HomeMy WebLinkAbout661 06-09-1981ORDINANCE NO. 661 AN ORDINANCE AMENDING ORDINANCE NO. 347 IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "PD" PLANNED DEVELOPMENT FOR CERTAIN PROPERTY OUT OF THE T.JASPER SURVEY IN THE CITY OF EULESS; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED DEVELOPMENT PLAN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as follows. The zoning classification of the following described property, now zoned "C -2" Community Business District to be changed to "PD" Planned Development on the property described as follows. Being all of Lot 18 and a part of Lot 19, Block 14, of Bell Ranch Terrace Addition, an addition to the City of Euless, Tarrant County, Texas, and being more particularly described as follows: BEGINNING at the present intersection of the south right -of -way line of Toplea Drive (a 60' ROW) with the west right -of -way line of F.M. 157 (a variable width ROW); THENCE North 89 degrees 30'00" West, 117.30 feet with the south line of Toplea Drive to a point for corner; THENCE South 00 degrees 06'00" East, 197.55 feet with the west line of said Lot 18 to a point for corner; THENCE South 88 degrees 54'00" East, 102.60 feet with the south line of said Lots 18 and 19 to a point for corner in the west line of F.M. 157; THENCE North 04 degrees 09'00" East, 199.00 feet with the west line of F.M. 157 to the POINT OF BEGINNING and containing 21,777 square feet or 0.50 acres of land as specifically set forth in the development plan as submitted by Applicant dated April 24, 1981, which development plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 334. II. The development plan submitted by Applicant and dated April 24, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such development plan Dated April 24, 1981, shall be applicable only as to the property hereby rezoned. III. The applicable uses of land pursuant to Section 7 -1100, City of Euless Zoning Ordinance No. 347, to be subject to the following conditions. BUILDINGS - (A) Maximum height is 18'08" (B) Minimum floor area is 4,085 square feet (C) Minimum building area (total floor area allowed) is 4,085 square feet SITE - (A) Site coverage (percentage of total tract covered with buildings) is 18.76 percent (B) Minimum building setbacks are (1) fifty foot (50') front yard, (2) fifteen foot (15') rear yard, and (3) twenty -five foot (25') side yard (C) Minimum lot width is 197.55 feet (west line) (D) Minimum lot depth is 102.60 feet (south line) (E) Minimum lot area is 0.50 acres (21,777 square feet) ORDINANCE NO. 661 - PAGE TWO OF FOUR TRAFFIC - (A) Sidewalks four feet (4') wide, one foot (1') outside the property line will be provided along public streets (B) A Minimum of sixteen (16) off - street parking spaces and one (1) loading space will be provided OTHER - (A) A six foot (6') high screening will be provided along the entire western boundary to meet standars of Section 10 -104 Euless Zoning Ordinance (B) One (1) free standing, 50 square foot, thirty foot (30') tall pole sign will be erected. IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. no Penalty for Violation. Any person violating the pro- visions of this ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347 and subsequent amendments of the Euless City Charter and Statutes of the State of Texas. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. ORDINANCE NO. 661 - PAGE THREE OF FOUR PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 26th day of May, 1981, by a vote of 5 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 9th day of June, 1981, by a vote of 5 ayes, 0 nays, and 0 abstentions.
