HomeMy WebLinkAbout639 08-26-1980ORDINANCE NO. 639 AN ORDINANCE AMENDING ORDINANCE NO. 411, WHICH ORDINANCE AMENDED ORDINANCE NO. 347, THE ZONING CODE OF THE CITY OF EULESS, TEXAS, AND APPROVING A REVISED PLAN OF DEVELOPMENT FOR 35.24 ACRES OF THE 61.93 ACRE TRACT ZONED "PD" PLANNED DEVELOPMENT DISTRICT PURSUANT TO THE TERMS OF SUCH ORDINANCE NO. 411; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: I. It is hereby ordered that the development plan submitted by Applicant and dated August 6, 1980, which development plan is on file in the City of Euless zoning records and attached to zoning case number 318, shall be and the same is hereby substituted for that development plan previously adopted by Ordinance No. 411. Such new development plan dated August 6, 1980, is incorporated in this ordinance by reference and made a part thereof for all purposes as is now set forth in full. Such new development plan dated August 6, 1980, shall be applicable only as to the 35.24 acres depicted thereon in the J. E. FIELD Survey, Abstract 540, to the City of Euless, Tarrant County, Texas. II. That the applicable uses of City of Euless Zoning Ordinance following conditions: BUILDINGS SITE land pursuant to Section 7 -1100 No. 347 being subject to the 1. Maximum height is thirty -five (35) feet. 2. Minimum floor area is: twenty -five (25) percent 950 square feet, twenty -five (25) percent 1,050 square feet and fifty (50) percent 1,100 square feet. 3. Minimum double unit size is 2,100 square feet. 4. Maximum building area is 1,800 square feet. 5. Eighty(80) percent masonry is required. 1. Maximum density is 6.41 units per acre. 2. Site coverage (o of total tract covered with buildings exclusive of private drives and public streets) is fifty (50) percent. 3. Building spacing is a minimum of twenty (20) feet. 4. Minimum building setbacks are (1) twenty -five (25) foot front yard, (2) fifteen (15) foot rear yard, and (3) ten (10) foot side yard. 5. Minimum lot width if forty (40) feet. 6. Minimum lot depth is ninety -eight (98) feet. 7. Minimum lot area is 3,920 square feet. 8. Minimum open space is 1,960 square feet. TRAFFIC 1. Public street right -of -ways will be fifty (50) feet with thirty -one (31) foot paving sections (b.b.). 2. Sidewalks will be required along both sides of public streets. 3. Minimum off- street parking will conform to Section 8 of Euless Zoning Ordinance. 1. Additional utility easements may be required with final platting. III. Penalty for Violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed two hundred dollars ($200.00). Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sen- tences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. - 2 - V. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 12th day of August, 1980, by a vote of 5 ayes, 0 nays, and 0 abstentions; GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 26th day of August, 1980, by a vote of 5 ayes, 0 nays, and 0 abstentions.
