AN ORDINANCE AMENDING PORTIONS OF THE EULESS
ZONING CODE (ORDINANCE NO. 347) AND THE EULESS
BUILDING CODE (ORDINANCE NO. 252 AND 504 et sic)
TO ASSURE INCLUSION OF CERTAIN WINDOW AND INTERIOR
SIGNS WITH THE PROVISIONS OF SUCH ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; A PENALTY FOR
VIOLATION THEREOF; AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
I.
Section 4 -52 of the Euless Building Code (Ordinance No. 252, 504,
et sic) is herewith and hereby repealed.
II.
Sub - Section (3) of Sub - Section 9 -300 of Section 9 of the Euless
Zoning Code (Ordinance No. 347, as amended) is herewith amended to hereafter
be and read as follows:
(3) No regulation or standard contained in this Section shall
apply to signs painted on or erected inside a window unless
such signs are included within the definitions of Sub - Section
(66) and (68) of Section 11 of this ordinance.
III.
Severability Clause. That it is hereby declared to be the intention
of The City Council that the sections, paragraphs, sentences, clauses, and
phrases of this Ordinance are severable, and if any phrase, clause, sentence,
paragraph, or section of this Ordinance shall be declared unconstitutional
by the valid judgment or decree of any court of competent jurisdiction, such
unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs, and sections of this ordinance, since the same would
have been enacted by The City Council without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence, paragraph,
or section.
IV.
Penalty for Violation. That a person violating a provision of this
Ordinance, upon conviction, is punishable by a fine of not more than
$200.00.
V.
Effective Date. This ordinance shall become effective immediately
from and after its passage and publication as provided by the Euless City
Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING on the 25th day of September, 1979,
at a regular meeting of the City Council of the City of Euless, Texas, by a
vote of 3 ayes, 0 nays, and 0 abstentions: GIVEN SECOND READING,
PASSED AND APPROVED on the 9th day of October, 1979, at a regular
meeting of the City Council of the City of Euless, Texas, by a vote of ,L
