HomeMy WebLinkAbout662 06-09-1981ORDINANCE NO. 662 AN ORDINANCE AMENDING ORDINANCE NO. 347 IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "PD" PLANNED DEVELOPMENT FOR CERTAIN PROPERTY OUT OF THE T. JASPER SURVEY IN THE CITY OF EULESS; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED DEVELOPMENT PLAN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as follows. The zoning classification of the following described property, now zoned "C -2" Community Business District to be changed to "PD" Planned Development on the property described as follows. Being a tract of land situated in the T.Jasper Survey, Abstract No. 861, in the County of Tarrant; and being more particularly described as follows: BEGINNING at a point for corner in the southerly right -of -way line of State Highway 183 (Airport Freeway), said point being North 89 degrees 54' West a distance of 175.0 feet from the point of intersection of the southwesterly cut -off line and said southerly right -of -way line of State Highway 183 (350 feet wide) and F.M.Highway No. 157; THENCE South 19 degrees 34'30" East along the westerly line of the Humble Oil and Refining Company tract as recorded in Volume 3877, Page 137, a distance of 211.0 feet to a point for corner; THENCE South 80 degrees 38'10" East along the southerly line of said Humble Oil and Refining Company tract a distance of 159.82 feet to a point in the westerly right -of -way line of F.M. Highway 157; THENCE South 0 degrees 52'00" East along the westerly right -of -way line of said Highway 157 a distance of 647.03 feet to a point for corner in the north property line of Bell Ranch Terrace Addition as recorded in Volume 388 -S, Page 52, of the Deed Records of Tarrant County, Texas; THENCE North 89 degrees 47'30" West along the said northerly property line of said Bell Ranch Terrace Addition a distance of 1080.20 feet to a point for corner; THENCE North 0 degrees 03'24" West a distance of 869.42 feet to a point in the southerly right -of -way line of State Highway 183; THENCE South 89 degrees 54'00" East along the southerly right -of -way of said Highway 183 a distance of 843.11 feet to the POINT OF BEGINNING and containing 20.5579 acres, more or less, as specifically set forth in the development plan as submitted by Applicant dated April 20, 1981, which development plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 333. II. The development plan submitted by Applicant and dated April 20, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such development plan dated April 20, 1981, shall be applicable only as to the property hereby rezoned. ORDINANCE NO. 662, PAGE TWO OF FIVE III. The applicable uses of land pursuant to Section 7 -1100, City of Euless Zoning Ordinance No. 347, to be subject to the following conditions: USES - All uses permitted in Section 7 -501 "C -2" Community Business District BUILDINGS- Maximum height is sixty feet (60') or eighty feet (80') where side yards and /or rear yards are each increased an additional foot for each foot such buildings exceed sixty feet (60') in height SITE - (A) Site coverage (percentage of total site covered with buildings) is thirty -three percent (33 %) (B) Front yard setback is twenty feet (20') (C) Rear yard setback is fifteen feet (15') (D) There is no side yard setback except five feet (5') where adjacent to "R -1" zoning district (E) Open space (landscaping and parking areas) coverage is sixty -seven percent (67 %) TRAFFIC - (A) Vehicular access per fire lane easements as shown (B) Sidewalks will be required along both frontages on public streets (C) Minimum off - street parking and loading will conform to Section 8 of the Euless Zoning Ordinance ORDINANCE NO. 662, PAGE THREE OF FIVE OTHER - (A) A minimum six foot (6') wooden fence will be provided along south boundary to meet standards of Section 10 -104 Euless Zoning Ordinance (B) Landscaping provided as shown on plan (C) Sign usage includes those signs being present and constructed in compliance with the Euless Sign Ordinance on this date, plus any wall signs of any area and having a height not to exceed fifty feet (50') IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. V. Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. Effective Date. This effect from City Charter and after and the VI. ordinance shall be in full force and its passage as provided by the Euless laws of the State of Texas. ORDINANCE NO. 662, PAGE FOUR OF FIVE PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 26th day of May, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions; GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 9th day of June, 1981, by a vote of 5 ayes, 0 nays, and 0 abstentions.
