HomeMy WebLinkAbout604 12-11-1979ORDINANCE NO. 604 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 167 AND 169 OF ARTICLE XIX, R.C.S. 6701d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF EULESS AS SET OUT IN THE ORDINANCE; AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR VIOLATION OF THIS ORDINANCE. WHEREAS, Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investigation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street of highway, with the City taking into consideration the width and condition of the pavement and other circumstances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a ° reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION I. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 167 and 169 of Article XIX, R.C.S. 6701d, Uniform Act Regulating Traffic on Highways, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: Control: 364 -5 - State Highway 183 (Main Lanes) - Tarrant County I. EASTBOUND MAIN LANE ONLY a) From Station 333 +64.5 (west city limits of Euless, being also the east city limits of Bedfore) easterly 1.811 miles to Station 905 +45.0 (east city limits of Euless, being also the city limits of Fort Worth) at 55 miles per hour maximum, 45 miles per hour minimum. II. WESTBOUND MAIN LANE ONLY a) From Station 905 +45.0 (east city limits of Euless, being also the city limits of Fort Worth) westerly 1.811 miles to Station 333 +63.5 (west city limits of Euless, being also the city limits of Bedford) at 55 miles per hour maximum, 45 miles per hour minimum. SECTION II. Any person violating any of the provisions of this ordinance shall be deemed builty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred dollars ($200.00). SECTION III. By affirmative vote of fo declares that this is an ordinance public peace, property, health and the meaning of Article II, Section that it be read at two meetins, as dispensed with. ar or more of its members, the City Council for the immediate preservation of the safety, and is an emergency measure within 11, of the City Charter, and the requirement specified in such Section 11, is hereby SECTION IV That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitu- tional phrase, clause, sentence, paragraph, or section. SECTION V. This ordinance shall become effective upon and after final passage and publication as provided by the Euless City Charter and the laws of the State of Texas, and the posting of appropriate signs giving notice thereof, upon such streets and highways. PRESENTED AND PASSED ON FIRST AND FINAL READING on the 11th day of December, 1979, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 4/ ayes and C nays.
