HomeMy WebLinkAbout671 08-11-1981ORDINANCE NO. 671 AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTIFIED AS THE ZONING ORDINANCE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING MAP; PROVIDING FOR A CHANGE OF ZONING FROM "R -1" SINGLE FAMILY DWELLING DISTRICT TO "R -3" AND "R -4" MULTI- FAMILY DWELLING DISTRICT FOR CERTAIN PROPERTY OUT OF THE SOLOMON HUITT SURVEY IN THE CITY OF EULESS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: I. IT IS HEREBY ORDERED that the Official District Zoning Map of the City of Euless, Texas, being a part of Ordinance No. 347, be amended to read as hereinafter set forth. The zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District be changed to "R -3" Multi - Family Dwelling District. The following described tract or parcel of land situated in the Solomon Huitt Survey, A -705, Tarrant County, Texas, and being a portion of a 5.0 acre tract as recorded on Page 714 of Volume 5386 in the Tarrant County Deed Records, a portion of a 5.0 acre tract as recorded on Page 879 of Volume 6590 in the Tarrant County Deed Records, and a portion of a 75.0 acre tract as recorded on Page 439 of Volume 812 in the Tarrant County Deed Records and being more particularly described as follows: BEGINNING at the Northwest corner of said 5.0 acre tract as recorded on Page 714 of Volume 5386 in the Tarrant County Deed Records and being the Northeast corner of a 3.0 acre tract as conveyed to H. M. Newberry by deed recorded on Page 484 of Volume 3534 in the Tarrant County Deed Records and being in the South lane of County Road No. 3011 (Harwood Road); THENCE S 00 10' 40" W along the East line of said 3.0 acre tract a distance of 287.07 feet; THENCE S 890 35' 20" E a distance of 1360.19 feet; THENCE N 00 07' 55" E a distance of 295.13 feet to the South line of said County Road No. 3011 (Harwood Road); THENCE N 890 55' 40" W along the South line of said County Road No. 3011 (Harwood Road) a distance of 1359.97 feet to place of beginning, containing 9.089 acres of land more or less. The zoning classification of the following described property, now zoned "R -1" Single Family Dwelling District be changed to "R -4" Multi- Family Dwelling District.. The following described tract or parcel of land situated in the Solomon Huitt Survey, A -705, Tarrant County, Texas, and being a portion of a 5.0 acre tract as recorded on Page 714 of Volume 5386 in the Tarrant County Deed Records, a portion of a 5.0 acre tract as recorded on Page 879 of Volume 6590 in the Tarrant County Deed Records, and a portion of a 75.0 acre tract as recorded on Page 439 of Volume 812 in the Tarrant County Deed Records, and being more particularly described as follows: BEGINNING in the East line of a 3.0 acre tract as conveyed to H. M. Newberry by deed recorded on Page 484 of Volume 3534 in the Tarrant County Deed Records and being S 0° 10' 40" W a distance of 287.07 feet from the Northeast corner of said 3.0 acre tract and the Northwest corner of said 5.0 acre tract as recorded on Page 714 of Volume 5386 in the Tarrant County Deed Records; THENCE S 00 10' 40" W along the East line of said 3.0 acre tract a distance of 582.76 feet; THENCE S 890 35' 20" E a distance of 1360.43 feet; THENCE N 00 07' 55" E a distance of 582.76 feet; THENCE N 890 35' 20" W a distance of 1360.19 feet to place of beginning, containing 18.2 acres of land. ORDINANCE NO. 671, PAGE TWO OF FOUR II. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remain- ing phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. III. Penalty for Violation. Any person violating the provisions of this ordinance, or the amendments to the City of Euless Charter of 1961 hereby made, shall be deemed guilty of a misdemeanor and shall be liable to a fine of not more than Two Hundred Dollars ($200.00), and each day such violation shall be permitted to exist shall constitute a separate offense, as provided by Ordinance No. 347, and subsequent amendments to the Euless City Charter and the Statutes of the State of Texas. Imm Effective Date. This ordinance shall be in full force and effect from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless City Council on the 28th day of July, 1981, by a vote of 4 ayes, 0 nays, and 0 abstentions. GIVEN SECOND READING, PASSED, AND APPROVED at a regular meeting of the Euless City Council on the 11th day of August, 1981, by a vote of 4 ayes, 0 nays, and 1 abstentions. APPROVED: Harold D.
