HomeMy WebLinkAbout651 02-10-1981ORDINANCE NO. 651 AN ORDINANCE AMENDING ORDINANCE NO. 347 IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "R -2" TWO- FAMILY DWELLING DISTRICT AND "R -4" MULTI - FAMILY DWELLING DISTRICT WITH "CUD" FOR CONFORMING HOUSING; PROVIDING FOR DEVELOPMENT ACCORDING TO APPROVED PLANS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as follows: BEING four tracts of land out of TRACTS 15 and 16 of the RAY SHELTON SUBDIVISION, an addition to the City of Euless, Tarrant County, Texas, as recorded in Volume 1792, Page 93, of the Plat Records of Tarrant County, Texas, and being more particularly described as follows: TRACT A That the zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District be changed to "R -2" Two- Family Dwelling District with "CUD" for Conforming Housing on property described as follows: BEGINNING at the n THENCE S 89 045'35" THENCE S 00 014'25" THENCE N 89 045'35" THENCE N 00 014'20" and containing orthwest corner E, 827.00 feet W, 210.00 feet W, 827.00 feet E, 210.00 feet 3.99 acres of TRACT B of said Tract 16; to a point for corner; to a point for corner; to a point for corner; to the PLACE OF BEGINNING land. TRACT C That the zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District be changed to "R -2" Two- Family Dwelling District with "CUD" for Conforming Housing on property described as follows: BEGINNING at the northeast corner of said Tract 16; THENCE S 00 031'50" E, 140.00 feet to a point for corner; THENCE N 89 045'35" W, 285.00 feet to a point for corner; THENCE S 15 017'02" E, 186.82 feet to a point for corner; THENCE N 89 045'35" W, 181.83 feet to a point for corner; THENCE N 71 026'36" W, 50.00 feet to a point for corner on a curve to the left having a central angle of 18 °18'59" and a radius of 300.00 feet which bears N 71 °26'36" W; THENCE around said curve, a distance of 95.91 feet to a point for corner; THENCE N 00 014'25" E, 210.00 feet to a point for corner; THENCE S 89 04535" E, 447.21 feet to the PLACE OF BEGINNING and containing 2.23 acres of land. II. That the applicable uses of land pursuant to Section 7 -1002 (1) being subject to the following conditions: 1. No driveway cuts will be permitted on East Ash Lane or on the R2 frontage on Fuller -Wiser Road. 2. The total number of units to be constructed shall not exceed 250 units. 3. R2 lots shall be developed, including water and sewer, and a permit issued, prior to issuance of permits for apartments on R4 zoned land. III. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraph .5, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdicition, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. -3- IV. Penalty for Violation. Any person violating the provisions of this Ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall con- stitute a separate offense, as provided by Ordinance No. 347 and subsequent amendments of the Euless City Charter and Statutes of the State of Texas. V. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 13th day of January, 1981; GIVEN SECOND READING, PASSED AND APPROVED at a regular meeting of the Euless City Council on the 10th day of February, 1981, by a vote of 4 ayes, 1 nays, and 0 absentions.
