HomeMy WebLinkAbout76 05-25-1957ORDINANCE NO. 76 AN ORDINANCE AMENDING SECTION 25 OF ORDINANCE NO. 61 TRAFFIC CODE OF THE CITY OF EULESS, TEXAS, AS AMENDED BY ORDINANCE NO. 74; REGULATING THE SPEED OF MOTOR VEHICLES ON U. S. HIGHWAY NO. 183, AS DESIGNATED BY SIGNS CONSTRUCTED ON SAID HIGHWAY, AND THIRTY (30) MILES PER HOUR ON OTHER PUBLIC STREETS, ALLEYS AND THOROUGHFARES SITUATED WITHIN THE RESIDENTIAL, COMMERCIAL AND BUSINESS DISTRICTS IN SAID CITY; AND TWENTY (20) MILES PER HOUR IN DESIGNATED SCHOOL ZONES, DURING SCHOOL SEASON BETWEEN THE HOURS OF 7:30 O'CLOCK A. M. AND 4 :00 OrCLOCK P. M., SAVE AND EXCEPT SCHOOL CROSSING ZONE ON STATE HIGHWAY NO. 183 WHERE A SPEED LIMIT OF THIRTY-FIVE (35) MILES PER HOUR WILL BE APPLICABLE WHEN PORTABLE SIGNS INDICATING SAME ARE IN PLACE; PROVIDING THAT IT SHALL BE UNLAWFUL FOR ANY PERSON OR PERSONS TO RUN, DRIVE., DIRECT OR PERMIT THE RUNNING OR DRIVING OF ANY MOTOR VEHICLE AT A GREATER RATE OF SPEED AS IS PROVIDED IN THIS ORDINANCE; PROVIDING THAT ANY PERSON OR PERSONS VIOLATING THE PRO- VISIONS OF SUCH ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR, AND SHALL BE SUBJECT TO A FINE IN ANY SUM NOT EXCEEDING TWO HUNDRED ($200.00) DOLLARS; PROVIDING A SAVINGS CLAUSE, AND TIIAT SAID ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER THE DATE OF ITS ADOPTION AND PUBLICATION AS BY LAW PROVIDED ON ALL STREETS AND HIGHWAYS EXCEPT STATE HIGHWAY NO. 1832 AND ON THE LATTER,, FOLLOWING PUBLICATION AND THE DAY FOLLOWING THE ERECTION OF SIGNS REGULATING SPEED LIMIT ON SAID HIGHWAY AS HEREIN PROVIDED. WHEREAS, in the interest of the health, safety and general welfare of the City of Euless, Texas, its inhabitants and the general public traversing Texas State Highway No. 1839 through said City, the City Council of said Municipality having heretofore requested the Tarrant County District Engineer, of the Texas Mate Highway Department, to make such study and engineering investigation, as such department may deem necessary, for the purpose of regulating the speed of motor vehicles traveling on said1ighway within the limits of the City of Euless, Texas; and WHEREAS, under date of March 49 1957, the said District Engineer in writing with plats attached, reported to the City Council,, the findings of such department made pursuant to such study and engineer- ing investigation, with recommendations as to limiting the speed of motor vehicles on said State Highway No. 183 within the City, based upon standard engineering practices; and WHEREAS,. upon consideration of such recommendation the City Council of Euless;, Texas, finds that it would be to the best interest of the health, safety and general welfare of the City and its inhabitants and of the traveling public traversing said public highway through its boundaries, to approve and 'adopt such recommendations aforementioned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: 14 THAT, the recommendations as setout in the District Engineers report aforementioned be approved and adopted and that Section 25 of Ordinance No„ 61, as amended by Ordinance No, 74, be and is hereby amended to read as follows: SECTION 25 SPEED LIMIT (A) From and after the effective date of this ordinance it shall be unlawful for any person or persons to run, drive, direct or permit the running, driving and directing any motor vehicle, as such term.is defined in Ordinance No. 61, adopted on 26th day of January, 1957, in or upon Texas State Highway No, 183 within the limits of the City of Euless, Texas, at a greater speed than that which is hereinafter provided, to"wit: EAST BOUND TRAFFIC (Awl) From the West City Limits of Euless, Texas, a distance of 3*51 miles, 60 miles per hour in day time and 55 miles per hour nighttime; The next 0421 miles 50 miles per .hour; The next 0.21 miles S5 miles per hour; The next 0074 miles 60 miles per hour daytime, 55 miles per hour nighttime to the Eastern City Limit Line of said City. WEST BOUND TRAFFIC (A«-,2) From the Eastern City Limit Line, a distance 0.74 miles, 60 miles per hour daytime, S5 miles per hour nighttime; The next 0.21 miles, 55 miles per hour; The next 0,21 miles, 50 miles per hour; The next 3.51 miles, 60 miles per hour daytime, 55 miles per hour nighttime„ X24, EAST AND WEST BOUND TRAFFIC SCHOOL CROSSING ZONE (AH3) Between Station 861 +43 and Station 867 +00,, when