AN ORDINANCE AMENDING ORDINANCE NO. 347 IDENTIFIED AS
THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; PRO-
VIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY
BUSINESS DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT
WITH A "SP" SPECIFIC USE PERMIT FOR A COMMERCIAL AMUSE-
MENT CENTER; PROVIDING FOR DEVELOPMENT OF THIS TRACT
OF LAND TO BE DEVELOPED ACCORDING TO APPROVED PLANS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY
AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS,
THAT:
IT IS HEREBY ORDERED that the Official District Zoning Map of the City of
Euless, Texas, being a part of Ordinance No. 347, be amended to read as follows:
THAT the zoning classification of the following described
property, now zoned "C -2" Community Business District be
changed to "C -2" Community Business District with a Specific
Use Permit for a Commercial Amusement Center on property
described as follows:
The following described tract or parcel of land being a portion
of Tract A, Wilshire Village Shopping Center, to the City of Euless,
Tarrant County, Texas, according to plat recorded on Page 7 of
Volume 388 -95 in the Tarrant County Deed Records and being more
particularly described as follows:
Beginning S 660 42' W a distance of 129.2 feet, N 230 18'W a
distance of 210.0 feet, and N 660 42' E a distance of 30.0 feet
from the Southeast corner of said Tract A and the North line
of State Highway No. 10;
THENCE N 230 18' W a distance of 183.19 feet;
THENCE N 00 34' W a distance of 87.59 feet;
THENCE N 890 26' E a distance of 10.0 feet;
THENCE N 00 34' W a distance of 115.0 feet;
THENCE N 890 26' E a distance of 20.0 feet;
THENCE S 00 34' E a distance of 171.8 feet;
THENCE S 890 26' W a distance of 4.9 feet;
THENCE S 230 18' ,E a distance of 201.9 feet;
THENCE S 660 42' W a distance of 35.0 feet to place of
beginning, containing 11,139 square feet of land, more or less
as specifically set forth in the development plan as submitted by Applicant
dated July 8, 1980, which development plan is on file in the City of Euless
Zoning Records and file attached to Zoning Case No. 319.
THAT the applicable use of land pursuant to the Specific Use Permit for
a commercial amusement center, as permitted by Section 7 -1002, City of Euless
Zoning Ordinance No. 347, being subject to the following restrictions affect-
ing the Specific Use Permit granted at the premises:
1. No gambling permitted.
2. No consumption or possession of alcoholic beverages or drugs permitted.
3. No abusive or foul language permitted.
4. Shirts, blouses, or upper torso clothing covering is required.
4. No standing, congregating, or loitering of more than three
persons on the exterior of the premises in excess of thirty
consecutive minutes.
To facilitate the owners /operators enforcement of such restrictions,
the holder of the Specific Use Permit has agreed to post, in a
prominent location on the premises, signs as follows:
INSIDE: "No Gambling Permitted"
INSIDE: "No Possession or Consumption of Alcoholic Beverages
or Drugs Permitted"
INSIDE: "No Abusive or Foul Language Permitted"
OUTSIDE: "No Standing, Congregating, or Loitering Permitted"
Severability Clause. That it is hereby declared to be the intention of
the City Council that the sections, paragraphs, sentences, clauses, and phrases
of this ordinance are severable, and if any phrase, clause, sentence, para-
graph, or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such uncon-
stitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs, and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph, or section.
IV.
Penalty for Violation. Any person violating the provisions of this
Ordinance, or the amendments to the Euless City Charter of 1961 hereby made,
shall be deemed guilty of a misdemeanor and shall be liable to a fine
of not more than Two Hundred Dollars ($200.00), and each day such violation
shall be permitted to exist shall constitute a separate offense, as provided
by Ordinance No. 347 and subsequent amentments of the Euless City Charter
- 2 -
and Statutes of the State of Texas.
V.
EFFECTIVE DATE. This Ordinance shall be in full force and effect from
and after its passage as provided by the Euless City Charter and the laws of
the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of Euless City
Council on the 9th day of September, 1980; GIVEN SECOND READING, PASSED AND
APPROVED at a regular meeting of the Euless City Council on the 23rd day of
September, 1980, by a vote of 5 ayes, 0 nays, and 0 absentions.
