AN ORDINANCE DEFINING VAGRANTS AND VAGRANCY, PRESCRIBING
THE PENALTY THEREFOR AND PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED THAT THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
SECTION I
THAT the following persons are and shall be punished as vagrants,
to-wit:
a, Persons known as tramps, wandering or strolling about in idle-
ness, who are able to work and have no property to support them,
b. Persons leading an idle, immoral or profligate life who have
no property to support them, and who are able to work and do not work.
Vic. All persons able to work and who have no property to support
them and who have no visible or known means of a fair, honest and reputable
livelihood. The term "visible, or known means of a fair, honest and reput-
able livelihood" as used in this section shall be construed to mean reason-
ably continuous employment at some lawful occupation of reasonable compen-
sation, or a fixed and regular income from property or other investments,
Wlich income is sufficient for the support and maintenance of such person,
d. All able- bodied persons who habitually loaf, loiter and idle
in any railroad station or in any other public place in this city for the
larger portion of their time, without any regular employment, and without
any visible means of support; an offense under paragraph "D" of this section
shall be made out vAienever it is shown that any person has no visible means
of support and only occasionally has employment at odd jobs, being for the
most part of the time out of employment,
e. Persons trading or bartering stolen property, or who unlawfully
sell vinous, alcoholic, malt, intoxicating or spiritous liquors.
f. Every common gambler or person who for the most part maintains
himself by gambling,
g. All companies of Gypsies, who in whole or in part, maintain
themselves by telling fortunes.
h. Every able - bodied person who shall go begging for a livelihood,
i, Every common prostitute.
j, Every keeper of a house of prostitution.
k. Every keeper of a house of gambling or gaming,
1, Every person who shall abandon his wife or child, or children,
without just cause, leaving such wife, or child, or children without sup-
port, or in danger of becoming a public charge,
':- m, Every able-bodied person who lives without employment or labor,
and who has no visible means of support.
n. All persons who are able to work and do not work, but hire out
their minor children or do allow them to hire out and live upon their wages,
being without other means of support,
o. All persons over sixteen years of age and under twenty -one able
to work and who do not work and have no property to support them, and do
not have some known, visible means of a fair, honest and reputable liveii-
hood, a_--d whose parents or those in loco parentis are unable to support
them, and who are not in attendance on some educational institution.
pa All persons who advertise and maintain themselves in whole or
in part as clairvoyants or fortune tellers of future events, or as having
supernatural knowledge -iAi th. respect to present or future conditions, trans-
actions, happenings or events.
q. Any person who unlawfully solicits orders for intoxicating
liquors,
r. All male persons who habitually associate with prostitutes or
habitually loiter in or around houses of prostitution, or who, without
having means of support, receive financial aid or assistance from prosti-
tutes.
s. All persons who invite, entice, or solicit any male person, or
direct, take or transport, or offer or agree to tame or. transport, or aid
or assist in transporting, any male person to visit any bawdy house or dis-
orderly house or other place, for the purpose of unlavful sexual intercourse,
knowing the purpose of such person in going to such house; or who meet any
female at such bawdy house or disorderly house for the purpose of unlawful
sexual intercourse,
to All persons who engage in prostitution, lewdness, or assigna-
tion,
u. All prostitutes who solicit, induce, entice, or procure any
male person to visit any bawdy mouse or disorderly house or other place
with her for the purpose of unlawful sexual intercourse,
SECTION II
THAT this ordinance shall repeal every prior ordinance in conflict
herewith, but only insofar as the portions of such prior ordinances shall
be in conflict, and as to all other sections of ordinances not in direct
conflict herewith, this ordinance shall be and is hereby made cumulative.
SECTION III
�/ Any person violating this ordinance or any provision thereof shall,
upon conviction thereof in the Corporation Court, be fined in any sum not
to exceed Two Hundred ($200.00) Dollars.
SECTION IV
If any Section, part of a Section or provision of any Section of this
Oridinance shall be held to be void, ineffective or unconstitutional, the
holding of such Section or provision of any Section to be void, ineffective
or unconstitutional for any cause whatsoever shall in no way affect the
validity of the remaining Sections and provisions of this Ordinance, which
shall remain in full force and effect.
SECTION V
This ordinance shall be effective and in full force and effect upon
its adoption and publication.
PASSED AND ADOPTED this 7th day of September, 1957, at a regular
meeting of the City Council of the City of Euless, Texas.
