AN ORDINANCE AMENDING ORDINANCE NO. 347,
SAME BEING THE ZONING CODE OF THE CITY
OF EULESS, TEXAS, WITH RESPECT TO SIGN
REQUIREMENTS, PROVIDING DEFINITIONS, A
SEVERABILITY CLAUSE, A PENALTY FOR
VIOLATION, AND AN EFFECTIVE DATE:
WHEREAS, it is the desire of the Euless City Council, following public
hearings, to amend certain sign requirements under the Euless Zoning Code
for the purpose of increasing allowable size, height and separation of
signs placed on real properties, on Federal -Aid Primary Highways and in
shopping centers being properly zoned within the City.
I.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,
TEXAS, THAT THE HEREINAFTER CITED SECTIONS OF EULESS ORDINANCE NO. 347, SAME
BEING THE EULESS ZONING CODE ARE HEREWITH AND HEREINAFTER AMENDED TO READ AS
FOLLOWS:
Subsection 9 -200 of Section 9 of Ordinance No. 347, same being the
zoning code of the City of Euless, Texas, is herewith amended to hereafter
be and read as follows: (See attached chart)
Subsection 9 -301 of Section 9 - Add paragraph (5) to read as follows:
(5) All General Business signs in C -1, C -2, L -1, I -1 and I -2 zoning
districts located adjacent to a Federal -Aid Primary Highway or
separated therefrom only by a service road may be constructed
to have a maximum area as follows:
(a) Signs on tracts of land having freeway frontage of between
0 and 99 feet shall have a maximum area of up to 100 square
feet for signs erected to a height of 20 feet. This maximum
area shall be reduced 2.5 square feet in area for each one
(1) foot of height which the sign is constructed over 20 feet.
Table (5al) shall be used to establish the maximum area for
signs on tracts of land having freeway frontage of between
0 and 99 feet.
(b) Signs on tracts of land having freeway frontage of between
100 and 199 feet shall have a maximum area of up to 200 square
feet for signs erected to a height of 20 feet. This maximum
area shall be reduced 5 square feet in area for each one (1)
foot of height which the sign is constructed over 20 feet.
Table (5bl) shall be used to establish the maximum area for
signs on tracts of land having freeway frontage of between
100 and 199 feet.
(c) Signs on tracts of land having freeway frontage of 200 feet or
more shall have a maximum area of up to 250 square feet for signs
erected to a height of 20 feet. This maximum area shall be
reduced 6.25 square feet in area for each one (1) foot of height
which the sign is constructed over 20 feet. Table (5cl) shall be
used to establish the maximum area for signs on tracts of land
having freeway frontage of 200 feet or more.
(d) Freeway frontage shall be determined by the Building Official
in compliance with the definition for same in this ordinance,
and with the help of a site plan which shall clearly indicate
said frontage which shall be submitted with application for
sign permit.

(d) Freeway frontage shall be determined by the Building Official
in compliance with the definition for same in this ordinance,
and with the help of a site plan which shall clearly indicate
said frontage which shall be submitted with application for
sign permit.
Subsection 9 -301 of Section 9 --Add paragraph (6) to read as follows:
(6) All General Business signs in C -1, C -2, L -1, I -1 and I -2 zoning
districts located adjacent to a Federal -Aid Primary Highway or
separated therefrom only by a service road may be constructed
to a maximum height of 40 feet above either grade of ground level
at the site or the grade of the limited access freeway, the latter
to be determined by the Building Official. The grade of ground
elevation at the site shall be established at the highest Point of
ground elevation within 300 feet radius of the proposed sign.
Subsection 9 -301 of Section 9 - Add paragraph (7) to read as follows:
(7) All General Business signs in shopping centers zoned for this
purpose shall be limited to one directory sign thirty (30) feet
maximum height except where such sign is constructed on freeway
frontage in which case Section 9 -301 (6) shall apply. The maximum
allowable sign area of each directory sign shall be calculated by
allowing an area of 30 square feet per tenant not to exceed 600
square feet total. Said total sign area may be divided among any
number of tenants in any fashion.
Subsection 9 -301 of Section 9- Add paragraph (8) to read as follows:
(8) In addition to development signs permitted on -site, the following
development signs may be permitted off -site:
(a) One additional pole or ground sign having a maximum area of
200 square feet and a maximum height of 15 feet will be
permitted per project to be located on any property remote
to the project site.
OR
(b) Up to four off -site pole or ground signs having a combined
maximum area of 200 square feet and an individual maximum
height of 15 feet will be permitted per project.
Subsection 9 -300 of Section 9 - Add paragraph (10) to read as follows:
(10) Allpole and ground signs shall not be constructed within 100 f(-('t of
another such sign.
Subsection 9 -300 of Section 9 - Add paragraph (11) to read as followr;:
(11) All applications for building permits for the construction of signs
shall be accompanied with design drawings of the sign, a site plan
indicating street frontage and access to the site, and engineering
information prepared by a registered architect or engineer as may
be required by the Building Official.
Subsection 9 -300 of Section 9 - Add paragraph (12) to read as follows:
(12) Special Height and /or Area Signs: In order that the City may
develop in accordance with the intent and purpose of this ordinance
and in order that substantial justice may be done, signs may be
erected which exceed the height and area limitations contained in
Section 9 after approval of the same as a special use permit in
compliance with the terms and provisions of Section 7 -1000 hereof,
having due regard for the topography of the premises and the
elevation of adjacent roadways. Any request for such variance
must be fully documented as to need by the petitioner.
Subsection 7 -1002 of Section 7 - Add paragraph (54) to read as follows:
(54) Special Height and /or Area Signs All Districts
Subsections (70) & (71) of Section 11 - Add paragraphs to read as follows:
(70) FEDERAL -AID PRIMARY HIGHWAY
Means any highway system as established and maintained as a primary
highway; including extensions of such systems within municipalities,
which has been approved pursuant to Subsection B of Section 102 of
Title 23, United States Code.
(71) FREEWAY FRONTAGE
A tract of land having a frontage adjacent to a Federal -Aid Primary
Highway or separated therefrom only by a service road.
II.
Severability Clause. That it is hereby declared to be the intention of
the City Council that the sections, paragraphs, sentences, clauses and phrases
of this ordinance are severable, and if any phrase, clause, sentence, paragraph,
or section of this ordinance shall be declared unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
III.
Penalty for Violation. Any person, firm or corporation violating any of
the terms and provisions of this ordinance shall be deemed guilty of a misde-
meanor and upon conviction thereof, shall be fined in an amount not to exceed
$200.00. Each such violation shall be deemed a separate offense and shall be
punishable as such hereunder.
IV.
Effective Date. This ordinance shall be in full force and effect from and
after its passage and publication as provided by the Euless City Charter and the
laws of the State of Texas.

at a regular meeting of the City Council of the City of Euless, Texas,
SECOND READING, PASSED AND APPROVED on the 8th day of July
by a vote of 5 ayes and 0 nays and 0 abstentions.
