HomeMy WebLinkAbout97 05-13-1958ORDINANCE NO. 97 AN ORDINANCE AMENDING THE LAST PARAGRAPH OF SECTION 3 OF ORDINANCE NO. 50, AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: THAT, ,the last paragraph of Section 3 of Ordinance No. 50 be and is hereby amended to read as follows: 1. The City Secretary, Building Inspector or any other Officer designated by the City Council to issue Building Permits, shall not issue a building permit for the construction of buildings, residential or otherwise on any lot, tract or parcel of land fronting or abutting such dedicated streets, unless and until the dedicator of such streets, his, their or its successors and assigns and /or the contractor performing or to perform the street improvement for the dedicator, has filed with the City Secretary a corporate bond in favor of the City in the amount of the estimated costs of such street improvements, guaranteeing to the City that such street im- provements will be constructed in accordance with the provi- sions of this ordinance as hereinabove provided, and that such streets will be maintained by such dedicator and /or the contractor performing or to perform the street improvement, for a period of two (2) years from the date of the acceptance of sand street improvements by the City. In the event two or mote contractors are performing or to perform street improve- ments for the dedicator, then each such contractors shall file with the City Secretary the above specified bonds in the amounts of the estimated street improvements to be performed by each, provided however, that no building permits shall be issued until all such contractors performing or to perform street improvements for the dedicator have filed such bonds in accordance herewith. Such bonds so filed under this provision shall be furnished by a Surety Corporation authorized to do business in Texas, pursuant to Chapter Seven (7), Insurance Code of Texas, 1951 Revision, and must be approved by the City Secretary and City Attorney before any building permit can be issued. 2. THIS ordinance shall be effective and in full force and effect upon adoption and publication. ADOPTED this 'i,4, day of May, 1958. ATTEST: ! Mayor 'Cify S c,etary
