HomeMy WebLinkAbout667 07-07-1981ORDINANCE NO. 667 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "R -4" MULTI - FAMILY DWELLING DISTRICT ON PORTION OF TRACT B -R, LAKEWOOD ADDITION, AND "R -4" MULTI - FAMILY DWELLING DISTRICT TO "C -2" COMMUNITY BUSINESS DISTRICT ON PORTION OF BLOCK 1, LAKEWOOD ADDITION, SECOND INSTALLMENT FOR CERTAIN PROPERTY OUT OF THE GEORGE LINNEY SURVEY IN THE CITY OF EULESS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "C -2" Community Business District to be changed to "R -4" Multi - Family Dwelling District on portion of Tract B -R, Lakewood Addition. Being a 0.1554 acre tract of land in the George Linney Survey, Abstract No. 939, situated in the City of Euless, Tarrant County, Texas, and being a portion of Tract B -R of Lakewood Addition, an Addition to the City of Euless, Tarrant County, Texas, according to the plat recorded in Volume 338 -142 Page 12 of the Plat Records of Tarrant County, Texas, and being more particularly described as follows: BEGINNING at the intersection of the Southerly R.O.W. line of Ash Lane (60 degree ROW) and the Westerly R.O.W. line of Lakeshore Drive (60 degree ROW); THENCE South 48 degrees 20'00" West along said Westerly R.O.W. of Lakeshore Drive 10.50 feet to the Point of Curvature of a circular curve, concave to the Southeast, having a radius of 674.08 feet and a central angle of 09 degrees 36'26 "; THENCE along said curve in a Southwesterly direction 113.03 feet; THENCE North OO degrees 12'40" East, 159.53 feet to the Southerly R.O.W. line of said Ash Lane for the Point of Curvature of a circular curve, concave to the Southwest, having a radius of 570.00 feet, a central angle of 11 degrees 07'53 ", and a local tangent bearing of South 55 degrees, 48'38" East; THENCE along said curve 110.74 feet to the POINT OF BEGINNING and containing 6,771 square feet or 0.1554 acres of land, as specifically set forth as submitted by Applicant on May 12, 1981, which is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 341. II. IT IS FURTHER ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as further hereinafter set forth. The zoning classification of the following described property, now zoned "R -4" Multi - Family Dwelling District to be changed to "C -2" Community Business District on portion of Block 1, Lakewood Addition, Second Installment. Being a 0.3871 acre tract of land in the George Linney Survey, Abstract No. 939, situated in the City of Euless, Tarrant County, Texas, and being a portion of Block 1 of Lakewood Addition - Second Installment, an Addition to the City of Euless, Tarrant County, Texas, according to the plat recorded in Volume 388 -142 Page 12 of the Plat Records of Tarrant County, Texas, and being more particularly described as follows: COMMENCING at the intersection of the East R.O.W. line of F.M. Highway No. 157 (100 degree ROW) and the South R.O.W. line of Lakeshore Drive (60 degree ROW); THENCE North 89 degrees 41'28" West, 179.91 feet to the Point of Curvature of a circular curve, concave to the Northwest, having a radius of 329.71 feet and a central angle of 14 degrees 08'49 "; THENCE along said curve in a Northeasterly direction 81.41 feet to the POINT OF BEGINNING of herein described tract of land; ORDINANCE NO. 667 - PAGE TWO OF FOUR THENCE continuing along said curve in a Northeasterly direction, having a local tangent bearing of North 76 degrees 09'43" East, a radius of 329.71 feet, and a central angle of 44 degrees 58'43 ", a distance of 258.83 feet to the Point of Tangency; THENCE North 31 degrees 11'00" East, 24.79 feet; THENCE South 40 degrees 48'54" East, 36.67 feet; THENCE South 00 degrees 12'40" West, 144.17 feet; THENCE North 89 degrees, 41'28" West, 239.49 feet to the POINT OF BEGINNING and containing 16,861 square feet or 0.3871 acres of land, as specifically set forth as submitted by Applicant on May 12, 1981, which is on file in the City of Euless Zoning Records and file attached to Zoning Case No. 341. III. Said application submitted by Applicant dated May 12, 1981, shall be incorporated in this ordinance by reference and made a part hereof for all purposes as now set forth in full. IV. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, para- graph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining clauses, phrases, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. 9M Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the Euless City Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347 and subsequent amendments of the Euless City Charter and the Statutes of the State of Texas. ORDINANCE NO. 667 - PAGE THREE OF FOUR VI. Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 23rd day of June, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 7th day of July, 1981, by a vote of 5 ayes, 0 nays, and 0 abstentions. APPROVED: Harold D.
