HomeMy WebLinkAbout73 04-20-1957ORDINANCE NO. 73 AN ORDINANCE AMENDING ORDINANCE NO. 33 IDENTIFIED AS THE TEMPORARY COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; PROVIDING FOR CHANGE IN DESIGNATION IN CERTAIN AREAS AND AMENDING ZONING MAP TO CONFORM WITH SUCH AMENDMENT, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Zoning Commission of the City of Euless, "texas, following consideration of applications of Ross W. Smith, lessee, of 39.39 acres of land, and Allen Eades, attorney for C. D. Wallrath and wife, Jo Leta Little Wallrath, owners of a tract of land consisting of 29.217 acres of land, in the E. Rogers and Andrew J. Hewitt Surveys, Tarrant County, Texas, as is more fully hereinafter described, said land being situated within the City of Euless, Texas, and .having held public hearing thereon, in which all interested owners of property in the vicinity of said tracts were given ample and sufficient oppor- tunity to be heard in connection with said ap-Dli.cations, have recommended to the City Council a change in zoning designation of said tracts, as by law provided, publication of notice of final hearing on said recommendation to be held before the City Council was had, by publishing the same in the Mid Cities News, the official newspaper of the City of Euless, on April 5, 1957, and after said public hearing before the said City Council held in accordance with said notice wherein all owners of property situated in the City of Euless, Texas, were given ample and suffi- cient opportunity to be beard, the City Council deems it to the best interest to the health, safety and general welfare of the City and its inhabitants that the recommendation of the said Zoning Commission be approved, which the City Council so finds. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: 1. That the zoning designation of the property aforementioned and as described by metes and bounds herein, be, and is hereby ordered, changed. from "A" Single Family Dwelling District to "C" Commercial District; that the said property aforementioned is hereby more fully described by metes and bounds as follows: TRACT NO. 1 BEINs that certain lot, tract and parcel of land and being 39.39 acres, more or less, out of the E. Rodgers Survey in Tarrant County, Texas, described by metes and bounds as follows: I, BEGINNING at the point of intersection of the East line of Farm to Market Road No. 157, with the SE line of State Highway No. 183; THENCE, N. 33 degrees 15 minutes East 163.8 feet; THENCE, along the Southeast line of State Highway No. 183 to a curve 563.4 feet to a concrete monument on the line of said highway; THENCE, North 511 degrees 41 minutes East 845.6 feet to a corner in the Southeast line of said State Highway No. 183; THENCE, South 1 degree 40 minutes East 326.6 feet for corner; THENCE, East 30 feet for corner; THENCE, South 00 degrees 07 minutes rest 1429.5 feet for corner; THENCE, North 88 degrees 57 minutes West 1304.8 feet for corner; said point being in the East line of Farm to Market Road No. 157; THENCE, along the East line of Farm to Market Road No. 157 Nortli 824.6 feet to the place of begi nni.ng . TRACT NO. 2 BEING those certain lots, tracts and parcels of land and being 29.217 acres of land, more or less, in the E. Rodgers and A. J. Hewitt Surveys in Tarrant County, Texas, described by metes and bounds as follows: First Tract: A part of the A. J. Hewitt Survey, Ababtraet 684, Patent No. 244 in Vol. 13, in Tarrant County, Texas, described as follows: BEGINNING at a point 462 varas East and 583.2 varas South of the Northwest corner of the A. J. Hewitt Survey; THENCE, South 204.8 varas to the North line of State highway 15; THENCE, Southwesterly along the North line of said Highway 15 to the intersection of the South line of said A. J. Hewitt Survey and the North line of the E. Rodgers Survey; THENCE, West with the South line of the A. J. Hewitt Survey to the East line of the Arlington - Grapevine Highway; THENCE, North with the said East line of said Highway 394.8 varas; THENCE, East 452.2 varas to the place of beginning. Second Tract: Being all that portion of the E. Rodgers Survey, Tarrant County, Texas, acquired by W. A. Moores by deed dated December 21, 1935, executed by J. W. McAllister and wife, recorded in Vol. 1289, page 627 of the Deed Records of Tarrant County, Texas, lying North and West of the present right of way of State Highway 15, and East of the Arlington-Grapevine Road, said tract being described by metes and bounds as follows: N 2 1 BEGINNING at the Northwest corner of the E. Rodgers Survey in Tarrant County, Texas; THENCE, South with the Ifest line of said Rodgers Survey a distance of 306.1 feat to a point on the Northerly right of way line of State Highway 15 as conveyed by Deed recorded in Vol. 1226, Page 170, Deed Records of said County; THENCE, North 67 degrees 22 minutes East with said Northerly right of way line of State Highway 15, a distance of 81.5 feet to a point the beginning of a curve to the left whose radius is 2804.9 feet; THENCE, in a Northeasterly direction along said curve to the left in said right of wavy line a distance of 582.5 feet to a point on the North line of the said Rodgers Survey; THENCE, rest with the North line of said Rogers Survey a distance of 789.3 feet to the place of beginning and containing 2.237 acres of land, excepting 0.363 acres conveyed to Tarrant County and recorded in the Deed Records of Tarrant County in Vol. 1305, Page 616, and excepting that portion of the E. Rodgers Survey conveyed by W. A. Moores to the State of Texa-s by right of way deed dated October 7, 1938, and recorded in Vol. 1369, Page 609, Deed Records Tarrant County, Texas. It being the intention of this description to describe all of said E. Rodgers Survey acquired by W. A. Moores by said deed dated December 21, 1936, lying North and West of State Highway No. 15 as presently established by instruments appearing in the Deed Records of Tarrant County, "Texas, and lyi-ig East of the Arlington- Grapevine Road as -presently established ttzrough said Survey by instrument appearing in the Deed records of Tarrant County, Texas. 2. THAT the official district zoning map of the City of Euless, Texas, be and is hereby ordered to be amended and changed to conform with the provisions hereof. 3.
