HomeMy WebLinkAbout44 02-24-1956ORDINANCE NO. 44 AN ORDINANCE CREATING AND ESTABLISHING A CORPORATION COURT IN THE CITY OF EULESS, TEXAS; PROVIDING FOR JURISDICTION THEREOF AND FOR A JUDGE OF SAID COURT, TO BE KID CWN AS RECORDER; FURTHER PROVIDING FOR THE ELECTION OF SAID RECORDER AND FOR THE APPOINTMENT OF A RECORDER FOR THE PRESENT UNEXPIRED TERM; PROVIDING THAT THE CITY SECRETARY SHALL BE THE CLERK{ OF SAID COURT AND DUTIES OF SAID CLERK; FURTHER PROVIDING FOR REGULAR AND SPECIAL SESSIONS THEREOF, AND FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Title 28, Chapter 16, Articles 1194 to 1200 inclusive, 1.925 Revised Civil Statutes of Texas, provides for the creation of corpor -,.tion courts, for cities, towns and villages incorporated pursuant to provisions of said Title 28; Chanters 1 to 10; and, WHEREAS, Article 1197 of said Title provides the procedure for the selection of a Recorder of said Court in all cities, towns and Villages not incorporated under special charter; and, WHEREAS, the City of Euless, Texas, is duly incorporated and is now functioning pursuant to the provisions of said Title 28 BE IT ORDAINED BY THE CITY OF EULESS, TEXAS: I. THAT there is hereby created and established in the City of Euless, Texas, a court, to be known as the "Corporation Court of the City of Euless, Texas ". IIo SUCH court shall have jurisdiction within the territorial limits of the City of Euless, Texas, in all criminal cases arising under the ordinances of said City, and shall also have concurrent juris- diction with any justice of the peace in any precinct in which said City is situated in all criminal cases arising under the criminal laws of this State, in which punishment is by fine only, and where. the maximum of such fine may not exceed two hundred dollars ($200.00), and_ arising within such territorial limits. III, SUCH Court shall be presided over by a judge, to be known as the "Re corder".. who shall be elected in the. same manner and for the same time as the Mayor is elected, and in the event a vacancy, is created in the office of said "Recorder', such vacancy shall be filled by the City Council for the unexpired term only. The City Council, upon adoption of this ordinance, shall appoint a "Recorder" for such court to serve for the present unexpired term ending April 1, 1957, and until his successor is duly elected and qualified. IVn The City Secretary shall be ex-officio clerk of the Court herein created, and the City Council may in its discretion, appoint a deputy to said City Secretary with the same power and duties as herein conferred upon said Secretary, V. The Clerk of the Court shall keep minutes of the proceedings of the said? Court, issue all process, and generally per -form all the duties of the Clerk of a court as prescribed by law for a county clerk in so far as the some may be applicable. VI11 The Corporation Court shall. hold time and place as the City Council sessions as the Recorder may deem before said Court, VII one regular session weekly at such may designate, and such special necessary to care for the business This ordinance shall become effective and_ be in full force and effect immediately upon its adoption.
