HomeMy WebLinkAbout593 09-25-1979ORDINANCE NO. 593 AN ORDINANCE PROVIDING FOR UPDATED SERVICE CREDIT UNDER THE TEXAS MUNICIPAL RETIREMENT SYSTEM FOR SERVICE PERFORMED BY QUALIFING EMPLOYEES OF THE CITY OF EULESS, TEXAS, WHO ARE PROVIDED RETIREMENT BENEFITS UNDER SUCH SYSTEM; ELECTING AND PRESCRIBING THE EFFEC- TIVE DATE OF SUCH SERVICE CREDITS; AUTHORIZING AND PROVIDING FOR ALLOWANCE OF INCREASES IN MONTHLY BENEFITS PAYABLE BY THE TEXAS MUNI- CIPAL RETIREMENT SYSTEM TO RETIRED EMPLOYEES AND BENEFICIARIES OF DECEASED EMPLOYEES AS CURRENT SERVICE ANNUITIES AND PRIOR SERVICE ANNUITIES ARISING FROM SERVICE OF SUCH EMPLOYEES TO THE CITY OF EULESS, TEXAS; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, retirement benefits for employees of the City of Euless, Texas, are provided, under the Texas Municipal Retirement System; and WHEREAS, recent amendments to the enabling legislation estab- lishing and providing for such retirement system, authorized parti- cipating municipalities to provide updated service credit for qualified employees of such City under such retirement system; and WHEREAS, it is the desire of the City of Euless, Texas, to pro- vide such updated service credit for its participating employees and to increase, under an updated service credit, the current ser- vice annuities and prior service annuities arising from service to the City of Euless in monthly benefits payable by such System to presently retired employees and beneficiaries of deceased former employees. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. Section 1. Revised Allowance of Updated Service Credits. On the terms and conditions set out in Section XVII of Article 6243h, Vernon's Texas Civil Statutes, as amended, each member of Texas Municipal Retirement System who on the 1st day of January, 1980, has creditable service in said System arising out of employment with the City of Euless, Texas, prior to the first day of the year preceding the date last above - mentioned shall be and is hereby granted an "Updated Service Credit" (as that term is defined in said Act) that is 100% of the "Base Updated Service Credit" of the member, calculated as provided in said Act. The Updated Service Credits herein granted shall be effective from and after January 1, 1980, and shall be in lieu of and in substitution for all prior service credits and /or updated service credits previously allowed such member. II. Section 2. Revised Increases in Annuities in Effect. Pur- suant to Section XVIII of Article 6243h, Vernon's Texas Civil Statutes, as amended, the City of Euless, Texas, hereby elects to allow and to provide for payment of the increases below specified in all monthly benefits payable by Texas Municipal Retirement System after the lst day of January, 1980, to retired employees and to beneficiaries of deceased employees of this City under current service annuities and prior service annuities arising from service of such employees to this City, and in effect prior to the date last above - mentioned. Each such monthly benefit for the month of January, 1980, and each month thereafter shall be increased by twenty per cent (20 %) above the amount of the regular benefit (as distinguished from any supplemental or distributive benefit) in effect for the month of December, 1979. III. Section 3. Approval of Board of Trustees of Texas Municipal Retirement System. The granting of "Updated Service Credits" as provided in Section 1 above and the granting of increases in annuities in effect, as provided in Section 2, above, shall be conditioned upon and subject to approval by the Board of Trustees of Texas Municipal Retirement System as provided in the Act govern- ing said System. IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sen- tences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not effect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such inconstitutional phrase, clause, sentence, paragraph or section. .50-M V. Effective Date. This Ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 11th day of September, 1979; by a vote of 5 ayes, 0 nays and 0 abstentions: GIVEN SECOND READING, PASSED AND APPROVED at a regular meeting of the Euless City Council on the 25th day of September, 1979; by a vote of 3 ayes, 0 nays and 0 abstentions.