Portable School Crossing Signs designating said area are in place, 35 miles per hour, FRONTAGE ROADS ADJACENT TO AND ADJOINING STATE HIGHWAY NO. 183: (Ati4) SOUTH FRONTAGE ROAD - From Station 54+68 running in an easterly direction 0.18 miles to Station 64+15,, 30 miles per hour. (AA5) NORTH F from station 64+15 30 miles per hour, In accordance District Engineer, Texas. RONTAGE ROAD p Running in a westerly direction to station 55 +55 a distance of 0.16 miles, with recommendation of State Highway Department, as shown on plat in .files of the City of Euless, (A-6) There shall be constructed on each side of said-highway, and frontage roads within the limits of the City of Euless, Texas, substantial signs., warning the traveling public of the speed limit within the areas of said highway as above provided, 1PSPEED ZONE AHEAD" signs on State Highway No. 183., outside of the City Limits on the East and West thereof respectively; . (B) Other than the streets and highways descfibed in subsection AF19 -A. -2, .A.N3, AH4, A -5 and A -6, as above provided, it shall be un- lawful for any person or persons to run, drive, direct or permit the running or driving of any motor vehicle, in, upon, along or across any public highway, street., alley or thoroughfare in the commercial, business or residential districts, as .herein defined, within the corporate limits of the City of Euless, Texas, at a greater rate of speed than thirty (30) miles per hour; (C) It shall also be unlawful for any person or persons to run, drive or permit the running or driving of any vehicle in, upon or along any of the roads or streets of the City designated as "SCHOOL SAFETY ZONES" as marked by signs directed on said roads and streets, save and except at School Crossing Zone of State Highway No. 183, during the school season and during the hours of 7 :30 o'clock A. M. and 4:00 o'clock P. M. at a greater rate of speed than 20 miles per hour„ (D) The above subsections shall not apply to emergency vehicles as is herein defined when responding to an emergency call. (E) Nothing in this provision shall be construed as prohibiting the driver of a motor vehicle from observing the instructions of H3" any Police Officer directing traffic, or any sign, signal or device directing the movement of traffic. (F) The driver of any vehicle passing a school Building or the grounds thereof during the school recess or while children are going to or leaving school during the opening or closing hours, shall bring his said vehicle to a full and complete stop where signs have been erected indicating the proximity of a school or school grounds or at cross walks duly marked, and the Chief of Police is hereby authorized to direct and maintain such signs in conformity with this section. 2, ORDINANCES RELATING TO VEI41CLE_S FOR HIRE NOTHING in this ordinance shall affect or repeal in any way any ordinance now or hereafter enacted, relating to the operation of jitneys, motor buses, taxicabs or other vehicles using the streets of the City of Euless for hire and ordinances relating to such are hereby intended and declared to remain in full force and effect. 3p EFFECT OF ORDINANCE IF any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional.F such decisions shall not affect the validity of the remaining portions of this ordinance. The City Council .hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, even if it had Known that any one or more sections, sub - sections, sentences, clauses or phrases would be declared uncon- stitutional, 44 PENALTY ANY person who shall violate any of the provisions of this ordinance or any rule or regulation made by the Chief of Police pursuant thereto shall be guilty of a misdemeanor and upon con" victi.on thereof, shall be fined in any amount not exceeding the sum of Two Hundred Dollars ($200,00). R44" 5. THIS ordinance shall become effective, and be in full force and effect from and after the date of its adoption and publication as by law provided, excepting that tine provisions of Section One, AH1, A -2, AH4 and AH5, hereof shall not be effective until approR priate warning signs as herein provided are erected, and in such event the provisions of such sections hereof shall be in full force and effect following publication hereof and on the day following the completion of the construction of such signs.
