HomeMy WebLinkAbout2016-09-13 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL Tuesday, September 13, 2016 A regular meeting of the Euless City Council was called to order by Mayor Linda Martin at 4:32 p.m. on Tuesday, September 13, 2016, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included Mayor Linda Martin, Council Members Tim Stinneford, Jeremy Tompkins, Linda Eilenfeldt, and Harry Zimmer. Council Member Eddie Price arrived at 4:43 p.m. Mayor Pro Tern Perry Bynum arrived at 4:54 p.m. During the Precouncil meeting: Council Member Jeremy Tompkins announced that he and Mayor Martin attended the Texas Health Harris Methodist HEB Hospital Intensive Care Unit ribbon cutting on Wednesday, August 31, 2016, and advised that it was a wonderful event. Council Member Linda Eilenfeldt advised that she and several City staff members attended the grand opening of Dirt Cheap on Wednesday, September 7, 2016, and welcomed the store to Euless. Mayor Linda Martin participated in the Scrubs Day event at Texas Health Harris Methodist HEB Hospital and advised that she witnessed two heart catheter procedures. She expressed her admiration of the doctors who perform the procedures. City Manager Loretta Getchell informed the City Council that the Walk of Champions ceremony at The Parks at Texas Star honoring Mike Daniels will be held Saturday, September 24, 2016, at 10:00 a.m. Fire Chief Wes Rhodes announced that the Firefighters for Wounded Warriors 5K and Fun Run will be held Saturday, September 17, 2016, 8:00 a.m. at Bob Eden Park and approximately 200 runners have already registered. Police Chief Mike Brown announced that the Fort Worth Panthers Police Hockey Team will host a charity hockey game at the Dr. Pepper Stars Center at 5:30 p.m. on Saturday, September 17, 2016. All ticket sales and money raised through a raffle t-shirt sale will directly benefit the family of Officer David S. Hofer. Assistant City Manager Chris Barker advised of the upcoming tree trimming to be conducted by Oncor in their easements along Gateway Boulevard. City Manager Getchell reviewed the regular agenda. Council Minutes Page 2 of 9 September 13, 2016 City Manager Getchell provided an explanation of a proposed ordinance regarding payday lending regulations and distracted driver regulations. Discussion ensued regarding the necessity of a separate distracted driver ordinance in addition to state law. Lieutenant Brandon Zachary presented the Code update and provided information including hotel/motel inspections. • Police Chief Brown presented the quarterly Police update for the period ending June 30, 2016, and provided information including response times, crimes against persons, and introduced new employees. Additionally, he announced Law Enforcement Appreciation Night at the Texas Rangers Baseball game on Saturday, September 17, 2016. Police Officers Mike Sarro and Ed Pietrowski will lead a contingent of officers onto the field during a pregame ceremony in recognition of the Officer of the Month Award they were recently awarded by the National Law Enforcement Officers Memorial Fund of Washington, D.C. Discussion ensued regarding response time changes as a result of the demolition of the Main Street bridge in June. • Finance Director Janina Jewell presented the Financial update for the month ending July 31, 2016. PLEDGE OF ALLEGIANCE Mayor Linda Martin led the pledge of allegiance. ITEM NO. 1. PRESENTATION OF CERTIFICATE OF ACHIEVEMENT FOR EXCELLENCE IN FINANCIAL REPORTING AWARD Finance Director Jewell accompanied by Assistant Finance Director Jackie Theriot and Budget/Treasury Manager Diana Ayala announced that the Government Finance Officers Association (GFOA) has awarded the City of Euless a Certificate of Achievement for Excellence in Financial Reporting. Ms. Jewell presented the certificate to Mayor Martin and advised that this is the 29th consecutive year the City of Euless has Council Minutes Page 4 of 9 September 13, 2016 received this award. Additionally, she recognized Assistant Finance Director Theriot and her staff for their hard work in achieving this recognition. ITEM NO. 2. PRESENTATION IN RECOGNITION OF HEB READS READING CHALLENGE PARTICIPANTS Library Administrator Sherry Knight accompanied by Senior Librarian Angela Jones and Library Advisory Board Chair Barney Snitz introduced Kiera Elledge, Hurst-Euless- Bedford (HEB ISD) STEM and School Libraries Coordinator, and Angela Brown, South Euless Elementary Librarian. Ms. Knight advised that the HEB Reads program is a collaboration between the cities of Hurst, Euless, and Bedford, as well as HEB ISD and 496 students participated this past summer. 