE; AN EFFECTIVE DATE; A PENALTY FOR VIOLATION THEREOF; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. Sub - section 7 -1300, entitled DEFINITIONS AND EXPLANATIONS APPLICABLE TO USE REGULATIONS, of Euless Ordinance 347, same being the Zoning Code of the-city of Euless, Texas, is herewith amended in the following respects: Sub - section (43), entitled Name Plate Sign is herewith amended to hereafter read as follows: (43) Name Plate Sign: Any sign showing only the name and/or address of the owners or occupant of the premises on which it is erected or placed. Sub - section (44), entitled Real Estate Sign is herewith amended to hereafter read as follows: (44) Real Estate Sign: Any temporary sign pertain- ing to the sale or rental of property and advertizing the property only for a use for which it is legally zoned. Sub - section (45), entitled Construction Sign is herewith amended to hereafter read as follows: (45) Construction Sign: Any temporary sign iden- tify ni g the owner, architect, contractor, en- gineer, landscape architect, decorator or mort- gagee engaged in the design, construction or improvement of the premises on which the sign is located. Sub - section (46), entitled Non - residential Identification Sign is herewith amended to hereafter read as follows: (46) Identification Sign: Any sign which issued to identify shopping centers, industrial sites, re- tail districts and commercial sites. Sub - section (47), entitled Institutional Sign is herewith amended to hereafter read as follows: (47) Institutional Sign: Any sign or bulletin board used to identify schools, churchs, hospitals and similar public or quasi - public institutions. Sub - section (48), entitled Apartment Sign is herewith amended to hereafter read as follows: (48) Apartment Sign: Any Sign identifying an apart- ment building or complex of apartment build- ings. Sub - section (50), entitled General Business Sign is herewith amended to hereafter read as follows: (50) General Business Sign: Any advertising sign which is used to identify a business, profes- sion, service, product, or activity conducted, sold or offered on the premises where such sign is located. Sub - section (52), entitled Advertising Sign shall read as follows: (52) Advertising Sign: Any sign which promotes and advertises commodities or services not limited to being offered on the premises on which such signs are located. Sub - section 7 -1300 entitled DEFINITIONS AND EXPLANATIONS APPLICABLE TO USE REGULATIONS, of'Eu ess Ordinance Nu. 347, same being the Zoning Code of the City of Euless, Texas, is herewith amended by the addition of the following new sub - sections, which shall hereafter be and read as follows: Sub - section (99), entitled Development Sign shall read as follows: -2- (99) Develo ment Sign: Any temporary, on -site promotional sign pertaining to the development of land or construction of buildings. Sub- section (100), entitled Ground Sign shall read as follows: (100) Ground Sign: Any sign which is erected on a vertical framework consisting of two (2) or more uprights supported by the ground. Sub - section (101), entitled Marque Sign shall read as follows: (101) Marque Sign: Any sign erected on a marque or fixed awning. Sub - section (102), entitled Parapet Wall Sign shall read as follows: (102) Parapet Wall Sign: Any sign erected on the top surface of a parapet wall. Sub - section (103), entitled Pole Sign shall read as fol- lows: (103) Pole Sign: Any sign supported by a single free - standing pole, and having no guys or braces to the ground or to any structure other than the pole. Sub - section (104), entitled Projecting Sign shall read as follows: (104) Projecting Sign: Any sign which projects from a building and which has one end attach- ed to a building or other permanent struc- ture. Sub - section (105), entitled Roof Sign shall read as fol- lows: (105) Roof Sign: Any,sign erected on a vertical framework supported by and located immediately and entirely over the roof of a building. Sub - section (106), entitled Wall Sign shall read as follows: (106) Wall Sign: Any sign erected flat against a wall, support by the wall, and having the sign face parallel to and not more than twelve (12) inchs from the walls surface. -3- Neon tubing attached directly to a wall surface shall be considered a "wallsign ". II. Sub - section (66) of Section 11 entitled GENERAL DEFINITIONS, of Euless Ordinance No. 347, same being the Zoning Code of the City of Euless, Texas, is herewith amended to hereafter be and read as follows: (66) Sign: The term "sign" shall mean and include every sign, name, number, identification, des- cription, device, display, flag, banner, pennant, illustration, beacon, light or insignia, and structure supporting any of the same, affixed directly or indirectly to or upon any building or outdoor structure, or erected or maintained upon a piece of land, which directs attention to any object, product, service, place, activity, person, institution, organization or business. Any interior illuminated or moving sign or light which is visable from the exterior shall be deemed to be erected on the exterior of the building or structure. III. Line Fronts e L -1, I -1, W,PA, Advertising 1_2 None 50 P'G' 25 Yes No No- Permanent PR,M,R 9 -300 GENERAL PROVISIONS of Section 9 of Euless Ordinance No. 347 same being the Zoning Code of the City of Euless, Texas, is herewith amended by the addition of a new sub - paragraph (9) which shall hereafter be and read as follows: (9) A building permit issued for any sign pursuant to the Building Code of the City of Euless, Texas, shall automatically terminate and become void and of no effect upon the cessation, for a period of one hundred and eighty (180) days, of the use permitted by such permit or to which the sign directs attention or in the event such sign shall fail, for a period of one hundred and eighty (180) days to direct attention to an existing object, product, service, place, activity, person, institution, organization or business. Upon cessation of the'Building Per - mit for any sign, such sign shall thereafter be and constitute a non - permitted structure under and pursuant to the Building Code of the City of Euless, Texas, and shall be sub- ject to abatement and removal pursuant to the provisions of such Building Code and the owner thereof or occupant of the pre- mises upon which such sign shall be situated shall be subject to fine and /or penalty as provided pursuant to the provisions of the Zoning Code of the City of Euless, Texas, and the Building .Code of the City of Euless, Texas. IV. Severablity Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any, phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining, phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. -5- VI. Penalty for Violation. Any person or corporation who shall violate any of the provisions of this ordinance or fail to comply therewith or with any of the requirements thereof, or who shall build or alter any building or use in violation of any detailed statement or plan submitted and approved hereunder shall be guilty of a misdemeanor and shall be liable to a fine of not more than two hundred dollars ($200.00) and each day such viola- tion shall be permitted to exist shall constitute a separate offense. The owner or owners of any building or premises, or part thereof, where anything in violation of this ordinance shall be placed or shall exist, and any architect, building, contractor, agent, person or corporation employed in connection therewith and who may have assisted in the commission of any such violation shall be guilty of a separate offense and upon conviction shall be fined as herein provided. The City of Euless, likewise, shall have the power to enforce the provisions of this ordinance through civil court action as provided by State Law. VII. Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. VIII. Emergency Clause. By the affirmative vote of four or more of its members, The City Council declares that this is an Ordi- nance for the immediate preservation of the public peace, property, health, and safety, and is an emergency measure within the mean- ing of Article II, Section 11 of the City Charter; and the requirement that it be read at two meetings, as specified in such Section 11, Is hereby dispensed with. PRESENTED AND PASSED ON first and final reading.on the th` day of June, 1978, at a regular meeting of the City Council ofd the City of Euless, Texas, by a vote of 5 ayes and 0 nays and 0 abstentions.
