AN ORDINANCE AMENDING SUBSECTION 8 (c) of PARAGRAPH B OF SECTION
V OF ORDINANCE 79, AND PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:

That Subsection 8 (c) of Panagraph B of Section V of Ordinance No.
79 be and is hereby amended to read as follows:
Until the developer acid /or owner and /or contractor or contrac-
tors performing or to performing such improvements for the
developer and /or owner, files a corporate bond with the City
Secretary in favor of the City in the amount equal to the
cost of such improvements for the designated area guaranteeing
the installation thereof within the time stated in the bond,
and for maintenance of such improvements for two years after
the acceptance thereof by the City, except that a water system
as hereinabove provided shall be operated perpetually. In
the event two or more contractors performing or to perform
such improvements for the developer and /or owner, then each
such contractors shall file wish the City Secretary the above
specified bonds in the amount of the cost of the improvements
to be performed by each, provided however, that no building
permits, nor any water, sewer, plumbing or electrical permits
shall be issued until all such contractors performing or to
perform such improvements for the developer and /or owner have
filed such bonds in accordance herewith. Such bonds so filed
under this provision shall be furnished by a Surety Corporation
authorized to do business in Texas, pursuant to Chapter Seven
(7), Insurance Code of Texas, 1951 Revision, and must be approved
by the City Secretary and City Attorney.

THIS ordinance shall be effective and in full force and effect upon
adoption and publication.