57 students achieved the highest level in the program by reading for 2,000 minutes. Ms. Knight announced that each of those 57 students will have a book donated to their school library in their name. Ms. Elledge thanked Ms. Knight and the City for their participation and was pleased to announce that every school campus within HEB ISD participated in the challenge including the junior highs and high schools. ITEM NO. 3. PRESENTATION OF PROCLAMATION Mayor Pro Tern Perry Bynum presented a proclamation to Sarah Harris, DFW Chapter Manager, Dallas Fort Worth National Ovarian Cancer Coalition, proclaiming September as Ovarian Cancer Awareness Month. CONSENT AGENDA (items 4 through 8) Mayor Martin asked Assistant City Manager Chris Barker to read each item into the record. Council Member Stinneford motioned to approve the consent agenda items number 4 through 8. Mayor Pro Tern Bynum seconded the motion. AUTHORIZED PURCHASE OF A PLATFORM FIRE TRUCK Authorized purchase of a Pierce Platform Fire Truck from Siddons-Martin Emergency Group, an authorized dealer for Pierce Manufacturing, 2600 American Drive, Appleton, Wisconsin, through the Houston-Galveston Area Council (HGAC) Cooperative Council Minutes Page 5 of 9 September 13, 2016 Purchasing Program. Pricing is based on the current HGAC Contract No. FS12-15 and includes fees associated with contract pricing and applicable prepayment discount. The estimated expenditure of $1,202,700 falls below budget estimates. ITEM NO. 5. APPROVED RESOLUTION NO. 16-1492 Approved the Fiscal Year 2016-2017 Service and Assessment Plan for the Glade Parks Public Improvement District No. 1 (PID #1.) PID #1 was established December 14, 2010, by Resolution No. 10-1350 for property located near the intersection of State Highway 121 and Cheek Sparger Road. Based on the amortization schedule of the debt service for such improvements, no assessment is necessary for FY2016-2017. ITEM NO. 6. APPROVED RESOLUTION NO. 16-1493 Approved the Fiscal Year 2016-2017 Service and Assessment Plan for the Glade Parks Public Improvement District No. 2 (PID #2.) PID #2 was established June 9, 2015, by Resolution No. 15-1461 for property located near the intersection of State Highway 121 and Cheek Sparger Road. Based on the amortization schedule of the debt service for such improvements, no assessment is necessary for FY2016-2017. ITEM NO. 7. APPROVED RESOLUTION NO. 16-1494 Approved the Fiscal Year 2016-2017 Service and Assessment Plan for the Euless Midtown Public Improvement District (PID.) The PID was established August 25, 2015, by Resolution No. 15-1471 for property located near FM 157, State Highway 10 and State Highway 183. Based on the Annual Service Plan, an assessment of $607,588 is necessary for FY2016-2017 to fund the debt service and annual collection costs. ITEM NO. 8. APPROVED CITY COUNCIL MINUTES Approved City Council minutes of the regular meeting of August 30, 2016, and the special called meeting of September 6, 2016. REGULAR AGENDA ITEM NO. 9. HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 16- 15-SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2133 Mayor Martin opened the public hearing at 7:12 p.m. Director of Planning and Economic Development Collins presented the item to the City Council and stated that the applicant, Jeff Nance, representing Nance Retail Stores, LLC dba Once Upon a Child, intends to continue leasing retail space within the Heritage Towne Center to run a used merchandise business focused primarily on children's toys, clothing, and accessories. This is strictly a retail establishment and not a thrift/donation style business model. Additionally, the Planning and Zoning Commission held a public Council Minutes Page 6 of 9 September 13, 2016 hearing on August 9, 2016, and recommended approval of the Specific Use Permit by a vote of 5-0-1 with the following conditions: 1. Tied to the business owner, Nance Retail Stores, LLC; 2. Tied to the business name, Once Upon a Child; 3. All merchandise shall be displayed within the store and not exterior to the building; 4. Any customers bringing items to be sold to the retail store shall bring such items interior to the store during business hours; 5. No items shall