HomeMy WebLinkAbout666 07-07-1981ORDINANCE NO. 666 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "R -4" MULTI- FAMILY DWELLING DISTRICT WITH "CUD" FOR CONFORMING HOUSING FOR CERTAIN PROPERTY OUT OF THE GEORGE LINNEY SURVEY IN THE CITY OF EULESS; PROVIDING FOR DEVELOPMENT OF SUCH TRACT OF LAND ACCORDING TO APPROVED SITE PLAN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "C -2" Community Business District to be changed to "R -4" Multi - Family Dwelling District with "CUD" for Conforming Housing. Being a 5.3480 acre tract of land in the George Linney Survey, Abstract No. 939, situated in the City of Euless, Tarrant County, Texas, and being a portion of Tract A of Lakewood Addition, an Addition to the City of Euless, Tarrant County, Texas, according to the plat recorded in Volume 388 -142 Page 12 of the Plat Records of Tarrant County, Texas, and being more particularly described as follows: COMMENCING at the intersection of the North R.O.W. line of Ash Lane (60 degree ROW) and the East R.O.W. line of F.M. Highway No. 157 (100 degree ROW); THENCE North 00 degrees 12'40" East along said East R.O.W. line 200.00 feet to the POINT OF BEGINNING of herein described tract of land; THENCE North 00 degrees 12'40" East continuing along said East R.O.W. line 328.31 feet; THENCE South 89 degrees, 49'20" East, 500.00 feet; THENCE South OO degrees 14'20" West, 614.89 feet to the North R.O.W. line of Ash Lane for the Point of Curvature of a circular curve, concave to the South, having a radius of 630.00 feet, a central angle of 28 degrees 41'42 ", and a local tangent bearing of North 59 degrees 21'05" West; THENCE along said circular curve in a Northwesterly direction 315.52 feet; THENCE North 00 degrees 12'40" East, 200.49 feet; THENCE West 200.00 feet to the POINT OF BEGINNING and containing 232,958 square feet or 5.3480 acres of land, as specifically set forth in the site plan as submitted by Applicate dated May 12, 1981, which site plan is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 340. II. The site plan submitted by Applicant and dated May 12, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. Such site plan dated May 12, 1981, shall be applicable only as to the property hereby rezoned. III. The applicable uses of land pursuant to Section 7 -1100, City of Euless Zoning Ordinance No. 347, to be subject to the conditions as hereinafter set forth. SITE - Density: 21.9 units per acre, maximum - Minimum Lot Area: (A) Efficiency units shall have 1600 square feet of all land area per unit and shall be limited to thirty (30) percent efficiency units per acre. (B) One - bedroom units shall have 1800 square feet of land area per unit and shall be limited to fifty (50) percent one - bedroom units per acre. (C) Two - bedroom units shall have 2000 square feet of land area per unit. (D) Three - bedroom units shall have 2200 square feet of land area per unit. (E) Over three - bedroom units shall have additional 1,000 square feet of land area per additional bedroom. ORDINANCE NO. 666 - PAGE TWO OF SIX - Maximum Lot Coverage: 40% - Minimum Lot Width: 65' - Minimum Rear Yard: 25' to Property Line - Minimum Side Yard (1): 25' to Property Line - Minimum Side Yard (2): 25' to Property Line Minimum Distance Between Blank Walls: 10' - Minimum Distance Between Windows & Blank Walls: 15' - Minimum Distance Between Window & Door: 30' - Access: Private drives, public streets, alleys, etc., Pedestrian - 3' sidewalks along all right of ways BUILDING - Minimum Floor Area: (A) Efficiency units - four hundred (400) square feet per unit. (B) One- bedroom units - five hundred and sixty (560) square feet per unit. (C) Two - bedroom units - seven hundred and fifty (750) square feet per unit. (D) Three - bedroom units - nine hundred and eighty (980) square feet per unit. - Maximum Height: Height of buildings usable space shall be thirty -five (35) feet, with no limit of roof height - Minimum Masonry Requirements: 80% all elevations - Development Make -up: (A) Efficiency units shall have 1600 square feet of land area per unit. Maximum thirty (30) percent efficiency units per acre. (B) One- bedroom units shall have 1800 square feet of land area per unit. Maximum fifty (50) percent one - bedroom units per acre. (C) Two - bedroom units shall have 2000 square feet of land area per unit. (D) Three - bedroom units shall have 2200 square feet of land area per unit. (E) Over three - bedroom units shall have additional 1,000 square feet of land area per additional bedroom. USES Uses permitted on the eastern 3.8+ acre tract shall be limited to multi - family housing as permitted in the conditions listed below up to a maximum density of 21.9 units per acre provided that the individual lot width, lot depth and lot area standards may be reduced not to exceed twenty -five percent (25 %) from the standards established below and further provided that the sum of these reductions in individual lot area shall not exceed the 1.5 acre proposed permanent community open space in conformance with Section 7- 1111(2) City of Euless Zoning Ordinance. ORDINANCE NO. 666 - PAGE THREE OF SIX The developer shall submit with any Application for Building Permit a detailed Site Plan which shall be used by City Staff to verify the compliance of any proposed construction with the conditions hereby set. Said detailed Site Plan shall include but not be limited to the following: a. Listings of total number of dwelling units to be grouped per number of bedrooms provided in each dwelling unit. b. Listings of lot area provided for each dwelling unit listed in paragraph (a) above. c. Listings of lot area reductions from minimum standards prescribed below: 1. Efficiency units shall have 1600 square feet of land area per unit and shall be limited to thirty (30) percent efficiency units per acre. 2. One- bedroom units shall have 1800 square feet of land area per unit and shall be limited to fifty (50) percent one - bedroom units per acre. 3. Two - bedroom units shall have 2000 square feet of land area per unit. 4. Three - bedroom units shall have 2200 square feet of land area per unit. 5. Over three - bedroom units shall have additional 1,000 square feet of land area per additional bedroom. OTHER - Minimum Off Street Parking Per Unit: Two (2) parking spaces per apartment dwelling unit. No required parking shall be allowed in front of building line of front yards, but will be allowed in side and rear yards. - Screening Requirements: Screening fence to City Standards Section 10 -104 as indicated on site plan - Sign Requirements: As permitted in Euless Sign Ordinance - Permanent Community Open Space: Uses permitted; recreational open space, jogging trails, etc. No structures will be con- structed that could impede flow of 100 year flood waters. A perpetual maintenance agreement of City Standards will be furnished with the Preliminary Plat. ORDINANCE NO. 666 - PAGE FOUR OF SIX IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. M Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 23rd day of June, 1981, by a vote of 3 ayes, 0 nays, and 1 abstentions.
