HomeMy WebLinkAbout555 09-26-1978ORDINANCE NO. 555 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF EULESS AS SET OUT IN THE ORDINANCE; DECLARING AN EMERGENCY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A PENALTY FOR VIOLATION THEREOF WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION I. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: 1. Eastbound Frontage Road Only (a) From Station 265 +07.42 (West City Limits of Euless, being also the City Limits of Bedford) easterly 2.307 miles to Station 386 +87.49 (intersection of Main Street) at 40 M.P.H. 2. Westbound Frontage Road Only (a) From Station 905 +45 (East City Limits of Euless, being also the City Limits of Fort Worth) westerly 0.752 miles to Station 865 +74 (being approximately 450 feet east of Main Street) at 40 M.P.H. (b) From Station 387 +33.31 (Main Street) westerly 1.017 miles (West City Limits of Euless) to Station 333 +61.70 at 40 M.P.H. SECTION II. PENALTY FOR VIOLATION Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred dollars ($200.00). SECTION III. EMERGENCY CLAUSE By the affirmative vote of four or more of its members, the City Council declares that this is an ordinance for the immediate preservation of the public peace, property, health and safety, and is an emergency measure within the meaning of Article II, Section 11, of the City Charter; and the requirement that it be read at two meetings, as specified in such Section 11, is hereby dispensed with. SECTION IV. SEVERABILITY CLAUSE That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION V. EFFECTIVE DATE This ordinance shall become effective upon and after final passage and publication as provided by the Euless City Charter and the laws of the State of Texas, and the posting of appropriate signs giving notice thereof, upon such streets and highways. - 2 - PRESENTED AND PASSED ON first and final reading on the 26th day of September, 1978, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 5 ayes and 0 nays and 0 abstentions.