be left exterior to the store. Any such items shall be removed in a timely manner; 6. The Specific Use Permit may be revoked if one or more of the conditions imposed by this permit has not been met or has been violated; and 7. Upon revocation or expiration of the Specific Use Permit, all uses permitted hereunder shall cease. Applicant and owner Trista Nance was present to address any questions. Mayor Martin asked to hear from any proponents followed by opponents wishing to speak regarding the case. Seeing none, the public hearing was closed at 7:14 p.m. Council Member Eilenfeldt motioned to approve the first and final reading of Ordinance No. 2133, a request for a Specific Use Permit for Used Merchandise located at Heritage Towne Crossing Addition, Block B, Lot 1, 3001 State Highway 121, Suite 258, Texas 121 Gateway District (TX-121). Council Member Tompkins seconded the motion. Ayes: Mayor Martin, Mayor Pro Tem Bynum, Council Members Stinneford, Tompkins, Price, Eilenfeldt, and Zimmer Nays: None Mayor Martin declared the motion carried. ITEM NO. 10. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2135 Mayor Martin advised that, based on the results of a recent traffic study, staff is recommending the posted speed limit on Westpark Way be lowered from 40 mph to 35 mph from State Highway 10 to State Highway 183. Mayor Pro Tem Bynum motioned to approve the first and final reading of Ordinance No. 2135, amending the City of Euless Code of Ordinances, Chapter 82, "Traffic and Motor Vehicles," Article Ill, "Operation of Vehicle," Section 82-62, "Same—on certain streets and portions of streets," by amending the speed limit on Westpark Way from State Highway 10 to State Highway 183. Ayes: Mayor Martin, Mayor Pro Tern Bynum, Council Members Stinneford, Tompkins, Price, Eilenfeldt, and Zimmer Nays: None Mayor Martin declared the motion carried. ITEM NO. 11. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2131 Finance Director Jewell stated that public hearings were held August 30, 2016, and September 6, 2016, and the proposed tax rate supports the Fiscal Year 2016-2017 budget approved August 30, 2016. While the required motion to approve the tax rate implies that the rate is being increased, the tax rate is being lowered from the previous year and this will be the 22nd year that the City has either lowered or held the tax rate steady. Council Member Price motioned that the property tax rate be increased by the adoption of a tax rate of $0.4625 per $100 of assessed value, which is effectively a 6.57 percent increase in the tax rate, by adoption of Ordinance No. 2131. Council Member Stinneford seconded the motion. Ayes: Mayor Martin, Mayor Pro Tern Bynum, Council Members Stinneford, Tompkins, Price, Eilenfeldt, and Zimmer Nays: None Mayor Martin declared the motion carried. ITEM NO. 12. APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 2132 Finance Director Jewell stated that the Tarrant County Appraisal District is required to submit a summary of property values and exemptions within the City by July 25 of each year. The approved tax rate will be entered by the Tarrant County Tax Assessor Collector and taxes levied will be calculated based on the approval of this tax roll. Council Member Zimmer motioned to approve the first and final reading of Ordinance No. 2132, adopting the Tax Roll for 2016. Mayor Pro Tem Bynum seconded the motion. City Council Council Member Tompkins commended Finance Director Janina Jewell and the entire Finance Department for their hard work during the recently completed budgetary process. Council Member Stinneford clarified that despite the state required language in the motion to approve the tax rate (Agenda Item #11) as a property tax rate increase, the tax rate was actually lowered one half cent from $0.4675 to $0.4625 per $100 of assessed value. Police Chief Mike Brown mentioned upcoming events: • Fort Worth Panthers Police Hockey Team charity hockey game benefitting Officer David S. Hofer's family, Saturday, September 17, 2016, 5:30 p.m., Dr. Pepper Stars Center; • Texas Rangers Baseball Law Enforcement Appreciation Night, Saturday, September 17, 2016, 7:00 p.m. Mayor Martin expressed her appreciation to Police Chief Mike Brown and Fire Chief Wes Rhodes for their work in organizing and conducting the September 11 Observance ceremony held Friday, September 9, 2016, at the 9/11 Memorial outside of the Fire Administration building.
