HomeMy WebLinkAbout75 05-25-1957 ORDINANCE NO. 75 AN ORDINANCE AMENDING SUB - SECTION "C" OF SECTION 12 OF ORDINANCE NO. 33:, ZONING REGULATIONS OF THE CITY OF EULESS, TEXAS; PROVIDING THAT THE MINIMUM WIDTH OF LOTS SITUATED IN DISTRICT "A SINGLE FAMILY DWELLING DISTRICT, AS DEFINED IN SAID ORDINANCE, TO BE 65 FEET AT THE FRONT BUILDING LINE; FURTHER PROVIDING THAT ANY PERSON, FIRM OR CORPORATION VIOLATING ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR, AND UPON CONVICTION THEREOF SHALL BE FINED IN A SUM NOT MORE THAN $ 100,00, AND THAT EACH DAY SUCH VIOLATION CONTINUES SHALL CONSTITUTE A SEPARATE AND DISTINCT OFFENSE; FURTHER PROVIDING THAT SUCH VIOLATIONS OF PROVISIONS OF THIS ORD- INANCE BEING DECLARED HEREIN AS A MISDEMEANOR SHALL NOT PRECLUDE THE CITY OF EULESS, TEXAS, FROM INVOKING THE CIVIL REMEDIES GIVEN IT BY THE LAWS OF THE STATE OF TEXAS; BUT SHALL BE CUMULATIVE WITH AND SUBJECT TO PROSECUTION AS HEREINABOVE DESCRIBED FOR SUCH VIOLATION OR VIOLATIONS; FURTHER PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES OF THE CITY AFFECTING THE SUBJECT MATTER HEREIN; AND FURTHER PROVIDING THIS ORDINANCE SHALL BECOME EFFECTIVE AND BE IN FULL FORCE AND EFFECT FROM AND AFTER THE DATE OF ITS ADOPTION AND PUBLICATION AS BY LAW PROVIDED. WHEREAS, the Planning and Zoning Commission of the City of Euless, Texas, .has recommended to the City Council that the minimum width of lots situated in District "A" Single Family Dwelling District be increased from 55 feet to 65 feet at the front building line; and WHEREAS, publication of notice of final hearing on said recommendation to be held before the said City Council was had by publishing the same in the official newspaper of the City of Euless, Texas, to -wit: "Mid -#Cities News", a newspaper of general circulation in said City, on the 9th day of May, A. D,q 1957; That following such public hearing held in accordance with said notice, at which all owners of property in the City of Euless, Texas, were given ample and sufficient opportunity to be heard.$ the City Council deems it to the best interest of said City$, its inhabitants and property owners therein, that the recommendation of the Planning and Zoning Commission be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS., TEXAS: 1 -p THAT Sub--Section 11011 of Section 12 of Ordina.n -ce No. 33, be amended to read as follows: (C) WIDTH OF LOT: The minimum width of a lot shall be 65 feet at the front building line, provided that where a lot has less width than herein required, in separate ownership at the time of the passage of this ordinance, this regulation will not prohibit the erection of a Single Family Dwelling thereon. 2„ PENALTY:. Any person, firm or corporation violating any of the provisions of this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof,, shall be fined in a sum not more than One Hundred Dollars (100„00); each day such violation continues shall constitute a separate offense. But in case any building or structure is erected, constructed,. altered, repaired, converted or maintained, or any building, structure or land is used in violation of the general law or of the terms of this ordinance, the City of Euless, in addition to imposing the penalty above provided, may institute any appropriate action or proceedings in court to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, to restrain,, correct or abate such violation, to prevent the occupancy of such building, structure or land, or to prevent the illegal act, conduct, business or use, in or about such land; and the definition of any violation of the terms of this ordinance as a misdemeanors shall not preclude the City of Euless from invoking the civil remedies given it by law in such cases, but same shall be cumulative of and in addition to the penalties prescribed for such violation. 3. EFFECTIVE DATE: THIS ordinance shall take effect and be in force and effect from and after the date of its adoption and publication as provided by law, ADOPTED this day of May, A.
